Japan refuses to take the Senkaku dispute to the ICJ because they believe their is no territorial dispute, the islands are theirs.

Unless both parties agree to ICJ arbitration, then the ICJ won't hear the case. It doesn't matter if China wants or doesn't want to take the dispute to the ICJ.

They offered to take the Dokdo dipute to the ICJ, but not Senkaku dispute, which they say is a non-existent dispute since the territory is Japanese,

As for your second comment, who do you think has been sustaining the Japanese economy by taking 25% of Japan's exports for the last 10 years?

Excuse the insensitivity but... "Attacked when dining late at night"? We have no information on what was really going on there. For all we know it might be a bunch of old A-hole J-oyaji acting like far to many J-oyaji do when abroad.

The Chinese are true clowns with their litte gatherings, singing national anthems and what not, but it is obviously sanctioned by the C-gov.

Well, if you look at a map, you can see why Taiwan and China believe the islands are theirs. They are physically just a ways off the coast of Taiwan. The islands are clearly closer to Taiwan than they are to the Okinawan islands.

If you assume everyone is confused regarding any agreements or historical ownership, the physical proximity makes a strong case in Chinese minds that they should belong to Taiwan/China.

Even if there were an agreement, the Chinese would believe the Japanese stole them in the war anyways... which is an open sore.

You've got to learn to understand japanese logic, if you want to understand Japan. The Dokdos are occupied by Korea and the onlty way to wrest them back, without military force is ...........dedede.... the ICJ.

Japanese logic goes something like this, 'what is yours is mine and what is mine is mine'. Once you understand that the whole Japanese reasoning for a multitude of issues (from racism to international trade) will become clear.

@Onniyama - Dog has a point. Plus, the Japanese didn't "bring factories & jobs" to China out of goodwill anyways. They did it for their own self-interests - high skill level in manufacturing outside of Japan and lower cost of labor. Without China/SE Asia, many international companies would not still enjoy the profits they still do.

Of course the Chinese, didn't "take 25% of Japan's exports" to help them out either. But what this whole thing says is business and politics are two different things.

On a side, it's not even all about Chinese vs Japanese. Even within China, HK Chinese and Taiwanese can't stand the red card waving Mainland Chinese.

And for those who take a 'Japan is holier than thou' attitude, remember every time there is some issue with Korea, you always read the following days about some Japanese attacking a Japanese Korean school kid, usually a girl.

I remember in 1995, when those US marines raped that schoolgirl. A woman, a total stranger, just started screaming at me at a bus stop that I was a rapist and should leave Japan.

The japanese have their insane moments... it's just a problem of finding these Chinese criminals among us. Those sneaky Chinese speak Japanese as good as the natives and some of them are third generation.... that;s not playing fair.

China is smart. Japan, by their own actions - buying the senkakus - have created a perfect scape goat. Hmm, now that makes it very interesting doesn't it?! On tv they keep showing the islands by themselves... they never show it being just next to an equally large Japanese owned island!

While not disputing that Ishigaki is Japanese, do you really think that Ishigaki is Japan?

If you do, then you obviously have never visited the place. Culturally the place has a lot more affinity with Taiwan and China than Japan.

This Japanese trick of expanding 'Japan Proper' to the furthest rock sticking out of the Pacific sea is childish impractical and unacceptable.

In real terms, what do those islands really mean for either country? Japan already has Ishigaki. Adding that extra little bit doesn't improve their economics much - as in sea bed drilling rights.

For China, if they get it. What does that mean? Just a bunch of small rocks with Japanese and Chinese staring at each other and lobbing rotten tomatoes across the way with catapults everyday?

Is this dispute worth real money? Or significance? If they were out in the middle of nowhere I'd understand it would mean a claim to a fresh area and expansion of the economic zone.. but... in this case..

Can't the same be said of South Korea? The Japanese are asking for their dispute with South Korea to be resolved by the ICJ. However, the South Koreans refuse to take the Dokdo dispute to the ICJ because they believe there is no territorial dispute, the island is theirs.

South Korean logic also kind of sounds like "what is yours is mine and what is mine is mine" in a way, doesn't it? Maybe once you understand that then the whole South Korean reasoning for a multitude of issues (from racism to international trade) will also become clear.

I actually like a lot of things about Japan, unfortunately I do believe such current development regarding the Islands made a long-lasting damage to the friendship between Chinese and Japanese people. I think it's very unfortunate. I can understand why Chinese people believe that they have an legitimate claim of those Islands. I think the recent move by the PM of Japan has done nothing good for both countries. But of course I condemn hurting innocent people just because they are certain ethnicity, it's completely wrong and the offenders should be caught and punished according to the law.

When the Philippines and China were engaged on a stand-off in April China issued warnings to its citizens living in Manila and other major urban areas. To this day not a single Chinese was hurt or manhandled by unruly Filipinos irritated on recent Chinese incursions to Philippine territory and unjustified trade pressure. Chinese government response was not harsh to indicate that such actions are not allowed.

It already has! There will be war ships from both sides at these islands within a week. Both Japan and China have been waiting for an excuse to have a go at each other for over fifty years and now they have one. China wants revenge and Japan still wants to play Asian bully. I have a feeling the Chinese government is confident in its provocative stand towards Japan and other Asian nations thinking it has gotten hold of sufficient (Japanese) technology and know-how to run its industries independently. Not to worry about the Japanese packing up and setting up shop elsewhere. This [Chinese confidence] may work for a while, but it is sure to backfire. The country is being watched not only by Asian nations, but the whole world and it will alienate itself in spite of (present) cheap labor and cheap products. Not to speak even of all the illegal copied technology and products.

But I do hope common sense and restraint will prevail, because no one is going to benefit from a major escalating dispute.

Japan has GOT to try and mollify the Chinese, whether they deserve it or not, because if not the Chinese will take the islands -- that's all there is to it -- and then there will be no more questions about whom they belong to. It won't result in all out war, and the world will berate China for it, but that's all that will happen while Japan whines about losing the islands. The US won't step in except to condemn any violence that occurs. If only Ishihara had kept his old yap shut and his blinking to a minimum, none of this would even have gotten out of hand. And this is the guy that wants the Olympics and talks about how welcoming Japan is to other nations and cultures wall calling them 'gaijin' if they question his motives (including Japanese).

Japan is going to lose this.... and quickly... if they don't shape up and settle down. Move away from the island, and shut down the rhetoric. It will be seen by the wingers as a lack of strength--the same wingers who lament Japan's surrender in WWII and want the Emperor restored to power--but the strength is knowing when to do what is best for the nation, and the current path is not. I would say the same for China, but they are never going to stop being aggressive, for they have the means, and they can try and justify it based on history, and the rampant nationalism makes them a force to be feared. Don't give them the islands, but don't push them into taking them by force. If Gemba is serious about calming tensions, stop the purchase of the islands by weak-minded nationalists like Ishihara who are half-way in the ground as it is. Restart talks about joint mining of the gas fields in the area, and assure China you mean to improve relations. Granted, it would be seen as weakness by all the war-mongering idiots in this nation, but avoiding war is in everyone's best interests, and taking the higher ground is just that -- the higher ground. China certainly isn't going to take the higher ground on this issue.

I doubt very much that China or Taiwan will bring this to the ICJ... not because they think they'll lose but why would anybody let a court decide something when they 100% feel it is theirs in the first place. When you're dealing with deeds and titles within one country's borders, yes, a court would work but there are no deeds or titles to this land that China, Taiwan, or Japan would recognize other than one's produced in their own countries. This will come down to either dividing up the mineral rights around the Islands or military action. If I were one of the 3 countries I'd quickly put a massive military prescence on and around the disputed islands and dare the rest to take them back. Possession is 9 tenths of the law, at least that is what I've heard.

Not only that, but any decision by the ICJ is non-binding, and I guarantee that if both nations allowed it to go to the ICJ the country that would be declared in the wrong would simply dismiss it and the isle roes would continue as is, with more vehemence. Possession is 9 tenths of the law, agreed, and that is why it's in Japan's best interests to tone things down, make amends (not that they need to, but because they can), and wait it out. Time is on Japan's side if they don't push it, same as time is on South Korea's side with Dokdo, and definitely with Russia in terms of the Kuriles. Japan cannot possibly win all its island disputes, but with the Senkakus, if it tones down the current tensions, they stand to win in the long run.

It's all show so that PRC can evade domestic economic problems.

Their bubble is about to burst with small/mid size companies defaulting left and right. The wages are sky rocketing and international production facilities downsizing and or consider to downsize. (Not able to move out completely due to PRC commerce law).

If you notice, Uniclo clothing are now made in places like Bangladesh.

Believe it or not, the so-called "control" of the islands by Japan is paper only for it's uninhabited with just a few Coast Guard patrolling nearby. PLA, can at any time, occupy the islands but they have not done so like they did with the islands in South China Sea. The Senkaku dispute is nothing more than a political card used by China to deflect their domestic problems and nothing more.

This topic is telling me that the diplomacy between Japan and China has been broken. If hosting country, in this case China, is not willing to do a job for safety of Japanese citizens and business, Japan needs to think twice before investing more in China. Japan may want to think about relocating business investments to somewhere else safer. China needs Japan more than Japan needs China. We should not connect this single case to the island purchasing political issues. The Japanese got beaten because of his bad behavior ( made noise in public). There are millions of Japanese people live and work in China. All of them are safe. Japanese government is too sensitive. Chinese people are friendly to Japanese people always.

Japan has GOT to try and mollify the Chinese, whether they deserve it or not, because if not the Chinese will take >the islands -- that's all there is to it -- and then there will be no more questions about whom they belong to. It won't >result in all out war, and the world will berate China for it, but that's all that will happen while Japan whines about >losing the islands.

Japan HAS tried to mofuy them byu stopping Ishijhara plans to biuld there. But that ewasn't enough. The only way to "Molify" China is to hand the Senkakuis to them without argument. Is that what you are proposing?

These islands are no where near Japan and the only reason they are considered Japanese is cos the US gave them to Japan at the end of WW2. They never were Japanese territory. Disillusiomned, if China wants to act likea civilized country then they can take Japan to the ICJ to settle the dispute. But they haven't , preferring to play strong-arm tactics and letting the rabid mobs smash cars, restaurants and now attcking innocent unrelated people. The Chinese call Americans "racist" but we don';t go around beating people up, amd those whjo do are prosecuted under Fedral laws. Senkaku and Takeshima are two different cases as you know. But with both cases, if people read Cairo declaration and San Francisco treaty thoroughly, the cases become clear. Since the both issues arise from ignoring SF treaty, I put some facts here. Plainly and simply

1)Former Secretary of State, Dean Rusk sent a letter to Korea as a representative of the Allies who completed SF treaty clearly stated in 1951 that the island is Japan territory.

2) James Van Fleet as Eisenhower U.S. President's special ambassador to S.Korea delivered the message from the US that the territorial sea line which the South Korean President set up in 1951 was illegal. James stated in his government report in 1954.

3)Douglas MacArthur, on April 27, 1960 from the position of having full knowledge of postwar processing of the Allies of in those days, addressing telegram wording of a telegram to Ambassador to Korea McConaughy. I can read it clearly stated that Takeshima is a territory of Japan. This document was a secret for long time but now which is available at U.S. Public Record.

Yes, some people are right according to Cairo declaration, Japan only allowed to have just 4 main lands.But this declaration was a preparation to set the stage for SF peace treaty in 1951. The article 2 and 3 added more details. In article 2 shows what Japan lost, separated from, or returned to the original nation. The article 3 indicates what Japan may keep. Takeshima was one of them Japan may keep. Senkaku which had been the part of Okinawa prefecture since 1895 became the under occupation of the US. China said nothing then.The US did not think US ruled Chinese islands then,either. It was returned to Japan in 1972. China did not say anything like they do today.Why?Just simply makes no sense if Senkaku had been Chinese territory.

But the UN research team found some natural gas under Senkaku, China started saying Senkaku is China. And after, Taiwan Haixia missile crisis in1996, China started thier unclear budget military expansion especially on their navy. China expressed its` intention to US to divide the pacific at pearl Harboe as the middle point. between US and China. The US did not subscribe to that suggestion. So strategically Senkaku became important for China as their free route for the pacific. For me this is not only the island issue. I am afraid of Sinocentrism.

1)The title by geographical approachability does not have a meaning in the international law.

2) Discovery itself is immature origin of rights to obtain a sovereignty in international law which is inchoate title.

3) When a foreign country begins to use realistic sovereignty and a discovery country does not protest, the title which uses sovereignty is only larger than the title of discovery.

The world we live in now is lawful society. If only the distance determines its` sovereignty, it will produce so many problems. You know Guam is America but Taiwan is closer than America. However Taiwan has no intention to claim as Guam as Taiwan.

Another clueless wonder who have absolutely no clue as to the background of this dispute.

After the JPN Gov. had checked China called Shin then, if these islands belonged to China or not, then the islands were registered as Okinawa Japan 1895, Japan built a bonito flakes factory. Japaneses people were living on the island till1941,then WW2 broke out. Everyone on the island went back to the mainland.

In this fact, Japan seems obtains the 1)2)3) of the judicial precedent in an International law one above my comment.

China and Korea should send Japan to the international court to solve the issue now not sending any military ship. Japan has now been active supporter of UN for a long time and no military aggression they have manifested since the peace treaty in San Francisco. China and Korea should not stimulate Japan. They are giving the right reason to Japan to change their constitution article 9 which is declaration of war.

There was no Peoples Republic of China in 1895 and the Republic of China or the Chinese Kingdom signed over the islands in 1895. There is no more Republic of China, these islands belong to Japan.

The last time I was in China I happened to mention to a total stranger that I lived in Japan and he glared at me with a look of pure, undiluted hatred. While the virus of xenophobia is running rampant in China I don't think I'll be visiting again any time soon -- I just don't feel safe there. So much for people-to-people diplomacy.

Obviously you didn't read my post before you copied and pasted. I said they need to calm down the rhetoric and start suggesting joint development of the oil fields again. If they can calm down all this talk of confrontation time will be on Japan's side in terms of island possession. They keep speeding it up and they'll lose the islands for sure.

The consulate said another case involved a Chinese person throwing a bowl of hot noodles with soup at the face of a Japanese national.

The Japanese who got his face splattered with hot noodles required medical treatment for his eyes. It wouldn't surprise me if the Chinese started killing Japanese citizens in the not too distant future. Some deranged Chinese could easily carry out a Todd Bachman style killing. We might even see something similar to what happened during the Boxer Rebellion if the Chinese government escalates the situation.

That is probably an English translation of the Japanese Government's warning. There's no way of knowing who translated it. It could have been just some news agency. It 's just added information to show that there are many Japanese nationals living in Shanghai. Some of these people may be there only short term, but some may have chosen to make China their "home" and thus have been their many years.

The word "home" is often used in that way to figuratively describe where someone has chosen to live their lives. The sentence "Japan is home to many Chinese" does not mean in any way that Japan is part of China. Nobody in the Japanese Government or the Japanese Press is even insinuating that Shanghai is Japanese territory.

You should know SDF's weaponry is selected, designed and built for protection and not for attacking, it has no ability to attack china's mainland but they sure will send most of PLA-navy's invasion force to bottom of the sea even before reaching japanese shore.

If you still believe china can invade japan, do some googling about "CURRENT" PLA and SDF before spweing out nonsense.
