Seriously, I've asked this before and I'll ask it again: What exactly is it in some poster's psychology/upbringing that compels them to believe violent rape at the hands of fellow prison inmates a valid and indeed preferable form of punishment for something like child pornography?

You'll get no argument from me that child porn and the filth that procure and peddle it should be eliminated from society as stridently as possible.

But to that men . . . getting raped by other men . . . is a nifty idea sort of suggests you're missing the entire point of why society needs to strive against abominations like child porn. Rape fits right in there with child porn, folks, no matter who's doing it or who's having it done to them. So the word that leaps almost immediately to mind when I read about posters giggling with glee at the possibility that a convicted sex offender will get raped in prison is one of utter "hypocrisy."

Being raped certainly isn't going to scare or traumatize pedophilial tendencies out of offenders. In fact, there isn't a very large body of evidence to suggest the value of most sorts of corporal punishment as an effective deterrent against violent crime. All it teaches offenders is to be more careful next time, which you can be sure they will be when they get out of prison.

An eye for an eye just doesn't cut it any longer in the kind of society we live in. We have to handle these types of societal cancers by being smarter, not more brutal.

No adult has any right to molest, beat, harm, violate, batter etc. any child and display this cruel reality online for the world to see. Children are the next generation. We should admire and value their innocence. Hence a child does have the right to be protected and unharmed.

You are definitely right about that! I advocate three eyes for an eye. Let me explain: The criminal only has two eyes, so we take them. That way he loses all of whatever function he harmed in the other person. Then, to show the consequences of his actions, we take one more eye from someone he loves. Then criminals will think twice before doing something: If they commit a crime, they serve a double sentence and their wife, or girlfriend or child is ALSO going to serve a single sentence.

I'm of the opinion that punishments do not fit the crime. Based on some of the posts here, I suspect mine is the minority opinion. Allow me to explain my reasoning, and feel free to disagree.

I read recently of a man who received 10 years in prison for rape. He traumatized and violated a young girl. With good behavior he can be out in 7 years or less. Contrast this with the punishment of a man whose crime was not to harm or injure a girl, but merely to trade or possess photos. He received in excess of 20 years in prison. This happens a lot. To me, the man who actually committed the act, is much more deserving of punishment then the one possessing photos. So why is it not punished accordingly? When ones crime is rape and violence done personally, and the others is that of clicking yes to download on their computer, which is worse?

I admit, it feels like walking on eggshells. On the one hand, I don't condone kiddy porn at all. I want to see these people locked up as well. But then I hear about sentences of 20 years or more, for possession of photographs, and then hear of a sentence where a man rapes and injures a young girl and gets just a few years in prison, and I think, is this justice? How is possession of a photograph, worse then going out and raping, or killing someone? Admittedly this is from a US perspective. Japan is kinda nuts on the subject, but the US is crazy in the other direction. A nice middle ground would be good, where those who share this kind of material would get a few years in prison, and have to register as sex offenders, and rapists etc got 10-20 years.

Remember, several attractive female teachers have jailed for molestion, etc on teenage boy students in America in recent years. It wasn't them complaining. It was the parents. Most of us here were teenage boys. And most of us fantasized about a teacher at that time. So please, give me a break with this molestation is equal to violent rape idea.

Thank you EZTokyo for injecting some sense and compassion into this discussion. Those who condemn this man know nothing about how the US "justice" system works. This man is my friend, and I am a mother of an adolescent boy. I KNOW my friend was not involved in this criminal enterprise. He had the misfortune to play online games on a server that also was being used for criminal purposes. All those who are active online should beware of getting involved in online activities of ANY sort on privately run servers. You, too, could get implicated in a criminal conspiracy, be kidnapped by the FBI while transiting through the USA, tortured until you signed a plea bargain, and condemned to rot for many years in an overcrowded US jail.

90% of criminal cases in the US are resolved through plea bargains. My dear friend exhausted his and his family's resources in trying to fight this charge. After almost two years, he saw no option but to accept a plea--and worked very hard on the wording of that plea.

Criminal conspiracy in the USA requires no direct evidence--he was condemned by the perpetrators, who hoped to reduce their sentences by naming those who were merely gaming on their server. His sentence ended up being only slightly less than those who were central to this horrendous crime. The US authorities did not even have enough evidence of his guilt for the Canadian police to justify seizing his computer.

So please, those of you who are suggesting horrible things should happen to my friend, be more compassionate. This lovely young man has had his life ruined by a group of criminals. The US is currently on a witch hunt and the "justice" system is happy to bind just about anyone and throw them into the pond to see if they float. Unfortunately, my friend is sinking fast.

PLEASE do not believe what the US authorities are saying about this case--I know my friend is not the only innocent man suffering unfairly for the crimes of others in this case. There's a reason the US has the highest per capita inmate population in the world.....

Thanks, Frank Vaughn-- I too want the vulnerable protected, and in this case, it is my friend who is now vulnerable--he was entirely innocent of any wrongdoing but implicated via the USA's weird "criminal conspiracy" laws. After paying $200,000.00 to US lawyers, he is still burdened by this disgusting conviction and horrible penalty. How many more people need to go through this before the US comes to its senses? This particular crime is now being tried by McCarthy-era "justice" processes.

I was interested in your perspective right up until the accusation of torture on the part of the FBI in order to allegedly coerce Mr. Tachino to plead guilty. And of course, the generous application of words liek "horrible" and "disgusting" when it comes to the convictions and penalties handed down in this case to 16 co-defendants doesn't inspire confidence when placed alongside the severity of their crimes.

It bears noting that according to a U.S. Department of Justice article on this case, that Tachino wasn't arrested simply because his account information happened to be on the same server that the Lost Boys child porn ring was using.

From a DOJ report:

"Lost Boy had a thorough vetting process for new members, who were required to post child pornography to join the organization. Once accepted, members were required to continue posting child pornography to remain in good standing and to avoid removal from the board. According to court documents, Lost Boy members advised each other on techniques to evade detection by law enforcement, which included using screen names to mask identities and encrypting computer data."

Mr. Tachino wasn't arrested for just happening to be on a server. He was arrested for being a member of this particularly bulletin board. And in his capacity as a member of group seeking to not only break the law, but also not get caught, he, as well as every other member of the Lost Boys group, could and rightfully were charged with, among other things, conspiracy.

You seem to think that having been charged with conspiracy somehow magically made it easier for Tachino to be arrested and convicted. It didn't. Joining this bulletin board, fulfilling membership requirements for this bulletin board, then getting caught as a member of this bulletin board, not because of a U.S. law enforcement "witch hunt," but rather based on tips from Eurojust, the judicial cooperation arm of the European Union, as well as information from Norwegian and Italian law enforcement authorities, made it easier for Tachino to be arrested and convicted.

Honestly, he's lucky to have gotten off with just the conspiracy charge. You can be sure that those who produced the actual porn will have several more years tacked on top of those already levied for their part in the conspiracy. Some men convicted and sentenced walked away with 22 years in prison or more.

I doubt procecutors would have been particularly compelled to buy the "hapless gamer" excuse for Tachino or anyone of the handful of U.S. and Canadian men involved in this case. Short of having an even more fantastical explanation for being an electronically verifiable member of the network dedicated exclusively to trading child pornography involving young boys, I can't see how he's been given any less than he deserves.

Perhaps if you know pertinant details that would exonerate Mr. Tachino, I'm certain the Department of Justice (or Mr. Tachino's defense attorney) would be willing to listen.

As long as the individual is off the streets and unable to reoffend, I couldnt care less what happens to him in jail, but certainly do not wish him well. The children that were abused have to live with that abuse for a lifetime, and though I dont advocate getting out the old pitchforks, he should also have to live with the consequences of his actions for the rest of his life. The least owed to those children is justice and the knowledge he will not be free to repeat his offences.

I don't know what type material this guy was arrested for but allot of the mainstream publications printed in japan would be considered child pornography in many US states..I have had many Japanese men, ( Fisheries Technicians), employed on factory trawlers that I operate off shoe of Alaska. Most of the Magazines and news papers these men read have nude photos of young girls and some pictures list the ages as 16yo..In The US nude pictures of 16 yo children is Child pornography and illegal..In some of the magazines these Japanese employees have left on board our vessels many of the pictures appear to be of girls much younger than 16yo....Very apparent that nude pictures of teen agers being published in mainstream print is common and culturally accepted as the norm in Japan.

You'll get no argument from me. Again, as I said in my earlier post, we need to be smarter about crime deterence, not simply aply some contrived interpretation of "tougher." "Tougher" doesn't always work and it certainly doesn't always fit the crime. In the scenario you presented, it beggars reason that the one act (violent rape) can result in a significantly lighter punishment than the other (downloading -- not producing, but downloading child porn).

Then again, I would rank the 6 men in the U.S. arested and charged with child molestation as equally vile, if not more so, as someone who commits rape. In any case, both acts are obscene violations of a person's fundamental human rights. It begs the question, how does society confront such violations in a way that is meaningful?

Nothing strange about it at all when one realizes you're not only gratuitously rewriting my opinion, but also stripping it of the context it had in my brief discussion with Molenir.

My statement was precisely this:

I'll rephrase it for you: I don't think a non-violent crime like downloading or looking at child porn should receive a harsher sentence than rape.

Think of it in terms of drug dealers versus drug users. Dealers, IMO, are a far worse scourge on society that the users they prey upon.

The analogy is a poor one. First, the ones producing the drugs are rarely mistreated (though they're probably stuck once they start working for a cartel). Second , drug dealers are a distribution point and serve a secondary role in the acquisition of new "customers". Third, the end users (in the case of most illegal drugs) have acquired a physical dependency on the drug.

Compare that with child porn. The ones producing the product ALWAYS mistreat the "actors". The sites making the product available on the internet are trolling for new "customers". And the customers are not compelled to use the internet service.

In both "businesses", the true victim is at opposite ends of the production chain.

You have forgotten that some people busted for child porn were minors who took pictures of themselves! Or, I don't know, maybe you consider that self-mistreatment?

And more than that, your argument sounds similar to old arguments against all porn, where it was assumed the woman was always mistreated, as it harmed her reputation. Brooke Shields took some pictures and made some movies that are considered child porn now. I don't see her complaining.

I could live with it if you claimed 90 percent were mistreated. But ALWAYS? In CAPS? Come on.

Not in the case outlined in the article above. You're dragging entirely different "What ifs" into the discussion that have little bearing on a group of men pointedly going out of their way to produce and distribute child pornography through a dedicated website.

I was speaking more towards the dynamic behind society wanting to lock up drug users along with drug dealers. Yes, drug dealers get sentenced with relative strictness. But possession of drugs sometimes results, IMO, in some pretty asinine sentences when compared against what I consider to be the far greater crime of producing and distributing.

But your points are just as valid. Although, could you be more specific about this:

It sounds here like you're saying that someone who goes out one day and decides to produce/sell drugs/child porn is just as much a victim as actual drug users and child "actors." Am I misinterpreting this somehow?

The average recidivism rate across all forms of crime in the US and UK respectively are roughly 60% and 50%. However, recidivsm rates for violent crime in the US tend to be lower. In states with the most brutal prison conditions such as Arizona and Nevada the state recidivism rate is 24.6 and 29.2. States like California and New York, which focus more on rehabilitation (relative to other US states anyway) have much higher rates of recidivism. So there is a lot of conflicting information as to what methods of imprisonment reduce repeat offences.

I don't believe in prison rehabilitation. I firmly believe that prison should be a punishment. Light, open air, and the ability to exercise should be the first things to go when entering a prison followed quickly by human contact and time refrence. Right now it's more like summer camp for fellons, a summer camp full of rape and shivs but it still allows them to develop their criminal skills and establish contacts. Eliminate the social dynamic.

Prison should be an aweful place. I don't encourage prison rape, I actually avdocate a style of imprisonment that would render such acts impossible. Full duration solitary confinement.

I am going to put my money on the idea that most of the members knew pretty well what their fancy was ever since they as old as the boys they desire. If society did more to identify those boys at that age, the whole situation could be nipped in the bud. Instead society tries to sweep it all under the rug, and this is the result.

Yes. Drawing nasty pictures should surely come with long, long jail sentences. And also, penning nasty stories should too! Then we can move on to ridding the world of people with other disgusting ideas, so as the people who draw tentacle porn.

A normal prison has social meals, television, libraries, exercise equipment, and outdoor time. These should be rewards for the very best, most complient of prisoners. Not the norm. The only way a person can be in prison is if they stripped another person of their rights, their property, or their wellbeing. It stands to reason that in exchange for such a violation a person should at least begin with only the most basic of human needs. They can work to get the rest back, and maybe someday they may earn their freedom in the eyes of the law.

You deal with them by making a promise. That if they stray back into their old ways, if they miss their parole meetings, if they deviate from the course they promised they would take as part of their release. I don't believe in rehabilitation. I believe in punishment. Many people are cursed with horrid and/or self-destructive tendencies. By putting it on his bulletin board, he "created" access to the child porn. If the bulletin board had advertising banners, then he was "selling" the access. In order to make the child porn available to others, he had to "possess" access to the child porn. He was prosecuted in the U.S. for what he was making available to people IN THE U.S.

If you're going to make things available on the internet that might be considered illegal in some countries, it is YOUR responsibility to ensure the potentially illegal content isn't delivered to those countries. This IS doable. A manga scanlation group I use will block access to certain scanlated titles by country if that title has been licensed for publication in that country. Once "Spice & Wolf" became licensed for U.S. publication, the scanlated version could no longer be displayed on computers in the U.S. It's done by IP address ranges and is based on where a particular Internet Service Provider is located.

This guy had no interest in doing that, though, because what he was making available is illegal EVERYWHERE. Here's the flip side of this story, once he finally DOES get out of prison, every other country his porn was sent to can prosecute him as well.

JF143 you are so very right, just look at the case of Mr. Strauss-Khan. The U.S. has done away with their constitution when it comes to ANY accusation of sexual misconduct. And you can only receive justice if you have enough money to throw at the problem. The politicians and judges "support" this treatment of accused people because the American people are so paranoid about sex that it gets them easy votes for re-election.

But don't get me wrong there is need to protect those at risk especially children, but reason has to be put back into the equation.

I am just as against the abuse of children as anyone. But this Spanish Inquistion method of (cough) dealing with it is as twisted as it will be fruitless toward the goal of protecting children. In fact, I expect it to do quite the opposite, and by what it read about abused kids these last few decades, particularly in North America, I beleive it already is.

Dozens of child victims were identified and located in Norway, Romania, Brazil and other nations during the course of the investigation, including 27 in the United States.

How odd that the U.S. is mentioned at the end as if the number of victims make up a tiny proportion of the total. Americans were major players in this. The denial of the fact and attempts to pin the blame elsewhere won't help any kids either.

How many of them actually did harm a child? Pictures don't harm, the photographer does. Like for guns. Not saying it is right but perhaps some never went ahead because of those pictures. So sad anyway. Difficult to tell with so little knowledge of involvement...

Sure it won't prevent the occasional sick pervert who should be thrown in jail for harming minors, but it would prevent the casual pervert.

It's very similar to the introduction of services like iTunes and spotify for the music industry. Lawsuits didn't reduce illegal file uploading, giving people a legal option did (even if the option is still limited but good enough for most people)

He not only got a whopping 17 years for this oddball charge, he also got a life sentence of supervision. He would not have gotten that for "conspiracy to advertise snuff films". Think about that for a second.

Rape fits right in there with child porn, folks, no matter who's doing it or who's having it done to them.

Sorry, but no. Not all rapists are into child porn, and not all who own child porn are rapists.

You are definitely right about that! I advocate three eyes for an eye. Let me explain: The criminal only has two eyes, so we take them. That way he loses all of whatever function he harmed in the other person. Then, to show the consequences of his actions, we take one more eye from someone he loves. Then criminals will think twice before doing something: If they commit a crime, they serve a double sentence and their wife, or girlfriend or child is ALSO going to serve a single sentence.
