have your say

Japanese labor authorities have confirmed that a transgender employee developed depression due to a strong psychological burden caused by harassment related to sexual orientation or gender identity, or SOGI, and recognized it as a work-related disease eligible for workers' compensation insurance benefits. What do you think about this ruling?

Fine by me. It's long past time to exhibit tolerance and maturity concerning difference of lifestyle and orientation on any scale.

I am for it. Here's my take on work-related diseases that are eligible for compensation, if you got said injury/ disease from work and wasn't by your own hand, the work should shoulder it. I would wish that aside from compensation, discrimination should be a punishable offense because there will be more victims. Why not just fix the cause of the injury instead?

All employees need protection.

Sorry don't believe it, if this person was getting "harrassed at work for dressing as the opposite sex then odds are they were getting it throughout society and not just work so not really work related.

It would be like a person in a wheelchair saying their stress came from the not 100% barrier free work space, ignoring the 90% they cant access outside work.

We need to be careful how Japan proceeds or it will end up like places like Canada.

Recently Transgender female boast online how if they was a day off or leave early from work they can just say they are having menstrual pain. (This is a legitimate "medical" issue for "women") they laugh because they go on to say their employer knows they are not biologically women but challenging their claims of menstrual cramps/pain is considered discrimination and misgendering them.

Everyone has stress for every reason.

No one should expect preferential treatment

because their stress is "special".

Mental illness is not the fault of a work place.

they should be supported and the folks responsible for bullying should grow tf up and do their jobs instead of worrying about what other people look like

Once one sorts through all of the neospeak and word salad, it turns out that simply 'sexual harassment' would do just as well..

And this is enough for you to tar everyone with the same brush and deny this transgender employee's right to compensation? My God! It's still about tolerance in the end. Which part of this ruling threatens you or your identity really?

Yes because they are not women, sorry protection yes, I am fine with, pretending they are actually women like in many western countries, no.

To pretend they have menstruation, to even invent silly devices to "give them the feeling of having menstruation, then pretending to have the real and discomfort and even serious pain women have to endure monthly, is insulting.

I think it's reasonable, harassment is harassment and hopefully this will lead less harrassment and more tolerance in the work place. If it ruled on the contrary, it would only legitimize the harrassment.

Will this transgender person also include he/she developed depression due to a strong psychological burden caused by external environmental stresses related his/her sexual orientation? Does this person feel harassed cross dressing while out in public if so he/she recognizes this as a self thought problem and not a disease.

Either this person needs to face up to the fact that he is occupying a male body and act accordingly or develop a very thick skin. He can't expect society to revolve around him.

We can easily reword this title-

employee developed depression due to a strong psychological burden caused by harassment

I would guess the overwhelming majority of people here have experienced that, not only transgenders, like others have already said.

Pick a number and stand in line. Tons of us have experienced that, albeit for different reasons.

It is work place harassment period, no matter the person's gender, race, abnormal sexuality or disability. There no place for it at work or in society.

Generally speaking if you respect and strive to work positively with others they will reciprocate, or at the very least not harrass you.

Of course sometimes you have stressed out higher ups who struggle to reign in their ego and lack of self esteem.

I wouldn't be surprised if social security deductions would go up if everyone with gender identity crisis would line up for workers' compensation. If a certain company doesn't appreciate the way you work and present yourself, go find another one. Else I'll think not being able to handle work related stress means not capable to work or just a drama to leech on the govt.
