Man served 6th arrest warrant for drugging intoxicated woman, sexually assaulting her

Police in Tokyo have served a sixth arrest warrant against a 35-year-old man on suspicion of sexually assaulting an intoxicated woman after drugging her with sleeping pills.

Police said Yoshiaki Kajiwara, a restaurant worker, has already been charged on five similar counts, Fuji TV reported. According to the latest warrant, Kajiwara approached a drunk woman in her 30s who was seated on a Tokyo train platform in July 2020. He asked if she was OK. He then gave her a drink laced with a sleep-inducing drug and took her in a taxi to his home where he allegedly sexually assaulted her.

Surveillance camera footage showed Kajiwara assisting the woman as they left the station.

Kajiwara has been in custody since being arrested in November after he allegedly drugged an intoxicated woman in her 20s, in front of JR Shibuya Station in March, and took her home in a taxi, where he had sex with her. Kajiwara also stole the woman’s credit card and cell phone.

Police said four other women have implicated Kajiwara in similar cases, but he has remained silent since his arrest in November.

If he drugged her and she was unable to give consent, he didn’t “have sex with her”. He raped her.

This is incorrect. He was arrested in November and though the article doesn't say it, has almost certainly been detained continuously since then.

When police make an arrest in Japan they can hold the person in custody for up to 23 days before a prosecutor has to make a decision on whether to indict them or not. Usually they use this time to interrogate the suspect and seek to extract a confession. If they want more time (because the suspect doesn't confess) a trick they do is to simply re-arrest the person (who is still in custody) for a seperate offence, which has the effect of giving them another 23 days.

So that seems to be what they are doing here, and why he has been subjected to six separate arrest warrants. He isn't roaming freely, he has been in jail since he was arrested in November.

Unless specifically stated, it cannot be assumed that is the case. In Japan, sexual assault and rape often goes unpunished or underpunished. So, it's also quite possible that he hasn't been detained continuously since then.

I know quite a bit about criminal procedure in Japan and I can say with rock solid confidence that he is currently being detained.

Its important to note that at this stage he isn’t being punished - that comes after conviction and sentencing which haven’t happened yet. Right now he is being held in detention pending a decision by the prosecutor to indict him or not, after which he would proceed to trial and then that stuff would take place.

Right now he doesn’t yet have a right to bail or release, he is just sitting there being interrogated while the prosecutors build their case.

Unless specifically stated, it cannot be assumed that is the case. In Japan, sexual assault and rape often goes unpunished or underpunished. So, it's also quite possible that he hasn't been detained continuously since then.

It would be nice if that major bit of info could be confirmed via other news sources.

We all know why there's this lengthy piled up arrest warrants - no confession. Why can't the Police and Prosecutors man/woman up and win the case in court? Are they really that incompetent (not a question)?

Considering that this is Japan where rapes are rarely if ever prosecuted, it would be a miracle if he even spend a single day in jail. Find me a case where a rapist in Japan had to serve any time in Japan? You'll have to dig really deep because 99% of them either get their cases dropped or only get a suspended sentence. Rape is effectively de-facto legal in Japan because it is never enforced.

SERIAL RAPEST that's what you call a guy like this.... And I hope he get's life in prison without parole .... Their are so many women available & willing to have sex in Japan that their is no reason for a guy to drug a female and rape her. Obvious that this guy has serious issues ( and lets not say it's Mental Illness ) lets call it a Sick Fetish that most likely will never go away so to protect women he should be sent to prison until he dies....

Where do you get this information from as it is not on the article.

I highly doubt that since he is not talking that he would submit to a DNA test they still have to have his permission to take it. otherwise it would be illegal in Japan.

This is a clear example of why you should have a safe plan to get home if you're going out drink and plan to get mashed up proper. Because you'd have predators like this creep on the lookout for prey like this innocent victim.

That's the key word - RAPE. It takes two to tango/tangle. She didn't say yes, he did it and this is the same thing Bill Cosby did. And he had 62 counts on him.

It clearly says in the article he has been in custody since November.  they are basically sweating him to get as many confessions as possible before taking the cases to court.  It's how the system works here.

Why this is additional news is more of a question.  he is already in jail.  Guess it was taken from a Satsu press release or so.

It's 6 distinct rape cases (counting) piling up on his plate. After his arrest in November, his DNA and mugshot allowed to identify him for 5 other pending cases.

They don't seem to even know what drug was used "a sleep-inducing drug " which means they only have circumstantial evidence at best. 

A video of a guy taking away a sleepy victim PLUS her rape kit PLUS her stolen belongings found on him... it's not bad for evidence. At least one case is very solid.

You are assuming she was administered a rape kit, unless you have more specific information relating to the case that I do not (Please Provide it so we can all see it) this is after all Japan so you should presume that she was not administered a rape kit (considering her CC was left behind).

Did you know here in Japan the rape victim is required to pay for the rape kit upfront and other medical fees and not all hospitals are able to administer a rape kit it also costs upward of 100,000 yen. Sure it is reimbursed once you have filed. But Japan doesn't make it easy for a woman to accuse somebody of rape.

Did you also know that the definition of rape in Japan is different from other countries.

The definition of rape according to Japanese law (Article 177 of the Criminal Code) is as follows: A person who, using violence or threats, has sexual intercourse with a female person over the age of 13 shall be guilty of rape

He is remaining silent for a reason the Japanese police like a confession to make it simple to keep their 99.9% conviction rate.

In this case I agree with the cops and they probably have a solid theory but unfortunately that seems to be all they have. They don't seem to even know what drug was used "a sleep-inducing drug " which means they only have circumstantial evidence at best. Perhaps if enough Victims come forward they can establish a pattern which might be enough for a conviction.
