"Underpay" is a subjective term.

Depends what you mean by 'underpay'...
a) Pay less than the worker should be valued based on his/her skills.
b) Pay less than the contract stipulates.
c) Pay less than the minimum wage.
(b) and (c) are obviously illegal.
(a) is just a rubbish company.
