Gifu Prefectural Police have arrested a 25-year-old police officer on suspicion of having sex with a 16-year-old girl and filming the act in a hotel last year.
Police said Haruki Takeyama, a police officer at Kakamigahara Police Station, is accused of having sexual intercourse with the girl at a hotel in Ginan Town, Gifu Prefecture, on July 17 last year and filming the act on his smartphone, Sankei Shimbun reported.
Takeyama was a student at the police academy at the time. In September this year, another person consulted the police about the incident with the girl, and the police began their investigation. The suspect's smartphone, which was seized, contained multiple sexual videos with the girl.
Police said the two had not met until the day of the incident.
Chief Inspector Tatsumi Goto commented, "This is an outrageous act that a police officer should never be involved in, and is extremely regrettable. We will take strict action based on the results of the investigation.”

This article does not make clear what was the age of the girl at the time of the act last year. In 2023 Japan changed their legal age of consent to 16. If she was 16 at the time, is was no longer a minor in this regard. And it certainly was consensual.
The article also fails to make clear what exact charges are involved. Is it the filiming? And was that known to both parties? Or is this a violation of Police internal regulations?

In general a sexual relationship between a 16 y/o girl and a 25 y/o man is not illegal in Japan (and not illegal in many other countries too). Obviously the girl never accused him of any wrongdoing. The report also mentioned they found multiple sexual videos with the girl in his smartphone.
Age of consent is 16 in Japan. No way to accuse him of statutory rape. To agree to take pictures and keep them only for themselves without intention to forward them to anybody is not illegal either.
A 16 y/o girl can give consent for a sexual relationship however without the intent of prostitution, which means to sell this adult movie against money or upload it to adult websites etc. is legally possible only if both are 18+.
It is nowhere mentioned that she was paid by him. In case she was paid for her service, she can also be prosecuted, as the age of consent for prostitution is 18 and not 16.
IF no money transaction between them can be proven, I guess not much can happen to her and him. They can dismiss him as a police officer, but not much more than that. About her, just nothing.

No reason why not a 25yo having sex with a 16yo and filming it is as clear as possible, forbidden by law.
And since not being a police officer does nothing to make the girl older than 18 then it is irrelevant.
It is illegal, under the law anyone under 18 is a child, and it is forbidden by law to produce or possess pornographic materials that feature a child. There is absolutely no requirement to forward it to anybody else for this to become a crime. Being paid is also completely irrelevant, so it does not become an excuse in any case. The moment the accused had possession of pornographic materials of a 16yo prosecution is easy.
Which has no importance at all, he committed a crime, so he shall be punished for it, the headline is accurate, he is (was) a police officer at the time of the arrest.

About filming and keep these movies for themselves, if illegal is the question, it means that not only the man, but also the girl should be prosecuted, as she consented to it.
A 16 y/o girl, even taking such pictures or movies alone, without anybody else being present, could be prosecuted for producing child pornography. Therefore either prosecute both of them, or none of them.
She was not secretly recorded against her own will, she consented to it, as the article says multiple sexual videos have been found in his smartphone.

Sounds like a good advice. Stay away from minors, it is not worth the trouble. Make sure the girl is 18+ or even better 20+ and not drunk or full with drugs, so she or others cannot easily accuse you later for something regarding the complicated legal situation about consent.

Times have changed. When I was in high school no one batted an eye when military dudes, whose ages ranged from mid to late 20s, on the bases around my neighborhood would routinely date freshmen and sophomore girls, 14-16 year olds. Us fellow students of theirs didn't have a chance of dating these girls because we couldn't compete with the "older men with sports cars" mystique.

Filming is included in the comment precisely for this reason, she did nothing of the sort so what are they going to prosecute her for? not filming anything? Nothing in the article says she did anything of the sort, at that or any other time, THAT would be what is actually difficult to prosecute seeing that she didn't even possess any pornographic material.

This is not correct - there are national laws and regional laws, so effectively the age of consent differs from prefecture to prefecture. Many prefectures have stricter laws than the national baseline. I believe Tokyo, for example, is 18. I don’t know what the situation is in Gifu but it is quite possible that a law has been broken, and the police evidently believe so.
