Nissan may just have to face an actual justice system instead of the farce that is the Japanese justice system.

The parent company in Japan is still liable to US sanctions. It is part of the agreement to become a publicly traded company and a member of the SRO (SEC). These actions have direct corelations to all Nissan dealings in and outside of Japan. Nissan still has a duty to their shareholders in America.

I do not believe this has anything to do with an American being arrested. The SEC has a responsibility. I used to be a registered representative in the U.S. This means I have my investment licenses. Regardless of how big or small, the SEC and FINRA must investigate every single claim regardless of whether itis for agent or a broker/dealer. So this Nissan case has very large implications. Ghosn and Kelly has been with the Company for over 10 years. That means their actions could have directly defrauded investors and it is highly unlikely that two people could have run a scheme such as this so it also means that company itself could have defrauded investors. SEC and FINRA investigations are only made public once the findings of the broker/dealer's internal investigation does not answer all the questions or claim. Then the SRO and Government must act as an independent party and investigate as well.

Just how many middle-class workers here NOW are getting screwed by all sorts of corporations, including Nissan? The folks over there can take care of themselves.
You ask how? Just how many of Nissan's workers here in Japan are full-time and not contracted? (Don't compare to the US because it's a different system.) More and more are contracted here, meaning less stability, fixed incomes, and no opportunities to advance. Nissan and other corporations are making money like crazy, but their employees here are getting shite.

just happen to be reading Michael Woodford's 'Exposure', about the Olympus fiasco, and am just at the stage where the SEC have started taking an active interest.... which really put the wind up certain parties...... here's hoping....

Sanctions can only be brought upon their US operations though as America cannot enforce the Parent company in Japan to do anything. Typically, companies prefer to keep these situations in house.

It doesn't matter how small or simple the complaint is. Every single one is investigated. Majority are deemed a non factor for disciplinary actions and the cases are closed and nothing is ever reported. Even the employee may never know they were investigated.

Greg Kelly.... a U.S. Citizen. He was locked up with Ghosn initially. The SEC may investigate his pay by Nissan. If Nissan purchased or rented properties on behalf of Kelly and did not report it, then Nissan is guilty of improper reporting.

That is also probably ONE reason Jose Munoz, former Chairman of Nissan North America quit a few weeks back.

The SEC is a bloodhound; and, not only Ghosn & Kelly but others, like Munoz (former Chair of Nissan NA) ,as well as Nissan itself are in their crosshairs.
