Nursing home employee gets 8 years for fatally assaulting resident

A former nursing home employee has been sentenced to eight years in prison for fatally assaulting a female resident at the facility in Kasukabe, Saitama Prefecture.

According to the ruling by the Saitama District Court, Takahiro Oyoshi, 30, was arrested after it was discovered that in 2010, while working at the Flower Hill nursing home in Kasukabe, he had repeatedly hit a newly-admitted 95-year-old woman countless times in the chest and other areas, TV Asahi reported. The elderly woman eventually died from the physical abuse.

In handing down the sentence, the presiding judge said that Oyoshi's victim was completely powerless to resist her attacker's blows. The judge told Oyoshi that as a caregiver, it was his job to protect and care for the residents of Flower Hill.

Prosecutors had sought a 10-year prison term.

Only 8 years for murdering an elderly woman...incredible

As of 2012, there were a little over 835,000 residents in nursing homes throughout Japan. But for many physical abuse is a hideous inescapable reality. Many are denied the right to make personal choices such as what and when to eat, when to wake up and go to sleep and what to wear and also denied the right to complain and seek redress of problems. For the nursing home, it becomes a question of increasing its liability by allowing patients to do as they please or jeopardizing its licensure by denying the patients their opportunity to exercise their rights. Only eight years for fatally assaulting a resident?

Rotten person in charge of taking care of the elderly. I have to wonder what - if any - prescreening is done by these nursing homes to weed out candidates who can't handle high stress / high maintenance environments. Taking care of babies and taking care of the elderly are two completely different beasts.

8 years for murdering a 95 year old woman, and 3 years for murdering a six year old girl. Less with time served and good behavior. There is something seriously wrong with the justice system in Japan when a perfect conviction rate is more important than justice and protecting people.

8 years is a pathetic sentence for his actions, but manslaughter and murder are not equivalent. this is an important distinction when analyizing an act that causes another's death.
