sounds like horse manure to me. the J prosecutors are getting desperate and it shows.

It is quite an accomplishment for a man who cannot read, write, and speak Japanese.

Mr. Ghosn is a man of many talents I see.

20 ( +22 / -2 )

I'm not a lawyer, but that testimony sounds a bit like hearsay. Surprised it was allowed. But then again, the prosecutor holds all the cards in a Japanese "trial".

18 ( +19 / -1 )

Hari Nada, a former Nissan vice president in charge of legal affairs, is a key whistleblower in the case brought by Japanese prosecutors against former Nissan and Renault boss Ghosn, who was arrested in 2018.

He might reflect on being Vice President of legal affairs seems he wasn't capable of doing that job.

Nada was demoted following Ghosn's arrest. And I bet there are lots of prosecutors, police being demoted after the the debacle they started. Japan's legal system investigation process is based on confession not actual investigation. Terror is its version of truth.

So, yesterday on JT there was a story that it was Nissan who hid the money. Now, today, this story said that Ghosn hid the money. I think its Nissan who was responsible to acknowledge the money flow from the beginning of Ghosn's employment. Funny how Nissan is the employer and had no idea what was going on. I side with Ghosn. He was set up for sure.

There's one more development of the story today.

Hari Nada had a plan, written on paper, of how to get rid of Ghosn.

That paper got disclosed this morning.

the trial of former Nissan executive Greg Kelly who is charged with helping Ghosn hide 9.3 billion yen ($89 million) in compensation over eight years through deferred payments

https://www.cnbc.com/2020/01/08/ghosn-regrets-not-accepting-us-offer-to-lead-gm-for-double-his-salary.html

Ghosn was valued double in U.S. than in Japan, man like him that can bring back Nissan into business that amount is normal to get.

"He (Ghosn) didn't want to be fired. If he paid himself what he wanted and that was disclosed, the French state would have felt obliged to fire him,"

There always more that one story for any event. Bloomberg reveal another story, that shows conflict of interest that lead to that coup.

https://www.bloomberg.com/features/2020-ghosn-nada-nissan/

Ravinder Passi, was former legal counsel got demoted since he asked conflict of interest of people who planned downfall for Carlos Ghosn. What happened to him, his house also being confiscated after that.

Beside that, wavestone French IT security company was hired to break into Ghosn mail, in early 2018.

When wavestone was operated in their internal network is being done without knowledge of internal company IT manager, so what they did nobody knows since no internal IT staff can really monitor what they actually do.

They are just reporting what the testimonies are saying. Not everyone knows who was involved directly. And this is about Kelly, not Ghosn. Obviously the whistle-blower is going to blame Kelly, as he set it up that way to begin with.

The J Govt. feared such a large player being outside its orbit of control, and the house of cards collapsing.

9 ( +10 / -1 )

R,T..... This article, the whole Ghosn case and life in general are too confusing!

7 ( +10 / -3 )

This story was reported yesterday on NNN news, without disclosing the name of the former excutive officer didn't know it was Hari Nada until reading this article, I found it strange they didn't want to reveal his name but only his testimony that he received instructions from kelly and from Kelly only to conceal Ghosn salary and only Kelly was working on concealing Ghosn salary, there was no mention just like in this story of Kelly's defense statement. This kind of amateurish reporting might give to an unthinking mind the impression that the party being reported against is guilty by deliberately not mentioning whether the accused refuted the testimony or not.

Ghosn hid scale of Nissan salary, fearing dismissal from Renault, Tokyo court told.

What difference does it make what the court was told.

Prosecutors have made up their mind and Japanese judges are too scared to listen to this.

Scaredy cat cowardly custard Japanese Judges.

Carlos Ghosn concealed the scale of his compensation at Nissan because he feared the French government would force him out of Renault if it discovered how much he earned

If you're a publicly traded company, aren't you required to disclose your salary? Or is that only for the US market?

6 ( +6 / -0 )

Nada has immunity his statement doesn't make sense. Why would the French government fire him?

6 ( +6 / -0 )

This article doesn’t say much about Kelly, you wouldn’t think it him that was on trial would you.

5 ( +5 / -0 )

The only crime that Ghosn committed was trusting Japan Inc and loving Nissan! He should have left Nissan for better offers from other countries. The Japanese executives were super jealous of him and conspired with the Japanese prosecutors to build up a fake case against him! The independent commission from the UN has also said so. Other foreign CEOs / Executives need to be extra careful when accepting jobs with Japan Inc.

4 ( +8 / -4 )

~sigh! Why don't they just give it up already? This case made no sense from the beginning and its even worse with this article! More confusing than Japan's laws!

Hari Nada had a plan, written on paper, of how to get rid of Ghosn.

This Hari Nada types are what destroy the company culture completely...he even got the legal counsel out of his way...no wonder Ghosn never saw it coming..

4 ( +5 / -1 )

Only in Japan is this a case worthy of a trial.

4 ( +4 / -0 )

Doesn't fit with yesterday's testimony, "Nissan was afraid to lose Ghosn because other companies wanted him" and where offering him more If he was afraid of Renault he would have left.

4 ( +5 / -1 )

There is something fishy here, the story keeps changing... Somebody is feeding us garbage!

4 ( +4 / -0 )

Hari Nada was a key proponent in taking down Ghosn. Dude was the mastermind according to several articles. Now he's a witness with immunity. What about Ghosn and Kelly's witnesses? Are they even allowed to have any? This is like a Nazi court trying to appear to serve justice in the eyes of the world in 2021.

This guy nada lives up to his namesake clearly he doesnt have NADA on Ghosn & is making stuff up!! Pure hearsay, should be tossed by the judge!!! Ooops sorry forgot this is Japan, so the ""testimony"" is ""good"".

And yeah this guy nada was up to no good trying to frame Ghosn & was nasty what J-prosecutors did to that Indian man & his family entering his home in Japan & scaring his children etc, real nasty!

3 ( +4 / -1 )

Judges fear the prosecution too much to do any balanced judgement.

3 ( +3 / -0 )

Japan introduced new rules requiring executives to disclose payments above 1 billion yen.

Minor quibble but this is factually incorrect. The rule requires compensation above 100 million Yen, not 1 billion Yen, to be disclosed.

3 ( +3 / -0 )

What an apt name...Hari Nada...like the missing needle you're trying to find in the haystack. Just like the charge of guilty Nissan and the system is trying to conjure up on Ghosn out of thin air. Laughable.

3 ( +4 / -1 )

What wrong with paying a high salary???

3 ( +3 / -0 )

This story was reported yesterday on NNN news, without disclosing the name of the former excutive officer didn't know it was Hari Nada until reading this article, I found it strange they didn't want to reveal his name but only his testimony that he received instructions from kelly and from Kelly only to conceal Ghosn salary and only Kelly was working on concealing Ghosn salary, there was no mention just like in this story of Kelly's defense statement. This kind of amateurish reporting might give to an unthinking mind the impression that the party being reported against is guilty by deliberately not mentioning whether the accused refuted the testimony or not.

Yahoo had a similar article around the same time (2pm), and at night posted an article including the executive's name. So perhaps they weren't allowed to reveal his name until the session closed.

Regarding Kelly's defense, you can't expect NNN to report on that when it hasn't even begun yet!

That's plenty of resources for this fiasco.

4 trials: Nissan vs. Ghosn, Ghosn vs. Nissan, Nissan vs. Kelly, Nissan vs. Ghosn related damages.

4 extradition orders: Tailorx2 & Ghosnx2

2 Interpol red alerts

UN special cabinet assessing the arbitrarily of the MOJ

Documental, Movie, and Drama series.

A most interesting case--I have been following it from the beginning. The Bloomberg articles are really excellent and I would urge anyone to search for them. This case was precipitated by the change in rules of company executive payment disclosure regarding salary introduced in 2010. From Bloomberg:

Pay Disclosures

"The activity at the center of the trial began about a decade ago when new disclosure rules in Japan called on companies to disclose annual executive compensation of more than 1 billion yen ($9.7 million), triggering an effort to find alternative ways to pay Ghosn, according to the proceedings."

@bokuda

Thanks for linking to the intriguing document. I love the Tinker Tailor Soldier Spy codenames. I take it that "Navy" is Nissan and that Charcoal is, well, you know who.

*I just wonder why Ghosn felt like he had no choice and fled to Lebanon. What could make that his best option? *Are you serious?

Uhhhm...just maybe because he most certainly would have been found guilty in the kangaroo court they offer here?

2 ( +3 / -1 )

The guy got a huge salary. Ok. But like others have said, his salary was below the global average for someone in his position. And it was a deferred salary. I don’t blame him for fleeing. Maybe if the prosecutors had allowed him to be with his wife, he would have stayed. It was pretty cruel treatment for an “alleged” nonviolent crime.

2 ( +2 / -0 )

Actually, it does. Yesterday was Nissan's motive to agree to pay him more

Agreed? or Planned?

The point is moot, because Nissan already pleaded guilty.

Making coffee now but don’t know if it will help me understand what I just read...

A nasty, smutty, little ploy from what are obviously cheap, pathetic little bureaucrats. (Prosecutors). What an appauling exhibition of a culture.

Of course it was a "judge" who santioned this, obviously too scared to refuse the prosecutors cowardly demands. Keep degrading your country.

Japan’s system got played by the scheming Hari Nada and crooked Saikawa.

It’s a disgrace and an embarrassment to Japan.

Doesn't fit with yesterday's testimony, "Nissan was afraid to lose Ghosn because other companies wanted him" and where offering him more If he was afraid of Renault he would have left.

Actually, it does. Yesterday was Nissan's motive to agree to pay him more, including the possibility of using illegal covert means. Today was Ghosn's motive to agree to getting his pay (deserved or not) via illegal covert means.

The prosecution seems to be building up a case. That Nissan and Ghosn both agreed means little because the protection target of the law requiring disclosure of payment is potential and actual stockholders, and secondarily other companies that may work with Nissan and would benefit from an accurate report of its financial health.

LOL!! I can feel the despair of the ultra-right. They are out of arguments, the insult is their last resort.

This is getting interesting! Until recently the majority are pro Ghosn even when he escaped to Lebanon. I hope you'll get the idea about why he really did the Houdini thing. The gov't is tight-lip about this case and it has been a sided show, now the curtain is slowly rising. Let trump be a lesson. Ghosn is an A-Class thief and a Liar.
