Ghosn's lawyer Junichiro Hironaka pointed out prosecutors have already raided Ghosn's property and taken everything, leaving little to tamper with. He accused prosecutors of trying to silence Ghosn, who had tweeted he was planning a news conference next week to tell "the truth about what was happening."

I agree.

Ghosn's case and the extended detention without a conviction are drawing scrutiny to Japan's criminal justice system, long criticized as "hostage justice."

I hope so.

Nevertheless, Givens noted there were no grounds for detaining Ghosn again, as he had already satisfied a court that he won't flee or tamper with evidence or witnesses.

exactly.

How predictable.

Ghosn's detention extended until April 14

Well, what a surprise that is, NOT! He was scheduled to give a press conference on the 11th. Do you think there is a connection? What's the bet they hit him with some other trumped up load of hogwash to further extend his detention past the 14th? What a complete and utter farce! FREE GHOSN!!!

bail's money must be returned

Then after the month for Oman, he should get another month for abusing his bail conditions. His wife should also be detained and investigated for connection to the Oman prosecution

If Ghosn gets bail again, he would be well advised to keep his mouth shut until his chance to speak, otherwise he's shooting himself in the foot.

There is a reason the allies didn't carry the D-day invasion in the Netherlands even though it is closer to the German border. Warfare is based on deception. Keep noise in the east, strike in the west.  Ghosn annoucing his news conference gives it all away.

7 ( +9 / -2 )

if you followed the news on TV, his lawyer said that Ghosn was expecting to be arrested days ago already, and that his lawyer has a video recording of what he wanted to say anyway.

His enemies would have already expected Ghosn to do that. So theories that they charged Ghosn PRECISELY because of that press conference are non-sense to me. There were recently new leaks (from insiders of course) about Ghosn misconduct. They are being investigated in France as well.

The actions of Mr Ghosn are deemed serious enough so that government-backed Renault decided Wednesday in its shareholder meeting, NOT to award Mr Ghosn his +700,000 EUR a year pension (roughly 100,000,000 yens) as promised, because of Mr Ghosn misconduct, nor to award him his 2018 bonus.

The flaws of the Japanese judicial system have been exposed here, but to believe that Mr Ghosn is a victim of some cabal is just being victim of conspiracy theories. Mr Ghosn is a victim of his past deeds.

I guess Ghosn won’t make his press conference on April 11th. I understand he wanted to get his side of the story out there, but to announce it to the world first is what placed a target on his back. Especially when he knows they are out to get him.

"The arrest "has the plain look of an attempt to muzzle his ability to present his case to the public," he said."

That's pretty obvious -- almost as obvious as this kind of thing being why Japan ranks worst in human rights abuses in the developed countries.

Prosecutors had ... argued he was a flight risk.

And they were wrong.

7 ( +9 / -2 )

Even Japanese people in my office are saying that in spite of whether Ghosn is guilty or not, the justice system is out of control.

10 ( +12 / -2 )

Where's the opposition in Japan? Why isn't anybody in the media or government criticizing their legal system?

Any supporting evidence, or are you hoping for a clnfrssion like the incompetent prosecutors.

Japan's "justice" system is so shameful it doesn't matter if they do convict Ghosn because they have demonstrated repeatedly they can't be trusted due to lack of transparency.

Judges are appointed by the Ministry of Justice, (I believe for a two year tenure) and the Head of the MOJ is nearly always a prosecutor. The seems to be a massive flaw in the system.it makes the prosecutor the judges boss.

Japan, the place where logic is irrelevant. Also, common sense.

logic /common sense come a distant second to saving face. ironically its people with weak self esteem and inferiority complex that suffer from this condition the most.

thats just beyond stupid. basically do as exactly as we say , rule exactly as we want and you get the job. seems to correspond with the 99% conviction rate. Seriously is there any part of the J government that isnt rotten at the core!?

9 ( +11 / -2 )

Ghosn is not going to admit guilt, he has to insist on a trial, because his leverage comes from the facts that the prosecutors do not want disclosed.

Nope.

Everything you need to know about the Japanese legal system can be found in a book by Karel Van Wolferen entitled "The Enigma of Japanese Power". The system has little change since the 1980's when the book was written. The legal system and human rights abuses in detention are contained in the chapter "Friendly Neighbourhood Police State".

Also the paragraph "scared judges is relevant.

"...10-day detention request from prosecutors, who can seek another 10-day extension before needing to file charges against Ghosn, release him or accuse him of fresh misconduct that needs investigating..."

Hahaha, that makes me laugh. Anyway, love is blind, I still have confidence in the court.

FREE GHOSN! Who's watching Saikawa and NISSAN to prevent destroying of documents and notes supporting GHOSN.

Probably scared of prosecutors, too. You know, they can arrest you then decide later on what to charge you. They’ll search your house and all your communications then find something vaguely illegal and accuse you of “aggravated breach of trust”, whatever that means.

Prosecutors say they have bullet proofs (written documents by Oman dealer apparently). So why detaining him longer for interrogation?

4 ( +6 / -2 )

Everyone here already has their opinions for or against Ghosn. Seems funny that people have such strong opinions as if they have the hidden files tucked away at home. You know as much or as little as they rest of us - which is literally nothing.

The legal system is what it is. A majority of Japanese probably support the status quo, and IMHO, a lot of people in other countries probably wishes they had the Japanese system in their countries.

Yes the Japanese system is biased against the accused, but a lot of people in other countries are screaming blue murder that the system in their countries are biased against the victims.

Why do people keep asking the same question? Especially when the answer is common knowlege, and repeatedly documented in the public domain by the prosecutors?

Who's watching Saikawa and NISSAN to prevent destroying of documents and notes supporting GHOSN

I don't know why it is, but I have also wondered why the Japanese (and world) media aren't interested in the others eg Greg Kelly, or Nissan executives.

0 ( +2 / -2 )

The Japanese prosecutors are just pure sinister. GHOSN STAY STRONG!

-1 ( +2 / -3 )

These “prosecutors” are just like the Gestapo. Think we should just call them the Gestapo. They arrive in the middle of the night, lock you away for long periods for nothing, without a trial. They interrogate you for hours on end with no lawyer present trying to get you to confess, whether you are guilty or not is not their concern.

Is there no-one in Japan who can rein in the activities of the Gestapo??

2 ( +4 / -2 )

I agree that the Japanese legal system is antiquated, but at the same time I am surprised about how many people defend Ghosn blindly.

The amount of different accusations are staggering. There’s no way he’s completely clean. He sounds like despite getting his $10M/ year salary he wanted more and more and misusing company resources. He seems to be acting like Nissan is his company and using it as such, but he is just an employee.
