You're right, I didn't look into this specific case. But the way the Japanese police work is that they arrest someone on a crime to hold them which gives them 23 days to investigate while the suspect is locked up. Then, within that 23 days, they regularly 're-arrest' the person, under the new charges they intend to bring. In western countries, we generally refer to this as 'pressing new charges', but it's a peculiarity of reporting on Japan that the reporters use a more direct translation describing being arrested again, rather than the more natural translation of 'pressing new charges'.

Then, sometimes, the police will even press new charges later on, "re-arresting" the person. Still in custody from the first time.

But I haven't seen anything to indicate this case is different than other cases where suspects in Japan are "re-arrested" while still in custody, and every time a bunch of foreigners here freak out about it, not realizing what I've said all along:

No, they would have locked him up the first time, then as they press charges, they "re-arrest" him, while still in custody. He's never sent on his way. As I have said earlier in this thread:

Um, that's how it works in Japan. They arrest someone, and then when they have new charges, the re-arrest the person they still have in custody. This guy has been 'arrested' three times, but while I haven't looked, if this is the one special case where they did release him in the middle, whereas in all other cases they report a re-arrest the person was still in custody, I'd be amazed.

@Hiro Every country has their own laws you mentioned that the wife has to willing testify against him. Let me say this had this happened in the US the first report he would be under the jail. We can thank OJ for that. All a women or man has to say is they are abused and if their are signs of it someone is going to jail. Lets say if it was a man and he abused his wife if the police is called out and their are physical signs he is going to jail. Lets say there is a report and he is locked up a court date set and it is up to the prosecutor to say whether or not their is a trial she can refuse to testify but if the prosecutor wants to bring the case forward its a done deal especially if the guy has more than one call to that address or DV cases on file. Making a threat is just as worse as doing the crime. Second he has to worry about Bubba his cell mate. One thing you do not want to do is go to jail in the US on a DV, rape or child molestation charge because now your fate is in the hands of the inmate population and people who go in with those charges don't do well inside. My question is the wife had been injured many times and this guy made threats what does it take to put this guy away?

@Sanjinosebleed, it depend. Firstly the wife gonna have to actually be willing to testify against him. Which usually is hard to convince the victim when they are reliant on the abuser in their relation. Secondly police would need to do a investigation and have concrete proof to actually indicte him. Thirdly bringing his case to court and him getting a lawyer can keep his case going for months.

Is actually rare for a nation to throw a man into prison immediately without properly getting him sentence first. He has the right to appeal and defend his case. This is what we called having a democracy and respecting his right. Is not as easily as you think to just throw someone in prison. He might even be out in a few months. And he is clearly being smart by staying silent and have his lawyer do it's job.

A few more details from the Japanese news: the guy is also a 5 dan black belt in karate, and after beating his wife, he took her to the hospital and said he got hurt during karate practice. However, the doctors considered that suspicious enough, so they called the police, and this is how he got arrested. It seems that the wife does not want or is too afraid to testify against him.

My understanding was anyone charged with assault is kept on remmand. It is not his first time so by the second he should have been kept locked up. If he has assaulted her so badly that she is in hospital then there shouldn't be any problem keeping him in jail. Hopefully now they have recorded evidence he will go away for a few years to pay for his crimes!
