Civil courts have backlogs. Sometimes issues aren't known for months after an accident.
A brother was hit in the head while bicycling on a country road by the side mirror of a big "doollie" truck. He was wearing a quality bike helmet and out "training". He is/was a biker that rode thousands of miles every month. The driver stopped and took him to the hospital. He spent 3 weeks in hospital, but some of the injuries didn't show up for 6 months. He only sued for medical care expenses. The driver had insurance which covered it. Took him 3 yrs before he could work again and 2 yrs a before he could ride a bicycle. His balance was "off". He had terrible headaches for a decade. Today, he rides at least 5x a week between 20 and 100 miles for each ride. He does the The Broadmoor Cycle to the Summit (Pike's Peak) race almost every year, though he missed those 3 yrs.
I have sympathy for anyone injured due to accidents, serious accidents. I have little sympathy for someone trying to grab as much cash as possible over an "accident". Life has accidents.
