Not really a Mariah fan. But just looked up and played the version alleged to be copied over spotify.. and sounds absoutely different.

I think it's one of the better Christmas songs of the last 20 years or so. But this guy... all he has is the same title? Sounds like he's hoping for a payout to fund his retirement.

By this logic then all the song with the same title with be sued all over the place. Example 'Hello' which is title by artists Adele, Evanescence, Beyonce, the Cat Empire, Eminem, Martin Solveig, Dragonette, Oasis, Lionel Richie. 'Bad' U2 & Michael Jackson, 'Holiday' by Madonna & Green Day, It's My Life by Bon Jovi, No Doubt, Dr. Alban. The list can go on and on....

If it were only the two songs with those names, and his came first and there was a known relationship between the artists, I'd say she should throw him some settlement money, but with 177 songs of the same name and no problems, it sounds like he's just out for a pay day.

Sounds like this guy is just wanting a quick bit of cash..... Knows that he won't win the suit. But most likely hoping for a smaller settlement before the suit reaches the courts.
