2 men arrested after fight over vandalism to car

Police in Yokohama said they have arrested two men who got into a fight after one of them vandalized the other man’s car.

According to police, the incident occurred at around 9 p.m. Wednesday in the car parking lot of a drugstore in Seya Ward, Sankei Shimbun reported.  Police said Go Izuta, 52, who is an unemployed, damaged the car of Kyoka Mase, 25, by striking the door with a tool.

Izuta was also charged with assault after he pushed Mase up against a wall. Mase, who fought back and threw Izuta to the ground, was arrested on suspicion of assault.

Police said the two men were seen arguing, and this developed into a fight. Izuta was quoted by police as saying that he had been drinking prior to the incident. Both men are denying the charges.

Kinda defies logic if someone (a) vandalizes your property (b) throws you up against a wall, that ultimately you get arrested for assault by pushing him back too?

So Kyoka Mase, who fights back in self-defense after being shoved against a wall and having his car vandalized gets arrested too? What kind of crap is this? If some jerk did these attacks on me and my car I'd thrash him within inches of his life. Get Kyoka Mase off the hook, he did nothing wrong here!

This sounds like another example of Japanese bureaucracy lacking basic common sense.

Sure, by the letter of the law and looking at his actions in total isolation, Mase probably ‘assaulted’ the old guy. However, taking into account what had happened previous to that, there’s no way his actions should be deemed assault.

The lack of common sense and flexible thinking in this country is quite often scary.

An 82 year old man reversed into my car in a parking lot. My car was parked and my wife and I were in the supermarket at the time. I was deemed to be 20% ‘at fault’ because my tires on the drivers side were touching the white line - not over the line, just touching. I tried explaining that I was trying to leave as much space as possible for my pregnant wife to get out of the passenger side - but it didn’t make any difference. The police made it an issue by officially reporting that my tires were touching the white line. After that the old guy’s insurance company wouldn’t let that fact go and insisted they’d take the case to court if I didn’t agree. The fact that the other guy reversed into my front right headlight was neither here nor there. Had I been bang center in the space he’d still have hit me.

Totally ditto HBJ: "The lack of common sense and flexible thinking in this country is quite often scary." May I add to that that the J police are ... let's see ... what's beyond "useless"? And their justice system is, at best, whimsical.

A few years ago, a foreign guy got off a train and was going up the stairs when a Japanese guy just came up from behind and kicked him in the leg. ?? So, the guy grabbed him by the arm and took him to a koban, only to be told he (the foreigner) could be charged with assault.

I was deemed to be 20% ‘at fault’ is common in Japan even though your tires were in the middle of the white lines they would have found another reason to blame you, perhaps you went shopping at the wrong hour or the time wasn't correct, or for whatever matter you'd get hit with the 20% automatic at fault.

that’s a very personal and defensive reply. Means some people have pushed buttons and hit the truth with what you get defensive about here. In any case, it means no such thing, nor have people called them “meek” or “humble” (or “stoic”) besides themselves.

First, as I understand it if you are only 20% at fault, you'll still get money just a little less.

Second, everyone has a story as to why they did not follow the rules, but you still broke them, and you've just confessed to it.

Third, such rules save a significant amount of time for everyone because if it had to be fought in court, you'll have to record exactly where your car was to the centimeter, then hire experts to prove that the fact you did not park your car properly made absolutely no difference to the situation. 

Fourth, the rules also create an incentive for everyone to keep to the rules as much as possible, because in case you get hit, you'll get more money if you followed the rules exactly than if you did not for what, in this case, was ultimately for your (you+wife) convenience.

First, since the car was already vandalized by the time he showed up, justifiable defense cannot apply to the bit about the car. Only the bit about him being shoved against a wall can be put in the justifiable defense bracket.

Second, Kyoka is half the age of Go, a young man in his prime. There is a legitimate question of excessive self-defence (disproportionality) as he "threw Izuta into the ground".

To put it another way, suppose unfortunately Go Izuta hit a hard curb or something and died to that throw. Would you have been as quick to excuse or justify Kyoka Mase's actions?

The old 20% at fault rule gets most people at some time or other, simply explained to me one day as oh but if you wernt there then he wouldnt have crashed into you, so therefore you have to accept some blame..... WTF Japanese logic is totally illogical.

But yeah, touch some one here even in defense and you can be charged, crazy laws carried out by crazy police men n women.

So the unemployed guy was drunk before 9PM? Well, lock em up and throw away the key. He was definitely not practicing Social Distancing.

So let me get this straight. If someone attacks me or my wife and I defend myself or my wife or son, or protect my family from someone dangerous wielding a weapon because the police aren't there, I'll be arrested? Then why do they have all these karate, judo and other forms of self defense classes if when you defend yourself, you'll be arrested? Come now, Japan.....surely you jest with this level of senselessness!

How about if a professional fighter is attacked, what should he do? If a woman is defending herself from a rapist, will she be arrested? This makes no sense, Japan.

Two men caught brawling in a car park, of course they both get arrested and hauled off to the police station.

There they can both be properly questioned and the truth discovered, and proper action taken.

If the police had simply taken the word of either man and arrested just the other, you would all (rightly) be complaining about police gullibility.

There will be a proper investigation, questioning of witnesses, hearing from the two brawlers, and blame assigned appropriately.
