I feel sorry for Kelly having to face the charges by himself. Hopefully he'll be found innocent of all charges.

The irony is that the Nissan executives, Nada, Saikawa, and others, have caused 1000x more damage to Nissan and Japan than what Ghosn might have "done" if ever he is found guilty. Nissan shareholders and the Japanese people should sue both Nissan and Japan Prosecutors for costing the people millions of dollars.
dbsaiya
The defense should eat up the prosecution's witness Saikawa as a credible witness.
sakurasuki
Even if Carlos Ghosn were still in Japan there's nothing he could do, since they won't allow him to contact each other at all. Even worse Carlos Ghosn just facing hours interrogation without lawyer just like he had in the past.

This case have many flaws in the beginning, just it check here, necessary evidence to support is also included.

Mickelicious
Feel?
Nasty. How is anyone meant to process that?
Serious obstruction. Mistrial?
sakurasuki
Almost Two years? Build case and arrest the person, what happen in Japan is really opposite.
Billion pages of documents only can be opened on a computer at legal team's office with addtional 70 boxes of material, yet only the time that is given only two weeks. While the other side can access that freely for years.
Fiddlers
System is rigged in Japan to support the prosecution and the judges nearly always side with them so I don't think Kelly has much chance. On a positive note white collar crime usually ends up with a suspended sentence so he probably wont do any time although pleading not guilty doesn't go down well here.
Mickelicious
It's career suicide for judges not to side with the prosecution.

@justasking: this article has more details on the shameful behavior of Nada and Saikawa (with particular emphasis on the former), with video of the humiliating raid of the home of an Indian Nissan employee in Yokohama: https://www.bloomberg.com/features/2020-ghosn-nada-nissan/
We're used to reading about Japanese government officials and corporations being informed of these raids in advance; this time a gaggle of officials showed up, threatened to break the man's door chain, and got indignant when he criticized their tactics when the raid was over.
Somehow this kind of treatment never happens to connected figures like Saikawa!

Like the Japanese Justice system
exactly

Do you mean, Ravinder Passi? He is british born person, his previous role is gobal general console in that company and had role to investigate about scandal. At some point he just asking about conflict of interest the people who report Carlos Ghosn to authority based on evidence he had, also integrity of evidence that were given to the authority. Since it's obtained in questionable way.
Next thing he know he got demoted and his house is being raided.
Mickelicious
Surely that's a British Nissan employee, or does pigmentation matter, too?
AgentX
Except that there will be 'expectations' that the defense doesn't get out if line...

ThonTaddeo mentioned this above, but, just to make it stand out more. this is an excellent article:

Shame on Nissan! Shame on Japan for it's sickening justice system! I will never even consider buying Nissan again. Never.
mtuffizi
unbelievable and shameless. like they have nothing to do but takes so many years
to build up a case. how about saikawa and the rest? just bowed, apologized and got a free pass. why japan treated foreigner so differently? why?
Gobshite
When is the trial of the Japanese execs starting? I thought so...
ThonTaddeo
@sakurasuki and Mickelicious, yes, Mr. Passi. I guessed he was Indian based on his name and face; I am happy to be corrected. The point is that he isn't Japanese, and he was treated with malicious contempt.
sakurasuki
In the beginning of 2019 other execs, Jose Munoz was promised nice package but only if he flew back to Japan while he was in US at that time. Luckily for him he decide not to go Japan and leave that company. After he received concerns from Spain's Ambassador to Japan and also from US.
Nobody knows what will happen to him if he decided to go back to Japan at that time.
GW
The above is PURE EVIL!!!
Clearly it is impossible for a defendant to even have a chance to prepare for their CONVICTION!!! In Japan there is almost 0 chance to prevail in the ""courts""
sakurasuki
Others white collar crime in Japan only end up, all executives bowed in front of public without involvment in court at all.

""He believes the real motive was a “corporate coup” to oust Ghosn by others at Nissan who feared he might engineer a takeover by its French alliance partner, Renault.""
The Truth may never come out, but many know that Nissan was never happy about joining Renault, so it come as NO Surprise that this could be the main reason why they wanted Mr. Ghosn out.
Ascissor
I read in the Asahi this morning that Nissan secured massive finance from a government investment body, with the government (i.e., you, me, and other taxpayers) guaranteeing two thirds of the loan. It's a very unusual scheme and doesn't it just feel great to be propping up such a charming company.
Bugle Boy of Company B
Well that wasn't a particularly long wait.

Your prayers are meaningless, Mr. Ghosn.

""Saikawa replaced Ghosn but resigned last year over financial misconduct allegations of his own. He has not been charged.""
Typical Good Old Boys Justice, home boys walk, strangers get locked up.
bokuda
Lucky guy, really lucky!
The MOJ has no credibility whatsoever outside Japan... although the Taylors judge didn't get the memo.
drlucifer
Long but interesting article, if there is anybody out still thinking it wasn't a corporate coup then they need their brains checked. Hari nada what a scum of a man. He will be used and when there is no more use for him will be duscarded like used tissue, I have been through that and know what I an saying. Like a plaque I would advise any foreigner to avoid working for a J-company.
Arrrgh-Type
A complete outrage. But don’t worry, Nissan’s got KimTaku in their commercials now, so everything will look just fine to the average Tanaka.
Pukey2
Let this be a lesson to any foreigner wishing to take up a high position in a Japanese company in Japan.
indigo
Do not forget that Japanese lawyers in Japan serve the GOV interest. and check the number of Japanese lawyers who has been disciplined only in Tokyo, you will understand. Justice is a comedy here. I hope you believe in God or in supernatural thing Mr Kelly
GW
Foreigners in director & above roles must be CRAPPING their drawers now, especially if they are located in Japan!!!
Note to Japan..... Your plan for Tokyo for a financial center just DIED BIG TIME!!!
Personally my next step up here would be to a director level but no way in hell will I ever take that on even though I am at a small company, simply way too risky!! Hell we truth be told we dont even have to be a director or higher, days like this make me wish I lived somewhere ELSE!!!
Do the hustle
If Kelly is smart he’ll blame everything on Ghosn because ‘Ghosn is gone’!
AramaTaihenNoYouDidnt
"Tickets!! Tickets for the most famous fraud legal show in Japan!! Kelly innocent, Saikawa found guilty!! Tickets!!"
jeancolmar
"Let this be a lesson to any foreigner wishing to take up a high position in a Japanese company in Japan."
Don't work for anything in Japan.

Odd. I wonder what's different about Saikawa than Kelly and Ghosn. I guess we'll never know.
Michael Machida
The Japanese System was created by Japanese people. Stop blaming the system.
garth
Not if it's blameworthy.
sf2k
the show trial begins. Kelly shouldn't speak at all, there's no point
garth
@Michael Machida
It's absurd to suggest, as you seem to be doing, that a system created by a particular society is somehow sacrosanct and should be immune to criticism by 'outsiders.'
Goodlucktoyou
Give him 5 years if he rats on Ghost and his wife.
Vanessa Carlisle
Japanese prosecutors et. al are really doing a bang up job making Japan look like a judicial crap hole. Those "people" are a national embarrassment.
Random
If he rats on Ghosn and his wife, I’d let him plead guilty to a misdemeanor, sentence to time served, and no fine... and Bob’s yer uncle.
