And they're only taking action now? I smell a rat.

I literally said this was going to happen. Now watch them put out an Interpol red notice for her. My guess, she'll be picked up and used as a bargaining chip to get Ghosn back to Japan. Just gotta watch the timing of it, she'll probably be on her way to a country that has an extradition agreement with Japan when it happens.

Mark my words, Ghosn isn't winning this one. He gave Japan a new deck of cards and they aren't afraid of using it.

Pretty sure this action is motivated by vindictive feelings by the MOJ. Like a child breaking there own toy to prove a point no one cares about. I'm also sure her travel plans won't be including countries with extradition treaties with Japan....and that is a whole lot of places. It s amusing to see the foot stamping from the MOJ.

Exactly. There was almost certainly no plan to arrest her a week ago. This is purely a political move by the justice system and a vindictive one given that they have no hope of extraditing her. Justice is meant to be above politics, but a way of finding the truth. But not in Japan.

No doubt this is retaliatory. On the other hand, on general principles, the odds favor them having a case if they choose to pursue it. If Ghosn's wife showed up to trial, she probably was briefed by the defense counsel on exactly what to say, which also is to say, she did not tell the whole truth. For example, she probably "forgot" anything that was inconvenient.

Of course, everyone plays this game and contradictory testimony is a regular in courts, so perjury is a substantive crime but reserved for the most blatant abuses. Experienced lawyers know how much de facto slack they have within a system and coach their witnesses accordingly to get the best possible testimony without exposing them to perjury charges.

Usually this works out, but considering what Ghosn's wife was almost certainly involved in, I'm not exactly shocked the screws came on this time.

That will be huge sacrifice from Ghosn that can take years, while court and prosecutors make preparation Ghosn had to continue his limited freedom in bail. Beside that from day to day his former company can made up unpleasant surprise to him that can add more charge.

Even if he successfully manage to win his first court, prosecutor will bring him to higher court and that will take years.

Look, it isn't that hard. To even know there was an individual, they must have a witness or other evidence. Now, suppose Ms. Ghosn says "No we never met" or "I don't remember meeting him."

There is a contradiction and thus a reasonable suspicion Ms. Ghosn is lying (especially since Ms. Ghosn is the wife of Mr. Ghosn and the witness would be in a more neutral position).

The only question is, whether to do something about it, or content yourself with making the defendant witness' testimony look as un-creditable as possible.

Did she do her testimony under oath?

I cannot recall that and believe it was a voluntary answering to questions.

Article 169　When a witness who has sworn in accordance with law gives false testimony, imprisonment with work for not less than 3 months but not more than 10 years shall be imposed.

The key word is bolded - a suspect, accused or defendant is not a witness. Further, procedurally they are not requested to swear.

So, they've obtained an arrest warrant in Japan.

I suppose they will be looking to have INTERPOL issue a Red Notice next.

However, France has said it would not extradite its citizens to another country. And Lebanon has no extradition treaty with Japan.

And, unlike Carlos himself, I just don't see too many foreign courts / governments / jurisdictions being all too sympathetic to Japan wanting to go after Carole. Doesn't matter if Japan might have evidence. It just all looks too vindictive and calculated. And it makes Carole look like a pawn Japan is using to get to Carlos.

But, of course, I fully expect Japanese prosecutors to pull all of their tricks out of the bag. One thing I know. Prosecutors, no matter the country, HATE losing and HATE being embarrassed. And with the full resources and power of the State behind them, they can be pretty vindictive.

By the way, two can play this game. Maybe France should issue an arrest warrant and get an INTERPOL Red Notice for Tsunekazu Takeda. The guy is dirtier than dirty.

Surely, he can seek damage in civil court. But that is possible only after he wins 'not guilty' verdict in the criminal court. He actually had a good chance of winning as his lawyers said, but he threw it away. He lost his case, and he will never be able to clear his name.

Oh, absolutely. And I think Carlos knows that. And is prepared for that, in some way. I think that he resigned himself to that in setting all of this up. What I do know is that France will never use Carole as leverage against him.

So pathetic, what next ? They already took illegaly her passport thinking to pressure Carlos and what she did was simply to run away with her other passport. Did she get arrested few days later by coming back ? Not at all as persecutor...oops prosecutor has nothing against her.

The last time Carlos Ghosn wanted to organize s press conference after winning bail in Japan, he was re-arrested and thrown back to jail. Now a day before his scheduled press conference in Beirut, they have issued an arrest warrant for his wife. Shameless bullies Japanese prosecutors. Japan has extradition treaties with only 2 countries, the US and South Korea. The Ghosns must make sure they don't travel to these countries. They should remain in Lebanon and enjoy their life.
