Tokyo court denies Ghosn's latest bail request

The court did not give a reason for the denial. Bail is rarely granted for defendants in Japan without a confession.

So are we to assume here that Kelly confessed, thus was granted bail?

As expected. But this will probably make him more desperate, hope he doesn't sign a forced confession. Also where is Kelly, what happened to him? Haven't heard anything from him after he got released.

Cruel and unusual, he directly talked to their reasoning for not granting bail and they still rejected the request. Doesn't look good Japan.

The more he appeals to get out, the less his chances of release become.

15 years is a lonely small cell is a long time

Mark Karpeles (French businessman) also spent some time in the detention center in Tokyo.

"I wouldn't want this on anyone," Karpeles told CNN. "Not my worst enemy, not even humanity's worst enemy."

Karpeles said he lost 77 pounds (34 kgs) in custody. After the interrogation period came seven months in solitary confinement at a pre-trial detention center in Tokyo.

He remembers every detail of his windowless 6-square-meter (65-square-foot) cell, which had tatami floors, a sink, a toilet, and a small table on which he kept his journal.

Karpeles said he was forced to sit upright in a corner for some ten hours a day. If guards caught him slouching or napping, they would shout through the door. Once, when he failed to comply, he was taken to the padded "punishment room" where his hands were tied behind his back and he was kept on the floor for several hours.

He was released on bail more than two years ago, but he says he's still adjusting to life on the outside.

Oh and my next car will not be a Nissan. Guilty or not, I am not impressed with the way Nissan is handling this case.

Of course they did, he hasn't confessed yet. Much to the embarrassment of prosecutors. So they need many more months of poor food, cold environment, constant repetitive interrogations day and night. Separating him from family, limiting his time with his defence team. He will break metals or physically at some point. And instead of vultures circling they will be merrily perched on his carcass. Guilty or not.

It would seem that the "evidence" is not quite enough for a conviction. And a confession is required. At this point a confession will be viewed as being made under extreme duress and worthless in any first world country. But prosecutors will slap each other on the back at a Nissan funded after party. Can see Japan sliding further down in world Justice rankings this year.

This is iijime ( ill treatment ) of a man & his family. Carlos have offered the best offer on the table. That show his true and gentlemanly ways. Japan should not talk abt human rights or anything with correct international mind. Japan has no rights on the international stage. The court gave no reason? Perhaps the reason is so embarrassing to actually articulate with a straight face the judge felt it best to scrapper out the back door.

This is of huge concern to anyone living in Japan. The fact that bail is never given unless you confess. Ghosn's appeal was very reasonable, to tag him and that he would even pay for security. This is just proof that the system is not interested in a defendant having the chance to prove their innocence in court.

And lets just consider his crime for a moment. Tax avoidance and allegedly using company funds for unapproved benefit. The man who saved one of the highest profile car manufacturers in Japan, who were bankrupt 20 years ago. Flight risk? Where could he possibly go and hide?

This is blatant racism. As pointed out previously, why did this not happen with Olympus, Kobe Steel, Toshiba...

i've never said the ankle monitor itself is cheaper than a cell, I've said that an ankle monitor, if you want an effective supervision, implies several police officers dedicated to the task.

And as @ksteer said, "24/7 ankle bracelet, the Japanese court has no precedent for this".

So, police officers have to supervise the monitor in a relay manner, 24/7, then dispatch a team if the alarm rings (at least 1 team has to be ready 24/7, only for this purpose, while another keeps monitoring the device).

For God's sake, such logistics ! And all the possible human errors it can involve !

You know why in European Union, such device is vastly used ?

Because it's cheaper than prison, yes.

But not because it's more effective than prison. See some terrorists in France, their ankle monitor didn't prevent them to throat-cut a priest in his church.

And last reason why it's vastly preferred to prison : it's ideology. The European Court of Human Rights orders EU members to use prison as a very last resort, because prison in itself is what produce crimes in society, not criminals, because prison is bad, mean, cruel, counterproductive, etc...

What a disgrace. I love Japan itself and Japanese people in general but this is really the most shameless mockery of the justice system I've ever seen. I'm astonished Japan would willingly represent their government in such a dishonorable way. Everyone really should look at this by observing the facts first. There are just some facts that cannot be ignored.

A man is accused of a crime without proof backed by direct supporting evidence. He's being held against his will, based on "what if..." contingencies, with little to no respect for his natural human rights.

During this kidnapping, he's not allowed access to any of the outlets that have a high probability of proving his innocence, if he is innocent. This obviously shows that there may actually be something out there that can prove his innocence and he's being intentionally kept from it. This is a strangely a very common thing in Japanese business culture. They cant afford to be wrong so they'll literally use any means to block it or prevent it from being realized. Some people in Japan will even kill themselves to prevent dealing with being proven wrong.

Everytime the statue of limitations for his holding time reaches fruition, another "suprising" discovery of criminal action appears from nothingness. This is obviously the prosecution holding as many variations of each crime as they can find and then reaching up and pulling them out of the 'crime cloud' systematically in an attempt to extend his kidnapping as long as possible.

Beyond these facts almost everything else up till now has been completely single sided. I don't know if Ghosn is innocent. But one thing I do know: The Japanese government in this case has lost sight of right and wrong and "Justice" is no longer the goal in mind. It's now all about who's right and who's strongest.

No matter the final outcome here, Japan has lost significant respect around the world as a leader. And more importantly as a potential prospect for international business. After this case, whatever crime statistics the Japanese government present, can no longer be taken seriously. Especially conviction rates

You don't have to like it - this is the Japanese system. Pointless to compare/complain about Japan vs US, EU, AU, etc. Ghosn will not get bail, especially by offering up this other desperate measures such as electronic monitoring devices, security guards, etc. Japanese courts are not going to let foreigners inject new methods and manners of bail terms.

As much as I love Japan, there is no Justice in Japan, only what the prosecutors make it to be.

Regardless of whether he has or hasn't, the job of the bail hearing is to decide whether there is reasonable instance to suspect that he MIGHT do it, not to decide on the legality of bail conditions.

24/7 ankle bracelet, the Japanese court has no precedent for this, so the bail hearing has no legal framework to decide that its relevant and should be allowed. That isn't up for them to decide.

Paying of personal guards: That sounds like bribery to me, or an attempt to do some. As such, the bail hearing would properly disregard that as well.

I don't think Ghosn realizes that he isn't going to get special treatment here, and why should he? All the other people in detention centers who don't have the money that he does don't receive bail either. The bail hearing has to remember not to set a precedent and they're doing a very good, legal, just, and non-partisan job of it. Just because it isn't the result people want doesn't make it the wrong one.

And I still can't get over the idea that he can be released if he signs a confession of guilt though there is no solid evidence of such. Interested to see how this plays out. Several, not just one, several police officers for a 24/7 effective supervision.

On a related note, CNN showing Mark Karpeles and his "ordeal" in detention. Give me a break. CNN spent literally no time detailing the crimes this guy is committed. They painted him as a victim of injustice. Even if Ghosn is guilty, there is a huge difference between him and Karpeles. Ghosn might have underreported money that he earned thru hard work for the benefit of Nissan. Karpeles used Mt. Gox and users money to live a lavish lifestyle and opps, hackers stole YOUR money, but not his money. Hoping he get convicted and can by Ghosn's new roommate.

Everyday you wake up thinking that this maybe the day when courage wins over expediency. Then you realize careers are built on stubborn, pig headed resolve. Of course the answer was NO, silly. Nothing at all surprising about it, just sad that’s all.

Outside of Japan, Carlos Ghosn does not have the star power of, say, Elon Musk. Most of the world doesn't really care he's rotting in detention. In fact, some commenters at other sites wish a similar style of justice be brought to a lot of Wall Street execs for their corporate greed.

Without international pressure, he's stuck in there. However, if it gets to a point similar to what happened to American held in North Korea until he was near dead (and eventually died), then the international community may wake up.

But where is the evidence? Leaked snippets from unnamed sources. A secret internal Nissan investigation that has miraculously supplied nothing to charge him with, just enough to detain him. Prosecutors who in two months of (I would guess investigation) fruitless probing now have nothing but the hope of a confession. Think the evil super villain in this case might just be the inept politically and businesses controlled MOJ.

Even as a flight risk, I think the concessions he offered should be taken into consideration by the courts. Ankle monitor, his stocks, and a promise not to leave the country. That's pretty reasonable for a non felony charges. If still wary and doubtful, the courts can post guards at his apartment, restrict visitors/calls, and social media.

For those defending the MOJ I would suggest you simply look at JapanTodays history of Crime reports. They are all over the place from suspended sentence for murder, rape, fraud to jail for stealing ¥10, or huge fines for stealing a toilet roll. One thing stands out if you are in anyway connected to a known university, celebrity, politician, or a CEO it's probably going no further than the prosecutors out box. Be poor, a foreigner or simply a normal person expect the full weight of an inquisition type of trail with all the consequences that entails.

So @john, ankel monitor is more expensive?! Here is your "logic failure", police already spend time at the station 24/7, they are programmed with allowed areas times etc, and give an alarm when they exit these areas or gets damaged in any way, or if they loose signal. They require less people to maintain, no money for food, building, and guards checking on you every 10min. Before you choose flawed logic, I would request you to research first.

We use this in Denmark and many other countries in Europe because it's cheaper!

At this point in time, I would highly plede the European Union to start talking about sanctions, in coop with USA. Japan needs to change it's attitude.

The French government is here in Tokyo discussion Renalut/Nissan and needs to deliver the unequivocal message to the government to release Ghosn in the form of "This is not a request but an instruction and Japan will face dire consequences if Ghosn is not released." Of course, the French do not have the guts to do this though they have many means in their arsenal (economic, moral and military) to force Japan's hand. The international community should not accept this new imposition of the Gulag in Japan.

What i see is that the world is looking and seeing how this world leading wannabe society is acting. When Japan wants international recognition by taking on world level responsibilities it’ll be looked at and judged by its actions. Does the world WANT a leader where defendants are treated like unwanted criminals before judgement? The Japanese system May score a victory at home with deep throats running around and prosecutors looking for unwanted foreigners but for sure it’ll come back to them. If the prosecution is successful it’ll be limited in scope. The foolishness comes from unfounded speculation and blind faith in a "justice" system that has no interest in justice, which is evidenced by the reliance on forced confessions and indefinite detention to extract those confessions.

This article has been filled with recycled news to fill it up. however, has anybody else noticed there is no reference as to why his bail was refused this time? Previous requests were denied due to him being a flight risk and the possibility of him destroying evidence. However, he has stated he will wear a locator anklet and have security, which 'should' put the judge's fears at bay. If these are the only reasons the judge has denied his bail it is obviously a case of bias and unfair treatment. This man is not guilty of anything (yet), but he has been cut off from his family, being held in a small solitary cell, interrogated for hours daily, being fed a diet based on rice alone, has no access to the internet or newspapers and they intend to hold him like this for at least six months. This man is not convicted of anything and this how he is being treated? A convicted murderer gets treated better. It's absolutely disgusting how he is being treated, guilty or not.
