The Fukuoka District Public Prosecutors Office has decided that a 44-year-old man charged with the murder of a 15-year-old girl and attempted murder of a 15-year-old boy at a McDonald’s restaurant in Kitakyushu on Dec 14 will undergo a second psychiatric evaluation to determine if he is mentally fit to stand trial.
Masanori Hirabaru was arrested for fatally stabbing Saaya Nakashima and wounding her friend as they stood in line waiting to be served at the McDonald’s outlet. The two victims were classmates.
The police confiscated several dozen knives after searching Hirabaru's house and a vehicle.
Hirabaru completed a three-month psychiatric evaluation on Monday and was returned to the police station where the investigation headquarters is located, NTV reported.
However, prosecutors have requested a second evaluation, saying that there were still some doubts about Hirabaru's criminal responsibility at the time of the crime. They have decided that further tests by a different expert are necessary.

I kinda think it doesn't matter if people are sane or not. Murder is murder. If they aren't sane they can't be released and if they were sane, they still aren't sane because they killed someone.

Sounds as if they will bring in experts one at a time until they get the result they are looking for.

To be fair the experts are not the ones saying the tests were inconclusive, it was the prosecution. This can simply be that the experts concluded something that the prosecution don't want to accept.

The suspect's life depends on this: if he's found competent to stand trial, the near-certain conviction probably means he hangs. If he can't be tried, he quite likely lives out his life in an institution. Most important is that he's never in a position to take another innocent life.

David.... I feel for any nursing staff if offender is sent to a Psych. ward, not prison.
I dont think he will get the death penalty if found competent ....need more victims.

Many people who go to prison in the US for crimes on children get jailhouse justice carried out on them. For example, if you go to prison for a sex crime against child your life expectancy is very much reduced in some prisons. If you're not in segregation, you will be punished and possibly killed by other prisoners.
Even convicts don't tolerate crime on children. I hope he gets what he deserves whether experts find him insane or not.
