Driver who killed pedestrian during police chase gets 5 years in prison

A 32-year-old woman was sentenced to five years in prison for dangerous driving resulting in death by the Tokyo District Court on Monday.

According to the court ruling, Marisa Nakagawa, who worked at a bar in Kawasaki City, was driving a car being pursued by police when she hit and killed a woman pedestrian on May 20 last year, Sankei Shimbun reported. The incident occurred on National Route One in Tokyo’s Ota Ward at 12:50 p.m. About 15 minutes earlier, Nakagawa had been asked to stop her Mercedes by police after they had received a report about a car moving about suspiciously in Shinagawa Ward.

As police began to question her, Nakagawa took off. During the one-kilometer chase, Nakagawa went through several red traffic lights, then sped along a sidewalk for about 60 meters, hit another car and finally a concrete wall surrounding a garden outside an apartment building. A 34-year-old woman was walking by when she got caught up in the crash. The woman, Yu Takahashi, was rushed to hospital but died from her injuries.

Police said that at one point during the chase, Nakagawa was driving at about 120 kilometers per hour. Nakagawa was later arrested at a nearby apartment, where she had fled to on foot after the accident.

After her arrest, Nakagawa told police she remembered driving away while being questioned, but couldn’t recall the details of what happened after that. A subsequent medical examination revealed that Nakagawa had been taking stimulants.

During the trial, Nakagawa's lawyer said that a man had injected her with the stimulants while she slept at his place the night before. However, police found a glass pipe on her after her arrest, and DNA from the pipe matched hers.

She remembers being injected by a man, the police, but not killing the pedestrian. How unusual...

Just imagine what would be the sentence if this was a 32 years old man???

This sentence is a very BAD and sends the wrong message to both the victims and the criminal sides in this case, this ruling should be APPEALD.

Yubaru

Here in Japan they would call a mercedes taxi a 高級車, it's the brand they are talking about, not the actual cost. Even a used Mercedes here would be consider one as well.

She bragged about the car and showed pictures on Instagram. It was a brand new AMG SL63.... google it if you do not not know that vehicle. NOT your local Taxi...

they showed the car on the tv news & stated it was a 高級車

And about her making more? Doubt it, not during CORONA at least.

Japans first CRACK head just got off easy. She was driving an expensive Mercedese could mean she had money and she bought the best attorney money could buy and thats why she got off cheap! Caught with a crack pipe means she was a habitual user and it finally caught up to her.

The police is to blame, too. The car chase quadrupled the dangers of her in the wheels.

I agree in principle, but in this case there was no chase. The police wanted to talk with her (people had been reported her as behaving strangely), and the jumped in her car and took off. The footage is probably still you Ytube.

The Mercedes involved in this accident has been reported as valued at "nissen man yen" (20 million yen) and the woman driving it was not the owner.

the fact that she was driving a very expensive Mercedes Benz tells us that she has money

Maybe not so much. She lived in a 40,000 yen howel in Kawasaki, very much incongruent with the luxury cars that she posted about in Instagram. The Benz was most likely paid for by a boyfriend.

5 years is too short for that. The Japanese sentencing system is weird.

The police is to blame, too.

Dang if they do their job. Dang if they don't.

No, they are not to blame, not even a tiny bit. They were doing their job. You should read the article again and you'll see it was not even a chase.

Everytime I hear about a pipe, I gotta think about Chris Rock on Marian Berry.

"Smoke crack got his job back. Who did he beat? What were they, on heroin? Don't vote for crack, vote for smack!

Don't do drugs, you won't be nothing.

I can be mayor!"

Let's see...taking drugs, speeding, resisting arrest, dangerous driving, driving on a sidewalk, going through red lights, damaging another car, destroying a concrete wall, HITTING AND KILLING someone, lawyer lying about the circumstances, taking no responsibility. Five years. Light isn't even the correct word for this! Talk about a travesty and a miscarriage of justice! The judge should do fifty years for her then.

I'm surprised she didn't get a suspended sentence on top of those 5 years.

cocaine is a hell of a drug!

And what about that old man who hit and killed the mother and her daughter while trying to blame it on faulty brakes? Oh, right! 2 diffrerent justices! One for the famous and known and one for the normies!

3 ( +4 / -1 )

I agree. The verdict is lenient and unbalanced in reference to similar cases and precedents. The prosecutor should consider appealing to to the higher court.

They won't, because they only asked for 6 years to begin with. Definitely something fishy going on here.

I generally skew on the side of lenient punishments with a focus on rehabilitation, contrary to a lot of posters here, but even to me this seems excessively light.

I do hope she ultimately gets help for the drug issues, but that generally doesn't seem to be the driving force in Japanese correctional facilities.

This case really does check off a lot of "Oh this pisses me off big time" boxes.

Recklessly fleeing police? Check.

Violating numerous important traffic rules? Check.

Driving car on sidewalk? Check.

Doing 120 in what was probably a 40 or 50 zone? Check.

Driving an expensive Mercedes? Check.

Killing an innocent young women who had many years of life ahead of her? Check.

Showing callow indifference to the above killing by just running away? Check.

Being high on illegal drugs while doing all the above? Check.

Lying about being on drugs? Check.

We've seen people get 5 years just for drug offences here - never mind the driving offences and the manslaughter / murder.

8 ( +8 / -0 )

Five?

How about 50.

4 ( +4 / -0 )

I think 5 years is far too lenient given the details, but the nonsensical way sentences are imposed in Japan is scary. When two people can get vastly different sentences for the exact same crime, that's not good.

Justice system needs a complete overhaul, it is not a neutral system. It’s who you are who you know. Not what you did.

3 ( +4 / -1 )

5 years. For killing a person with a car. Fleeing the police. I really feel that our justice here is like a playing dice - you throw, get a number, look up in the sky, then think of a number and sentence that person. No multiple sentence in this case.

6 ( +7 / -1 )

@joey, it wasn’t really a chase. She sped off and they soon lost sight of her, whereas they found her disabled and abandoned car. She was caught on cc camera casually taking an elevator trying to make her escape.

4 ( +4 / -0 )

Silly, silly woman, She is VERY lucky she only got 5 years. It's as if the victim's life didn't really matter that much.

7 ( +7 / -0 )

Japan legal system is just crap!

15 ( +16 / -1 )

I think the maximum sentence for vehicular manslaughter is 7 years.

It's much heavier. In this particular hit & run case (under influences), I think she's supposed to get 22 and 1/2 years.

Lenient sentence because she is a woman?

7 ( +9 / -2 )

zichi, thanks for the info. In the Japanese penal system, can sentences be cumulated? She did illegal drugs, lied, fled the police, reckless driving, killing one person.

If I remember correctly, she was some high-end hostess

7 ( +7 / -0 )

Of course, the woman deserves a heavier punishment. But why was it necessary for the police to chase her. If they had the number plate details, they could have picked her up later. Perhaps too many US action films are interfering with sound judgement.

-6 ( +4 / -10 )

Somebody lost their daughter, friend, cousin for 5 years?

13 ( +13 / -0 )

5 years? Wow. How did they come up with 5 years? A 34 year old woman lost her life for 5 years?

13 ( +13 / -0 )

NOT ENOUGH TIME IN JAIL YOUR HONOR.

Obviously this person has NO RESPECT for the law or human lives. She runs away from a police officer, then reaches 120km/h speed kills a woman and destroys properties then hides, and then blames others for her actions and gets only 5 years in prison!??? is this a joke or am I reading it wrong?

6 ( +6 / -0 )

@yubaru

If she was working at a ‘bar’, she probably earns more than you, thanks to her ‘customers’

4 ( +7 / -3 )

Light sentence. Under drugs at that time. Women special treatment, as they often get lighter sentences, or gender equality respected ?

6 ( +8 / -2 )

Five years for killing someone. Seems like a light sentence for taking someones life. Am I right or am I right?

15 ( +15 / -0 )

The make of the care was just added here for titilation. If it were a domestic car, other than a Lexus, odds are, there would have been no mention of it in the article.

Added, to make it seem like she was a rich, entitled female.....but wait, she worked at bar.

Either way, she got off lucky

the fact that she was driving a very expensive Mercedes Benz tells us that she has money

How do you know it was a "very expensive Mercedes Benz?" Also there is no mention that she was the owner of the vehicle either.

You can buy a Mercedes here for around 1 Million yen, that is hardly "very expensive".

People just assume things I guess.

-2 ( +5 / -7 )

What an animal. Should have got 30 years. She will still be young when she gets out, and there will be few barriers to get back into her line of work. Sickening, when the innocent woman she killed will never have such freedom.

12 ( +12 / -0 )

The victim side should also seek compensations through civil trial

Definately !

the fact that she was driving a very expensive Mercedes Benz tells us that she has money

Life is cheap in Japan.

You can say that again.

The " judgements" seem so arbitrary and nonsensical it boggles the mind. But hey, who am I ? Their country, their people, their laws.

14 ( +14 / -0 )

Reckless driving, DUI, vehicular homicide = 5 years. Japanese justice is a joke.

I agree. The verdict is lenient and unbalanced in reference to similar cases and precedents. The prosecutor should consider appealing to to the higher court. The victim side should also seek compensations through civil trial (I guess they have done so alraedy)

she should get 5yrs just for this pathetic excuse

5 years? She will be out in 3. A disgrace! Should have been 25 years at least. Her selfish stupidity killed a 34 year old and ruined the lives of her family and friends.

The sentencing in Japan sometimes seems to defy logic and reason.
