All other things being equal, if he was a junior high boy with a scooter who took her back to his house while his parents were out of town, would the charge of kidnapping still stick? If not, drop it.

See, its just that I don't hear one single detail here that explains why its a kidnapping. It does not say she was grabbed. It does not say she was tied up. Or locked in a room. Or threatened. Or beaten. No ransom was demanded. She retained her cell phone. I don't see a single thing here to make me think "kidnapping" except the accusation of "kidnapping". Is that all it takes now? One accusation and you are guilty in the court of public opinion?

As to the age thing that everyone is so sensitive about, jhs and hs girls spend a lot of time to look pretty and to look like an adult, and PLENTY of j girls in their 20s look like jailbait. So I can't guess if he is targetting kids or not.

Broad daylight in a very public space- including cameras- for the pickup, not convincing that this was a violent abduction, though possible. So if not violent, did he lie to her to give her a ride? or consensual? If he lied, how did he get her into the apt from the car when she figured out he wasn't taking her home?

She calls on her keitai 24 hrs later for help- like, he is either the dumbest kidnapper ever to not figure out he should take away the keitai and/ or tie her up, or this was consensual.

When it comes to 'fault', there are two things to look at. What happened before the incident, and what happened after the incident.

Before the incident, no crime has been committed. Nothing wrong has happened. All that exists is the potential for a crime. A smart human being will do their best to bring as low as they can the odds of a crime happening to them. After the crime has been committed, it is out of the hands of the victim, and the crime is now the fault of the perpetrator.

So It's not the girls fault that she was kidnapped, that is entirely the kidnappers fault, and he bears all responsibility for it. But if we look at the point before the kidnapping happened, the girl should have done whatever she could to ensure something like this doesn't happen. For example, not getting into some strange guys vehicle. So she does bear fault in not doing her best to lower the odds of something bad happening to her. She doesn't bear fault in the actual kidnapping.

Who knows how she ended up in his car? Unfortunately the story doesnt give that information. However, it would appear that she was held in his apartment against her will. She probably waited until he was out of the room, went to the toilet or something similar then she used to her phone to get help (still cant understand why that took 24 hours though). Just my guess. But there are still a few holes in the story that will hopefully get filled in one day.

Whether or not HE believed it was kidnapping it WAS kidnapping, as the girl is 15 years old TOPS!
