In my opinion, her sentence should have not been suspended. I will give an extra hug to my kids this evening, while sparing a thought for the poor abused kids who lost the parent lottery.

you are grossly incorrect. the system is called a lay judge system, lay meaning citizens, because the citizens act as both jury and judges. they also mete out the sentence.

Poor girl. Absolutely heartbreaking. Makes me cry to think of what she went through. I understand, because it happened to me as a child, though no where near as badly. I remember the pain of feeling scared, unloved and scarred inside. But I made it though all that and have made a great life for myself, thank God.

For the record, judges and juries are entirely different, and lay judge is actually correct. If you don't like "judge", you can try assessor, but they are NOT juries. A jury sits and confers separately from the judge and only tries the facts, using the interpretation of law fed to him by the professional judge.

The lay judge works WITH the professional judges on the ruling and has influence on both the fact and the law. That's why it is not a lay jury system.

I have to agree it's a lay judge system, not a jury. If I recall correctly, there are 1-3 actual judges, with a number of civilian 'judges', and in fact the judge can overrule the lay judges I believe.

This woman got away. She spent months away and did nothing.

She knew what was happening. She looked after herself, and abandoned her daughter.

Many women do get trapped in these kind of relationships, and they get out, eventually they find a way. This woman used her daughter, to get free. Despicable.

The saibanin system works different from the jury system in common law countries, hence the deliberate choice to use “lay judge” as the English translation. In Japan a panel of 9 judges, 3 of them professionals and 6 lay judges hear each case. The professionals give instructions on the law, but all 9 make findings of fact and decide guilt or innocence together.

But when it comes to abusive man and if she is financially dependent on him, she must first build up some skills to be financially independent and support her children.
