A lot of legal problems in Japan start 72 hours after arrest. In most advanced normal countries a judge would probably determine veey quickly that there are mental issues in a case like this. (Setting fire to a shirt in a hotel room would suggest this).

But as usual the judge rubber stamps the police/prosecutors demands.

Do most people that are rejected by women set fires and stab others?

Does anyone in any situation set fires and stab others?

Yeah, its weird, but its also irrelevant to the outcome of the case.

But even the defence concedes that the attack happened and the defendant did it. So again, why is it relevant?

Do most people that are rejected by women set fires and stab others?

It's legally relevant because it makes the fact of the attack more probable.

I blame the AV industry here. Those flicks make it seem like Japanese women are always hungering for some.

I agree to a large extent (but maybe blame is too strong a word). The image of Japan that some foreigners have is completely warped by the internet, animes, etc.

According to the Japan Times: “Gross said he committed the crime to vent his anger after being turned down by women.”

Thanks. Odd that that wasn't included in this article.

1 ( +1 / -0 )

It is included in the story and the headline.

Andrew Crips -

Probably meeting women is easy but whether women want to go with a guy like him is a completely different story.

Perhaps he thought it would be easy, he thought Japanese women would easily be picked up by an European guy, turned out it wasn't that easy.

2 ( +2 / -0 )

The defendant "was upset at failing to pick up women at a bar that night

In a country where meeting local women isn't that hard, I wonder what the real story is.

Is the victim going to be compensated for his "light injuries" will he get his medical bill's paid by the attacker, who is going to pay for the concealing, I am sure the 50 YO Japanese man is going to have flash backs over the attack, he is going to need some help in the future.

1 ( +1 / -0 )

"stabbed a Japanese man in his 50s multiple times in the neck", I think the sentence is pretty light to be honest, "But the court reduced it believing the victim's injuries were relatively light". really? what planet are you from? Will he be incarcerated in a nice Hokkaido prison? will all of his sentence be in Japan or will he be sent home to carry out his full sentence their?

1 ( +1 / -0 )

Only 6 years?

4 ( +4 / -0 )

Alcohol defense?? Hay, he was sober before he took that first drink.

2 ( +2 / -0 )

He got less time because the injuries were light? What kind of nonsense is that? Usually stabbing someone in the neck will be guaranteed murder and the victim was lucky as hell. I'd be pissed if I was him, "yeah, you probably should have died, but in the end your injuries weren't that serious so obviously that should mean less jail time, if you had actually been disabled for life then maybe he'd deserve the whole 12!"

No, I'm asking for the evidence that demonstrates this guy committed these acts simply because he was rejected by women.

And that is relevant because...?

Motive isn't actually a necessary element of a criminal offence. Intention is a necessary element that has to be proved (and motive can establish intention but it isn't independently something which needs to be proven). It doesn't seem to be in dispute that he intended to stab the guy multiple times. What specific event drove him to do it doesn't really seem important in this case.

Interesting that the defence tried to pull the "Diminished responsibility due to alcohol" lurk. Often it works even with drugs like "ice".

When? I’ve never seen an example of this working in Japan.

Er....so you are asking for a logical and rational explanation for why a drunk guy would set his own shirt on fire, then go out and stab a complete stranger multiple times in the neck?

Just let the futility of that quest sink in for a moment.....

This smells. It would be nice to have a bit more information on this as the motive seems highly unlikely to result in the criminal actions which occurred.

I'm also shocked a German would do this. They seem like such nice people, at least in my travels around Southeast Asia.

Reckless

Some guys walk around with the attitude of “I’m gunna get action tonight!”. This attitude in some guys is actually very dangerous and I’ve had to knock some folks out flat who put their hands on others like they owned em.

Tobias Gross, 25, stabbed a Japanese man in his 50s multiple times in the neck on a street

the court reduced it (the 12 years sentencing) believing the victim's injuries were relatively light.

Something doesn't seem right. Stabbing someone multiple times in the neck usually results in death, but this guy survived!? Good on him! Don't take out your anger on innocent people because your pick up game is WEAK AF! Lock this big baby away in a prison offshore somewhere.

That's like a slap on the wrist for the crime he committed.

Yep, he gets 6 years while the victim is scarred for life physically and perhaps mentally.

4 ( +4 / -0 )

Six years for attempting to kill a random victim for absolutely no reason. Just six years. That's half of what the prosecutors were going for and what he deserved. That's like a slap on the wrist for the crime he committed.

papigiulio, which part in two posts above is your comment?

I will go for 8 years. Then deportation

Tobias Gross, 25, stabbed a Japanese man in his 50s multiple times in the neck

Prosecutors had sought a 12-year sentence during the lay judge trial. But the court reduced it believing the victim's injuries were relatively light.

I don't care how light the injuries were, he STABBED a guy multiple times in the neck. Also set a tshirt on fire in the hotel. Helloooooo. 6 years is not enough.

It is hard to understand how some men believe they are so entitled to a woman's attention, company, and body, that to be refused means they have to kill. This is why domestic violence is so common

It may be easier when considered in the context of patriarchy. Men have been in control since humans evolved from apes.

Make no mistake, I think it is repugnant how women are treated.

Maria

Agreed! Working in bars and clubs for several years did that for me.

There are angry frustrated unstable people walking around who are a danger to those around them.

7 ( +7 / -0 )

It's hilarious how so many posters are swallowing the motive given by the judge without any supporting evidence.

It seems like alcohol defense no longer works in Japanese court.

When did it ever work in a Japanese court? I've never seen an example where someone was excused for being drunk.

9 ( +10 / -1 )

I think it's pretty gross what he did.

3 ( +4 / -1 )

Yes, this story appeared out of nowhere a couple of weeks ago and will doubtless now disappear forever. I suppose we will have to scour other media sources to discover what actually happened.

Quite so! But probably not worth the effort! Seeing as how the actual attack happened over 1 year ago!

Cops couldnt get a confession, hence the suggested sentence by the prosecutors. Prosecutors here tend to go for the proverbial jugular when they cant get a confession, and on occasion they lose like here!

2 ( +3 / -1 )

Attempted murder? So the other guy survived after stabbing in the neck? Lucky he is in Japan. Any other places and he would get shot down. Traveling all this way just to pick up women. His vacation just extended to six years in prison.

5 ( +8 / -3 )

Read too many stories about how easy it is to pick up girls here. But it is not, specially if you are not attractive enough and strange. I guess girls realized how crazy this guy was and kept safe from him

It seems like alcohol defense no longer works in Japanese court. Now the German psychopath is going to have six years of rent-free living to cool his hot head.

...another man loses his child-like mind, has a tantrum and tries to kill somebody because he didn't get what he wanted.

Pathetic. Six years to think about that sounds good...

9 ( +12 / -3 )

Crazy man stabbing people in the neck. You don’t want people like that walking around.
