But to be fair to Trump, it's not him deciding and taking these songs, it's his campaign staff and they should know better. They can't just use music from another artist without approval and royalty fees, they should have absolutely known better. If I were Trump, someone would get fired.

The Stones do not have a legal leg to stand on. The venue pays the music rights, not the event renting the venue. The baseball stadium pays for the music, not the team. Trump is not using the music, the venue is.

If the Stones don't want their music played, they need to take it off the market which means it will not be played on radio stations either.

The key there is the licensing of the product. Without license to use the product it’s theft. A criminal wearing a suit in court can’t be stopped from wearing the suit if they’ve legally purchased it but can be done for it if the the suit is stolen.

Those examples are not entirely irrelevant. Virtually every music act in the world signs with a label, and they agree to various licensing & distribution deals by doing so. Any group, including political campaigns, can pay a licensing fee to use any song from a large catalog at a public event. The Rolling Stones, like any other act, is in that catalog. They don't retain exclusive control over when and where their songs are played.

For decades, this political posturing has played like a broken record. Such-and-such artist complains about such-and-such politician playing a song at rallies. The act blusters about it in the media with threats of lawyers. In the end, everybody knows that a lawsuit to prevent use of the song stands zero chance of success. The Stones, like other musicians before them, are milking the publicity. They get their names in the news. They get to distance themselves from a politician they don't like, and that they presume their fans don't like. They effectively make a free campaign donation against that candidate through the negative publicity. They know the campaign won't roll over and give up the right to play the song, but the longer the band can make a stink about it, the more they think it will hurt the candidate and help the band.

There's no evidence that this is politically effective--it didn't stop Bush from being reelected, and it didn't stop Trump from being elected--but it repeats without fail every presidential election cycle.

@Strangerland Trump is not using their music, the venue is. The stones have licensed their music through ASCAP or other and the venue pays ASCAP. If the Stones want to pick who can use their music they needed to have had that in their agreement to whoever they sold their music license to. The Stones are getting paid. It is all above board. The maker of a suit does have IP. It is very similar. The IP holder of the suit design could certainly require anyone purchasing their suit sign a form saying that they will not wear it in a court.

Most buildings have IP. You cannot take a photo of the Eiffel Tower or Tokyo tower and sell it without a lisence. But if the owners of the Eiffelt tower sell a license of an image to be used on t-shirts, they have no recourse if a stripper buys a licensed t-shirt and uses it as part of her show. The only option the owner of the Eiffel tower IP has is to stop selling licenses or when they do, include a clause that the maker of the t-shirts has everyone buying a t-shirt to agree not to use it in a strip show.

Music has always been present in or at American political rally's, political events. Since the birth of politics.

It is an interesting topic to study.

I remember talking to a guy once that went to Woodstock the whole things political he said. I asked him what did he take away from Woodstock? He said and understanding of capitalism and electric Kool-Aid laced with LSD.

She initiated Congressional hearings over music and lyrics. Started the PMRC.

The Clintons and the Gores have a taste for uninspired pop pap and Muzak - that's why they used it for their rallies. And they still use 'Don't Stop' now. Not my vibe.
