As how the article is written Smith is not showing any remorse for what he did, if anything he is playing the victim for the "adversity" he has to endure.
Since Will Smith is focusing only on how bad he has it instead of his flaws this seems like something he is making more difficult for the audiences. Specially because Emancipation was finished long before the Oscars, so Smith had already learned from making the movie when he Slapped Rock.
Apparently the fear is not so great to make him show he regrets his actions with actual sacrifices (like returning his Oscar for example). Compared to that the possibility that other people work may suffer seems less important.
