In a democracy it's difficult to accept that a government "owns" the body/remains of any person. The court order is fully justified (unless you believe it's "giving unto caesar").

In death all ends and handing over his remains is the correct action to take. In Japan ashes means bones. You can't sprinkle bones and in most locations it's illegal.

I understand the ruling of the court and probably if I had be the one to give a ruling I would have do so... but honestly making the ahses disappear for good would have been better.

No. Terrorists remains should not be returned to anyone, because it is almost certain that will guarantee martyrdom. The court should have shown consideration for the Japanese public and thousands of families who were destroyed by this animal.

This is a hard one, by one side you're denying the final rest to a human being that has already pay with his life for his crimes. But in other his rests can be weaponized. I will go with the last, as government your main duty is protect to the general population. Make a law that for national securiy in the case of terrorism the remains of the terrorist will be dispersed in open sea and close that possibility.
