I wouldn't call that a "legal victory" by any measure. This would have been a legal victory if prosecutors had gone after the bosses of the agency resulting in substantial prison sentences and hefty monetary damages for the victim.

More often than not the Japanese courts are complicit in facilitating coerced porn by siding with the agencies. In human rights cases, whether it be child abduction, parental custody or sex slavery, the courts in Japan are horrendous.

Always have mixed feelings when I read such stories. I obviously feel sorry for those girls and angry at those sharks who make a living off vulnerable/naive ppl but I also struggle to understand how someone get tricked that easily in a country like Japan? Is there anyone on this planet who still think talent, model etc agencies all around the world are squeaky clean and that all modeling, acting etc ads are exactly that?!

What the article describes in most other develoed countries (coercing someone into sexual activity against their will) would be treated as a sexual assault and unished accordingly. Japan's rape laws are antiquated and allow this sort of thing. Change those, start arresting these guys for sexual assault and then the industry might actually clean itself up.

Unfortunately these manipulators are a segment of the population that doesn't share the same world view and doesn't feel guilt or shame when they make someone unhappy. They are selfish, self-centered have a strong need to feel superior and powerful in their relationship. These manipulative usually don't consciously plan their tricks. They emerge from the manipulator's underlying personality disorder. They may use active techniques like becoming angry, lying, intimidating, shouting, name-calling or other bullying tactics. If these people are often associated with criminal behavior then these are called psychopaths. In the end these are the people who feel little compassion for other people, don't really feel guilty when they do something harmful. They pathologically lie, show superficial charm and don't take responsibility for their actions.

Starts with education

Just make it mandatory for Jr. and High Schools to put this as an essay question on their entrance exams, then they'll have to teach it in schools and Jukus: "What are the good and bad aspects of street model scouts and talent agencies?" and/or "What would you do if confronted by a street model scout or talent agency?"

I'm sorry, but I find it hard to believe that these women don't know what they are letting themselves in for. I find it more plausible that they get involved in the grumble flicks, then decide they want out for whatever reason (well, not everyone wants it in the tradesman's entrance).

That's not to say that those running the agencies aren't a bunch of dirty rats, but given the seemingly unlimited numbers of women willing to appear in donkey and rooster videos, I don't see the inventive to to coerce those already involved (unless they are extraordinary popular).

The reason I don't have any sympathy for these girls is that despite their story they were forced into doing porn they kept going back again and again - 100 films - and they never sort legal advice, police advice or went to some public help group some of these so called "victims" claim it was over a period of four years hard to believe four day and four weeks yes but not four years or 100 films their not victims but willing participants.

The opinion can go both ways so there is no reason to criticize those who wonder why the women continue to do porn with the freedom of choice being at play. There is no exact quote in this article that says the women were forced at gunpoint or threatened to continue after the first time they were tricked into it unless they lived in the studio under lock and key. Also the one woman is continuing to do porn as a freelancer?

Quite simple - though in most cases, a contract should be binding, in the case of porn, it should not. If a woman does not want to do it anymore, she should be allowed to cancel the contract without threat of legal recourse.

Saki is pretty, but then not having the backbone to tell people (even if there are 20 of them) that you are NOT going to undress and HAVE SEX ON CAMERA (which will haunt you until your death as film never goes away) and that this is not what you agreed to, is a BIG problem. This research paper by Professor Nakasatomi lists court rulings on porn related cases, both civil and criminal. The court ruled against porn industry in all cases.

There might be many victims but no one else sees this as self-promotion for her latest ventures. Which is fair enough, Fred, as you do not know me nor seem to be the most perspicatious guy around i.e i think you may have missed some nuances (in my initial post). Probably the 'do the whole floor' bit which does sound harsh/disrespectful as I deliberately wanted to highlight the crudeness of those blokes.

I just don't think there are 2 sides a (the good guys like you) a/'poor women, they got tricked big time and had no way out from day 1, absolutely no one could have seen that coming', b (the bad guys) " those girls are dumb, it's entirely their fault."

For whatever reason I am neither in a or b. I think extreme gullibility, being easily manipulated etc is a dangerous trait and the same way people should not trust a random woman/man met online who ask them to transfer $50k after exchanging 3 emails women should not blindly believe 'scouts' who tell them they'll get rich soon if they do what they are told, it's all legit etc. Chances are, its not, that's why ppl in those situations should be extremely cautious and should have enough social intelligence to see warning signs.

My other point was/is we 'society' have to ensure ppl are aware of those scams and have enough options to get help and opt out from day 1. I will always feel sorry for the victims and seek the harshest punishment possible for the perpetrators yet there is a point when someone's extreme gullibility becomes almost unfixable. I think the issue here is the contracts, if they are properly understood before being signed there won't be contract abuse as that would immediately become illegal.

When it comes to the Porn industry however, no matter what you're going to have the complainers trying to bring the industry into disrepute. In the US there are hundreds of cases each year where women say they were abused or scenes were too brutal or whatever, even though they were just following the contracts that they themselves signed.. I think we can be thankful that at least in Japan Porn actresses have legal recourse to fall back on and the industry is legitimate, as opposed to most countries on Earth..

Sad to see some people blaming the girls. Yes, I am for personal responsibility but the pressure on these girls (by multiple people) is immense and can be quite scary. Personally I would like to find some of these guys and pound some sense into them, but that is not a viable solution in Japan. Ms. Delicious I see you never signed anything you do not understand. This issue is another example of how vague Japanese contracts are -- the ones I have seen are not specific and judgements go based on nuances it seems. Even judgements in court decisions seem vague without explaining any reasoning for their decision. It seems the girl could have walked away from the contract, but there is no protection from intimidation.....the vultures know how to manipulate their victims, just as bullies harassing employees and students in schools. The base of the problem is the punishment for harassment is not there and this needs to be corrected to protect its young citizens. Time to wisen up Japan......

As for the scouting issue, FizzBit is right. Education is the answer. Young women should be warned. In fact, they should be warned even about the worlds of fashion modelling, TV, and AKB type idol groups being dangled in front of them to get them to do porn. Those jobs can also be very exploitative and treat their workers far worse than ordinary people will imagine from the fantasies shown on tv. Unbelievable how naive some Japanese girls are. Once I met a girl who told me she was scouted in Shibuya the previous day and planned to visit his office for a photo shoot the next day. I asked her if she had actually done any research into this guy's agency and she knew nothing! He just gave her piece of paper (or meishi as they call it here) with his name on it. She believed him and seemed really excited until I told her not to be such an idiot and at least get more information to make sure it's legit and bring a friend.

For some reason my first comment disappeared but this is an educational issue and it goes far deeper than porn. We're constantly hearing about workers in nearly every Japanese workplace who put up with miserable, illegal conditions because they don't know their rights. If Japanese youth can graduate from school into ANY field and not know their rights, that's a serious societal problem.

What I do not like about this AFP article is that it is most probably written based on the material provided by the anti-porn advocate group.

Last month when a similar article was published, there were many porn actresses who protested the article. The actresses said the article was unfair in emphasizing exceptional cases in which women were abused, and that the article did not reflect most cases in the industry where actresses are treated fairly.

AFP writer Natsuko Fukue must have known the move by the actresses last month, but did not include the move in her article.

[ This defeats her argument. You cannot prosecute the agency that you used to get out of your dilemma. And then claim this same agency needs a systems of checks -n - balances and how they need to be uniform when she still earns a living from it, and is therefore promoting it indirectly }.

There are ridiculous holes in your logic, but I'll bite.

I believe the fact that women are being tricked and coerced into pornography. Even if such coercion is exceptional, it still occurs, and is still reprehensible. It's rape by any measure.

If you say yourself -- in your very own words which are quoted, that 'such cases are exceptional', then you are admitting that as rare as they might be, they exist. So, then, what's all this stuff about "which fact is true", as though one is not possible? And you know what else, not ONCE do you even suggest that any company forcing women into porn is wrong, reprehensible, or even bad (despite admitting such cases exist), instead you blame the women and you blame groups which fight for women's rights. Well done, CH3CHO! You've outdone yourself. But I mean, on other threads about women forced into sexual slavery you also come to the defense of the aggressors, so no surprise, really.

I don't know if such cases are exceptional, but both do exist. Some women are coerced, but the large majority do it of their own free will.

Why doesn't this article by AFP mention the names?

If a woman is coerced to have a sexual intercourse, it is a rape and merits news reporting with the full name of the perpetrator. But AFP did not. Why?

Obviously, they want to give an impression that the whole industry is coercing the women into pornography, and are not interested in individual cases. On the other hand, porn actresses are arguing that they are doing their job on their own will. What is at stake is not individual cases but industry-wide crack down. But is the impression given by the article true, in the face of the witness of the porn actresses to the contrary?

You're probably one of those people who, if a woman is sexually abused, blame her at least in part for what she was wearing, as though she invited it.Not one harsh word towards the companies on your part -- just the women.

As noted above this is Yak driven and is totally allowed by the police. You can find scouts hanging out, loitering really, at stations all over Osaka. I have never seen the police shoo them off. Because no doubt the police are being bought off by money or other special favours if you know what I mean and I think you do. Most woman do not give in to the harassment of the scouts but obviously enough do so that they are out there every night. No doubt the scouts work on commission if they bring in new talent. Looking at them clearly they are misfits.

I wouldn't call that a "legal victory" by any measure.

That's because you want to eat your cake and have it, too. Having a case thrown out that was trying to force someone into porn is a "legal victory" for the defendant. Period.

I'm sorry, but I find it hard to believe that these women don't know what they are letting themselves in for. I find it more plausible that they get involved in the grumble flicks, then decide they want out for whatever reason (well, not everyone wants it in the tradesman's entrance).

So you have observed first-hand the tactics used by the "scouts" and had a chance to read the contracts these women are signing? No? Can't really help you, then, if you're disbelieving people without getting any facts.

I don't buy that she was forced/brainwashed into doing this. Doesn't add up on how someone leaves a company and then goes and continues to work elsewhere. And from seeing her on videos, she and many others seem to be enjoying themselves quite nicely and eagerly. I have seen numerous times these hoodlums and pimps at the station passing out tissues or pamphlets to women. I once asked a japanese person what was inside and they told me it was recruiting info. So basically, the ones interested, would reply on their own and the ones who weren't, wouldn't. Seems pretty simple. To think i did a similar method just trying to find a serious and decent girlfriend, from starbucks to department stores but was unsuccessful with typical ghostful outcomes.. They definitely have their system rigged for specific clientele.

Just checked out a Japanese Porn site this "lady" has thirty plus videos as a sole "actress" and I didn't even search her videos in "group" settings - tricked into porn that maybe so but she has certainly hung around for the benefits - no victim here but a willing participant.

For everyone doubting this girl, it could be a case of both. She may have been coerced into it when she started, but after starting, had no way out - what are the alternative job prospects for this girl? She can't have a lot of job options open to her anymore. People have to eat and pay the bills.

Don't sign contracts from somebody who just approached you on the street, and if you do take the contract to a lawyer to get checked and verified so that it isn't some kind of false and overly convoluted worded contract to trick you. If the agency won't allow that then they are shady and that should sound the alarms.

And if you find you actually have to do porn then don't, break the contract. Would love to see that going to court, I bet these agencies won't even make it to court because they'll be named and shamed publicly. They just hope the fear tactics they use on the girls will stick.

Sad to say but these women suffer from low self esteem after being forced to do something they don't want to do they suffer psychological damages for years. One person asked why does she free lance because that's all the skills she probably have.
