Man arrested for assaulting drunk bar customer who later died

A 45-year-old man has been arrested on an assault charge after he injured an intoxicated male customer at a bar in the Kabukicho district in Shinjuku, Tokyo. The customer later died from his injuries, Fuji TV reported. 

According to police, the incident occurred at around 11:30 p.m. Saturday. Police said Masashi Kagawa, who is self-employed, put a 50-year-old intoxicated man who was acting in a disorderly manner, in a headlock. The man lost consciousness.

Police were called and arrested Kagawa on suspicion of inflicting bodily injury on the victim. However, the man died in hospital early Sunday morning.

Kagawa was quoted by police as saying he did not know the man and that he took action to protect himself against the man who was starting to get violent.

Police said they plan to change the charge to causing injury resulting in death.

Surely there were witnesses who can attest to this being legitimate self defense or not. Its always a bit tricky because there are people who like to goad others to violent action then pummel them and claim self defense. And they have friends who will vouch for them. But its really annoying how the Japanese government frowns upon people defending themselves and others.

Could be self defense. I guess that will be determined by witnesses.

"Man arrested for assaulting drunk bar customer who later died" I think this should be some type of Murder charge not assault. Sure alcohol was involved in this incident BUT don't blame the alcohol blame the man drinking the alcohol. Alcohol should never be used as an excuse for the dumb CRAP people do when they drink alcohol. This happened around 11:30pm at that time of the night these guys should have been at home snuggling up with nice warm woman, Not at a bar doing dump stuff.

That is a tricky situation. So what your supposed to do when an aggressive drunk attacks you? Just sit there and let it happen? Run away? And once in the middle of a drunken conflagration, where exactly to stop? Aggressive drunks are not likely to tap out and give up like in a Judo match...

Clearly this sounds like a case of self defense resulting in an accidental death.

Drunk people are very unpredictable especially if you don't know them. This guy took appropriate actions to protect himself with NO means or intentions of killing anyone. Its the same as if someone shot an armed burglar with the intent to kill. Would the home owner be charged? Of course not. Its a defense situation.
