A great many major countries have reciprocal agreements with Courts in Japan in terms of enforcement of judgements.

You gotta be kidding me.

Still remember that all justice representatives where laughing at the Japanese justice Minister a couple years ago because he won't admit how demigrant and retarded is the Japanese justice.

This thing keeps going on and on....

nissan is a Japanese organization. The Rules are made by nissan. nissan has admitted guilty . Now, to accused Carlos is totally riiculous because Carlos have to have people like japamese accountants and advisers. In Japan. all operating laws are in Japanese. Carlos do not write nor read Japanese. HOW can he commit all those acts that he is accused of ???. where is that nasty saikawa???

But I still would feel sorry for Kelly given how his has had years of his life upturned by this nonsense.

If Ghosn was not guilty then obviously he can present a defense.

He has, the news reports tell the stories.

Presenting his defense doesn’t mean that the Japanese justice system would find him not guilty though, which is priority number one.

I’ve been taken in for questioning by police once... I have seen how this works. In retrospect I took the blame for something I didn’t do myself, to get it over with.

Ghosn did the right thing by himself.

Even Defendants who are guilty can present a defense.

But you may also value your freedom as well.

You are undermining the entire legal system of Japan through unproven accusations. Pretty much the way Trump is currently undermining the US election system with his unproven accusations.

I am standing by the presumption of innocence over the presumption of guilt. Trump is behaving like the Japanese justice system. You’ve got it backwards.

If you seriously deny the validity of the Japanese legal system entirely, you are best served by living elsewhere under a different jurisdiction, for your own good.

The lack of presumption of innocence does make one think, to be honest. But I don’t find myself in such a high profile position as Ghosn was. But there is no way I’d ever put myself in similar shoes to him and Kelly at a Japanese company seeing as how they were thrown under the bus.

Tell you what, if Kelly is found innocent I will stand corrected.

How Mr. Goshen can summit a wrongful taxation papers, I have been living in Japan for so many years (more than 30), and I can not even read a milk label in the supermarket, how such and important person, Could have gone by himself to the tax office and do wrong? Is this fairly trials..?

So Japanese justice is reduced to rendition? Kidnapping someone N Korea style? And expect a fair trial with a 99% conviction rate. Think that might negate the argument that J justice is fair or impartial.

3 ( +7 / -4 )

Is it possible to set up a video conference between two courts? 1 in Japan and 1 in Lebanon? even if it is possible, will it happen? probably not as Ghosn will tare them apart and the Japanese prosecutors will be embarrassed, this is so one sided, its a joke.

If that’s your solution to every problem, then you’re one of the problem.

Unproven accusations? No one, not even the Japanese Minister of Justice can defend the Japanese injustice system. No one.

He had already been found guilty as Kelly will be. The prosecutors decide guilt not the court. The court is just a superficial display to give the illusion of justice a monicom of believability. It's not about guilt, it's about Nissan executives giving prosecutors a secret internal report that contained no evidence. And prosecutors with government nod of approval try to get a confession, as evidence gathering not a strong point. Now the Loss of face is too much to bear...and someone has to pay. Justice...don't think so.

No matter what happens in the trial.

Ghosn will be declared guilty.

Of course he will be found guilty. By default because he is not defending himself.

At which point he will have been tried and found guilty.

It’s a kangaroo court though, not sure how many would put faith in it given the circumstances

A great many major countries have reciprocal agreements with Courts in Japan in terms of enforcement of judgements. It's pretty safe to say that the Courts in the US, UK,. EU don't make such agreements with what you call a "kangaroo court". Besides, the only way to actually prove your allegation would have been for Ghosn to actually stand trial and let the world see it. But he chose not to.

that doesn't help him defend himself in this case.

I don’t think a defense was feasible though, and not because of any guilt on his part.

That is an absurd statement. If Ghosn was not guilty then obviously he can present a defense. Even Defendants who are guilty can present a defense.

@OssanAmerica

How can Ghosn prove that they are not without presence or representation in court?

Presumption of innocence!

Its a basic human right, no matter what the Japanese Minister of Justice says.

It is obvious that you, and all those downvoting me when I am trying to defend Ghosn, have absolutely no experience in an actual Court of law. A person is presumed innocent until tried. But if no one represents and defends him, the prosecution will win by default. At which point he will have been tried and found guilty. The presumption of innocence does not defend itself in Court. Most of you are just tossing anti-Japan sentiment without any understanding of how law works anywhere, in Japan or any country. And while rooting rah-rah Ghosn may make him and you feel good, that doesn't help him defend himself in this case.

No matter what the outcome will be even if we clearly knows where it goes.

They might be able to save face within their island but around the civilized world the damage of reputation is already done.

4 ( +14 / -10 )

The scapegoat Ghosn news is back. I hope Nissan never found him.

1 ( +11 / -10 )

No matter what happens in the trial.

Ghosn will be declared guilty.

Prosecutors are the decision takers, evidence is irrelevant.

5 ( +18 / -13 )

Japan, its pretty pathetic when the ONLY way defendants can DEFEND themselves is when they are located OUTSIDE Japan in another country!!!! Just sayin!

"Scandal-Hit Nissan Sinks Into Extreme Losses as Sales Plummet to the ground in America, additionally with the strain of kung flu. Its over.

1 ( +13 / -12 )

To save face and blame another for their own incompetence, Nissan will spent its last yen. Companies should think practical and commercial, not emotional. There is no way, even if, what is more than likely, Nissan wins, they get one real yen in.

Employees and shareholders are helped only by company profits. Or better, they can be.

on top of this Nissan prolongs again the negative PR fallout. I will be kind and call that “ not very intelligent “

7 ( +16 / -9 )

"Nissan's damages" Nissan is globally finished, American dollar will crash soon, and aint nobody significant in numbers buying Nissan.

At least now he can make public statement to give his story.

Making statements from Lebanon carry no weight in court. Simply influencing public opinion doesn't help his case one way or another.

How can they prove any damages are due to Ghosn’s ‘alleged’ misconduct?

How can Ghosn prove that they are not without presence or representation in court?

"Attorney Gohara has continually pointed out serious problems with respect to the investigations"

Even one of their own surprisingly said that...

7 ( +15 / -8 )

Funny. Nissan and Renault have lost more than $15 billion for throwing Ghosn under the bus, not to mention 20,000 workers losing their jobs. Who will Nissan sue to recover those losses?

12 ( +22 / -10 )

How can they prove any damages are due to Ghosn’s ‘alleged’ misconduct?

9 ( +20 / -11 )

Nissan admitted guilt in the criminal trial but still at the same time they try to charge Ghosn in a civil case. Typical Japanese hatred against foreigners, nothing else.

15 ( +26 / -11 )

I've been watching Gohara, the lawyer, youtube videos.

Looks like Nissan is making up lots of fake claims because Nissan doesn't want to pay the "future compensations" of Ghosn.

6 ( +19 / -13 )

“The current Nissan civil lawsuit is an extension to the extremely unreasonable internal investigation with sinister intent by a portion of Nissan’s senior management and the unreasonable arrests and indictments by the public prosecutors,” Ghosn said.

At least now he can make public statement to give his story. In 2019 he tried to make public statement so there is balance between story that provided by Nissan, Prosecutor and him. What happened when he tried to do that new indictment just appears.

4 ( +8 / -4 )

Ghosn made the decision not to appear in court and defend his position. How he thinks his "innocence" is going to be proven when he is not represented and able to present his defense is beyond me. He has ensured that a default judgement will be entered against him. Sitting in Lebanon and crying foul carries no legal weight.

-10 ( +20 / -30 )

Sorry but others at a Nissan brought this upon it. Ghosn was what Nissan had Ghosn for it.
