Not sure why Airbus is sueing for $2 billion if Skymark can't come up with the cash. Perhaps they are looking for a partial settlement, but it sure looks like a vindictive move on a company that might go belly-up.

WA4TKG, the Airbus A-330 is the airliner that fell out of the sky and they knew exactly what happened. When the pitot tubes iced over, the computer tripped offline, leaving the co-pilots to decipher what was happening. At the time, the senior pilot was taking a rest break. WIthout realizing what they were doing, the plane was put into a climb and held with the nose up all the way down to the ocean. In other words, it stalled out and fell out of the sky. Only about a minute before they hit the ocean did the senior pilot realize that the co-pilot still had the controls pulled back as if trying to climb.

Not at all. As Skymark was already in breach of contract, there was no obligation on Airbus to perform its obligations. In fact, it would have been foolish to do so as it would have lost both money and inventory.

Not sure why Airbus is sueing for $2 billion if Skymark can't come up with the cash. Perhaps they are looking for a partial settlement, but it sure looks like a vindictive move on a company that might go belly-up.

Airbus is the wronged party here, not Skymark. It is attempting to recover a debt, at least partially. Skymark were not forced to enter a contract with Airbus, thus must face the consequences of their incompetence.

The difference is that in Japan, the incompetent / corrupt are seldom brought to account. Any attempts to do so usually result in @ss-covering in epic proportions. See Olympus.

No, no, no. Airbus cancelled the contract because Skymark tried to completely change the original and signed contract because they suddenly decided that they wanted less planes and thought with incredible arrogance that they could just change the contract that they have themselves agreed and signed upon with Airbus. You can't just come like this arguing that the business is tough and try to renegotiate a contract for your own benefits since Skymark even went as fas as to think that they wouldn't have to pay penalties for the cancelled planes.

Airbus of course doesn't play this silly Japanese inc game, they are professionals and a contract is a contrarct so they decided to stop any deal with Skymark and ther are totally right. Airbus has asked (as again stipulated by the contract) penalties because Skymark didn't fulfill its duties so they are suing them now because Skymark refuses to pay.

Airbus is just following legally the contract Skymark has originally agreed with. This is Skymark which is tying to extort Airbus by violating what both parties have agreed on.

Airbus cancelled the contract because Skymark tried to completely change the original and signed contract because they suddenly decided that they wanted less planes and thought with incredible arrogance that they could just change the contract that they have themselves agreed and signed upon with Airbus. changing the rules halfway through an agreement is common practice in Japan, which is why Airbus doesnt sue Skymark in Japan, theyd never get a conviction. if Airbus win I doubt youll see Skymark ever fly outside of Japan as theyd have to follow international legal rules/laws and not the laws in Japan that offer pathetic punishment for big business

Not it wasn't! The plane that crashed into the ocean was an Airbus 330, a twin-engined double-deck plane, not the four-engined wide-body 380.

Please get your facts right before sounding off in the future! In fact, no "twist of fate", just a twist of facts.

Kind of harsh and it is a public relations mistake. Just because you can do something does not make it the right course of action.

Basically Airbus miscalculated and now they are hitting the panic button.

It was AB that tried to changed the contract not Skymark after AB questioned Skymark ability to pay so they demanded that Skymark become an affiliate with one of the two major Japan carriers for delievery in which Skymark refused and started negotiation for cancellation of contract. AB then again gone against the contract again stating they will not return the deposit of approx. 200 million dollar US beside the cancellation fee to be negotiated.

Now who is changing the terms for their own means?
