Nissan confirmed both were true, but denied there was any conflict of interest. The company said it considered it inappropriate to contact Ghosn or Kelly because the company and they were co-defendants.

What a load of horse manure!

“This report confirms that Nissan's investigation was biased, lacked integrity and independence, and was designed and executed for the predetermined purpose of taking out Carlos Ghosn,” the lawyers said in a statement.

Hell ya! And those guys are Japanese. Lets see them get accused of Japan bashing .

This from 17 Jan. 2020, Japan Today: “The report found Saikawa received an excess of around 96.50 million yen ($877,000) before tax via stock appreciation rights, and six other executives were overpaid under the scheme by a total of 57.72 million yen. Nissan expects the amount to be repaid by March.”

So if Ghosn misappropriated funds like Saikawa who could he not gotten the same reprieve as Saikawa? Return X number yen by March?

There is a double standard in Japan. Japanese get the breaks. Foreigners are broken.

Go to Nissan official web site and read original press release. You have English version for those.

Hah, now that Ghosn is no longer being held hostage and under threat of re-arrest as soon as he tries to publicly refute this hit job I wonder if Nissan and the prosecutors are going to stop making these kinds of statements which are easily disproven and only give more attention to what a disaster this is!

Ask Goshn yourself but he could not explain in a fair trial. You are presuming guilt and he could ne be failry tried. Understand the principles of fair law and human rights fundamentals !

It's him who run away from such trial. and 99% conviction rate cannot be any excuse (US is also 99% including plea of guilty bargaining). His rebut so far .... [It's all business and it's all signed off internally]

I believe he has taken advantage of his situation, like many executives of large companies.

That cannot be any excuse either at all. Whether it is judged as a breach of trust under corporation law

or not, that only matters.

Oman route and Saudi Arab route, very exotic for the media but everyday business for a CEO like Goshn.

Please explain how can a man of no threat be taken as a criminal when getting down from a plane ?

Explain, explain, explain !

The same reason why the prosecutors wouldn't allow for the bail for the suspect with quick footwork.

Funny how the naysayers clammed up the moment the evidence became overwhelming. I still recall the derision I received when I said the accusations didn't pass smell test. The vindication is all so delicious.

Yokohama-based Nissan says Ghosn “single-handedly" decided on his compensation.

Nissan and Tokyo Prosecutors can't bring Ghosn down. He "single-handedly" run Nissan and the alliance which consist of 180,000+ people, which obviously now that he's gone the alliance is collapsing esp. financially.

Only thing Tokyo Prosecutors "can" do is illegally leak information to the media and claim that Ghosn's statements are one-sided.

No news of this fellow lately. He is also still on the payroll.

Anyone convinced of his innocence cares to explain suspicious "Oman Route" and " Saudi Arab Route", needless to say, that include reflux scheme to his(and his son's) private funds

@talaraedokko

Put yourself in the shoes of a foreign HQ thinking of sending your best man to Japan to do business.

Most foreign corporations have given up on Japanese markets.

Put yourself in the shoes of a foreign HQ thinking of sending your best man to Japan to do business. He / she reads the Japan business section in the local media. They wonder if they're safe. Will a husband accidentally stick his foot where he shouldn't. He's put away unable to see the spouse & family. Conflicting signs. Ghosn BS おもてなし.

Today I fear more for the future of Japan than for Ghosn or Kelly. We're no longer in Edo. This has all been transferred to the international court of opinions. Japan is on the defense and the judges are waiting for answers.

@showchinmono

Ghosn's lawyers already asked the prosecutors the reason Saikawa had not been charged similarly in summer last year. They must know why and just don't refer to it

I think everyone knows why,

This is Japan

Educator60: I've been searching the Internet for the source of your above quote and have been unable to find it using Google.

That quote is: “The report found Saikawa received an excess of around 96.50 million yen ($877,000) before tax via stock appreciation rights, and six other executives were overpaid under the scheme by a total of 57.72 million yen. Nissan expects the amount to be repaid by March.”

Could you give me your source and its date?

Especially How come Ghosn himself did not spend time enough in his press conference to clear this charge, where no one can read well what were agreed and stipulated on written approval signed off by misc persons?

Saikawa is a backstabber!

biased, lacked integrity and independence

Speaks volumes.

Nissan says Ghosn “single-handedly" decided on his compensation.

The Nissan board of directors “single-handedly” approved the compensation for each board member.

Yokohama-based Nissan says Ghosn “single-handedly" decided on his compensation.

This is impossible. His salary would have had to have been cleared by the board of directors. I'm starting to understand why the prosecutors kept delaying his trial. It wasn't so they could build a stronger case against Ghosn. It was to give Nissan a chance to clean up all their bookwork to make it look like Ghosn acted on his own.

"Saikawa resigned last year over allegations about dubious income. He has not been charged."

Welcome to the land of the rising double standard. The foreigners are charged. The Japanese gets a slap on the wrist with a wet noodle.

I presume Saikawa got to keep his dubious income.

speechless

“This report confirms that Nissan's investigation was biased, lacked integrity and independence, and was designed and executed for the predetermined purpose of taking out Carlos Ghosn,” the lawyers said in a statement.

This is exactly right! Whatever Ghosn and Kelly may (or may not) have done, what is clear that there was no attempt to fairly get the facts. There certainly was no presumption of innocence by those involved in Nissan with ousting Ghosn.

No, this was exactly as Ghosn's lawers described. A concerted, coordinated hit job undertaken together by the Japanese authorities and the J management at Nissan. Specifically, Saikawa.

15 ( +17 / -2 )

Saikawa hasn’t been charged with a crime despite under reporting his income? No double-standard to see here, folks. Move along.

Ghosn lawyers rebut new Nissan claims against fugitive exec

Some headline. They wouldn't be very good lawyers if they didn't.

8 ( +10 / -2 )

Nissan can't put together a real case, just make accusations. The more they bleet the more we learn. Good catch bythe defence lawyers to show the conflict of interests. If nissan had a case it just fell apart again

Also Saikawa was never in jail so as long as that is true this will never end for nissan

15 ( +19 / -4 )

Poor Kelly. I wonder how long be will be detained.

And at the end of it, will he be able to get a fair trial.

It seems, now they have to charge him with something coz if he is charged with nothing it would be as if they admitted that Ghosn too had done nothing or that the evidence they had against him was not sufficient from the very start...
