They are suing him for damages on allegations he has not been found guilty of? Jumping the gun a bit, down you think?

If Nissan was making all these payments and they weren't supposed to be and didn't know about it they should fire their CFO and entire Finance Department management.

Corporate governance issues, not crimes. These new reports are making Nissan boards and executives look incompetent. Maybe shareholders should sue Nissan next for poor management?

And the Nissan Accounts Department, Legal department, executives who also signed off on these deals? Think the whole thing stinks more day by day. It's a daily leak of negative information designed to besmirch Carlos and gain public "understanding". While not explaining (if any of it is true at all) Nissans rubber stamping of these alleged criminal activities. Go for it currently he owns a leach for court, a pair of paper slippers some squares of toilet paper. All much needed by Nissan.

This guy will probably spend most of the year behind bars and what if he is found not guilty? Will he be compensated in anyway. Oh what am I thinking? The verdict is already in. This is Kabuki theater.

Compensation not going to happen, 2 or 3 days ago on this site was the story about an Osaka man jailed for 6 years, turns out he was innocent applied for compensation and was told no, no explanation just no. So I think being given a plane ticket would be about as far as compensation goes.

It looks like Nissan is timing this announcement to coincide with ghosn's bail request and appeal to strengthen the "media" trail and help the prosecutors keep him in detention.

The media reports are all based on the prosecutors drip drip drip leaks of information and are using the media to convict him before there's a trail. If the really have a case they should just go to trail and prove it, but I doubt they have a very strong case though.

The media makes it sound like the houses in Brazil, Paris, etc were bought by Ghosn, but isn't it true that they are in Nissan's name? Instead of paying rent Nissan purchased the house and Ghosn was allowed to use it, they all still belong to Nissan. And, as for the salary that wasn't they say was fixed and declared, if Ghosn is found guilty Nissan owes him the $50M, right? On the other hand, if Ghosn is found innocent then it means the amounts were not fixed and Nissan doesn't have to pay.

What damages? All financial salary is reported by your accountants and CFO, that picture of Saikawa is cringe to look at.. He set this up

And general it's like this: the little criminals goes to prison, the big criminals will walk free. But this time it looks different.

If I read all what happend, that remembers me at the Clans (from Lebanon) in Germany, where all the big "family" is involved to cheat in every criminal way possible.

Nissan is acting like the prosecution, the prosecution is acting like the judge, the judge is acting like the prosecution's secretary, which leaves the media to play executioner.

Nissan make it sound like he had control over the entire bank account. All payments would have been known to the accounts department who were paying for them.

I went to a car show, and the lead man was looking at the Century, the other twenty stay in line, like a snake, if the head of the snake (like C.Ghosn), goes bad, they all follow still.

I still think H.Saikawa can pull the Companies through, and I don't think there is much point in spending long on C.Ghosn, there is much to do in the car industry right now, like Nissan should do a good HYBRID !

Some of you folks are to brainwashed by the negative media.. Media is always full of lies. Remember WMD, Y2K.. People behind the scene want to direct your judgement on the wrong cause.. Saikawa and Co set this up to break the alliance.. It's the truth..

If you have this kind of mentality, you won’t be able to climb the ladder of the corporate world. You’ll be stuck at the bottom. You are assuming that the Nissan board are a bunch of incompetent “yes” men. If that’s correct then Nissan is in big trouble. If not, then they are a bunch of scums. Either way, it paints a bad picture for Nissan. I personally will never associate myself with anything Nissan unless they can clean up their board esp. Saikawa and his cohorts.

Then again, if Japan doesn’t have a dark side then here will be haven. Heaven on earth. I think the revolting state of its justice system balances everything out. Now we can freely say, in terms of justice, Japan is at par with NK and China. Other than that, all is good.

Wasn't Nissan in the gutters just before Ghosn took over? Would I shed a tear if Nissan dropped back in the gutters?

In a sane world this type of civil suit would come after a conviction.

Unfortunately this case/situation has devolved into the bowels of repugnance and it seems little makes sense anymore.

In a perfect world the man would have bail (with severe restrictions on movement) and would at least be able to talk to his family, the prosecutor would press formal charges and a trial would take place. If found guilt a punishment would be administered and then (perhaps even simultaneously) this type of civil suit would be considered/brought forth.

Obviously we are not in a perfect world.

They don't understand their corporate governance so they will show the world they don't have any, just to condemn one man out of spite, and take down the rest of the company with them. No wonder Renault board won't talk to Saikawa. This was probably timed after that rejection. Also this confirmation of a lack of governance of Nissan should ruin any future prospects and again give gaijin executives more than just pause when considering Japan but outright withdrawal.

There hasn't even been a trial yet let alone any convictions so this civil suit literally has nothing to work on.

This makes it look like Japan hasn't a clue what it's doing and Japan Inc. should probably rein in Saikawa's ongoing blunderings.

These extra charges are to keep him in detention for the whole year. The prosecution knows that he will be detained for fear of fleeing or evidence tampering. Thus, Nissan will have grounds to remove from office at Renault because he cannot meet his duties as chairman and CEO.

I hope Renault stick to their guns and keep him on at some capacity, so he can come back with vengeance!

Achilles heel of people like Ghosn is abuse of powers. The special CEO fund is very questionable. There are many ways that Nissan can get rid of Ghosn, and the cheapest way is to explore Ghosn's expensive spending.

Ghosn can fight on, no doubt about it if he chooses. The special fund must be designed very easily to be disposed by Ghosn, so legally he might not be guilty of wrong doings. However the cost maybe too high for him and his family. At some points, he should cut a deal to avoid the lengthy process.

Japanese prosecutors are very capable and tenacious, according to movies and novels. Although Ghosn has read several thrillers since in the jail, he might have no resources to fight on because he is basically cut off connections with close associates who maybe able to help him.

I was curious about why Nissan's Dutch joint venture unit Zi-A Capital BV has paid the Renault senior executive compensation instead of pay by the Renault Company because he was not held any position in the Nissan - Renault alliance Company. It seems to be the Nissan's Dutch Holding Company was created for to hide their illegal activity by Carlos Ghosn and his confidants. The Nissan's Dutch joint venture unit money was used for his own personal use, to pay his sister and brother for nothing doing for Nissan and his close associates from Renault and Nissan.

Sadly, at some point a few months late, the Japanese prosecutors will dangle a carrot in front of Carlos. He "confesses" to dipping into the honey pot, bow to the cameras and he is free to go home, leave the country, whatever he wants. Totally not fair, but Carlos would need to evaluate how much taking this stand is worth to him. If he were a martyr for his people sure... but in the grand scheme of things, if he sticks with it, he's a rebel without a cause. This stand will not change Japanese law, societal rules, etc. He could sign the "confession" be done with it and enjoy the rest of his life. It was a set-up and I'm sure his countrymen would be on his side of the story. So what would he care of the Japanese public possibly think him to be a criminal.

Carlos, save your energy. Get out and plan your Oceans 11 job on Saikawa and the Nissan cronies. Lol... be free, go back to France and have them make you CEO of Renault again, then make life hell for Nissan. Carlos is most probably guilty. Everyday it's getting worse for him as more of his criminal acts are unveiled. You can call it unfair because I guess 90%+ of CEOs of big firms are doing the same kind of things - and so he thinks he was entitled to do the same - and he will be the only one to pay, but that's certainly not an excuse for him, he'll have trouble explaining that to the judges.

I agree the case has exposed the total ridiculousness of the Japanese Judicial system, but Ghosn is not treated worse than other convicts.

As for the facts, if they are all true Ghosn will be behind bars for a long long time....

now not only Ghosn will be in prison, but he will get out a poor man...

His wife had better divorce him before judges grab all their assets...
