I see there is a lot of people nick picking over the term rape, we either way when your on the receiving end of it, it must be terrifying, with deep emotional scars lasting a life time! and then to go through it all again if it goes to court, no wonder xx % goes unrecorded. poor woman!!

That is the difficult point, isn't it? Often, if a woman or girl or boy or man want to have a sexual assault taken seriously, it is necessary for there to have been penetration. Unless that is the extent of the act, it is often seen as less of a crime, even if the person was held down, forced to do or endure certain unwilling acts, experience violence or intimidation or even pain. But, whether it can be considered rape, a crime, is up to whether or not he penetrated. That would make sense for would-be attackers to avoid that one point to get a lesser sentence. If that were the definition of rape, and not his goal , then even "attempted rape" may not be the correct label. Attempt has to have intention. What did he attempt to do? Does he do this often but never penetrates? For her, it will nonetheless be a traumatic and wrongful experience. We will see what the courts decide. He could be out on the streets again. Here is a book we might well read to understand what a person of an "attempted rape" must go through to see a trial to the end. The recipient of the act is often-times more scrutinized than the aggressor. "What was she wearing?" "Why was she alone?" "Had she been drinking?" "Did she give off the wrong impression?" We don't know whether it was rape or attempted rape. It depends on the legal definition of rape. For example, if there were no penetration, then the act might not be considered rape. The guy might have masturbated in front of the woman. Also, perhaps the police and woman do not want the stigma of rape hanging over her. We don't know and shouldn't presume anything. If the police say attempted rape, that's sufficient.

As someone who has experienced "molestation" of various levels at various ages, I can tell you that this is not going to be easy for her to overcome. I do not really like the use of the word "molestation" because it in no way even comes close to the degradation and sometimes horror that a child or adult experiences when they are violated in some sexual, mental way. Add to that the terror of being trapped, alone with a perpertrator in a public toilet in a park late at night while he ejaculates, the only good point of that would be that she actually got his semen enough on her somehow to have the DNA checked so that he could be caught, identified and somehow brought to justice. Her sense of security and dignity was removed. Her joy of life was taken away by that 30 minutes of terror she experienced. Okay, until the police and justice system bring it to trial, we can refer to it as "attempted rape." But, for her it won't matter what the legal system decides.
