It doesn't matter how many lines of code out of your platform are legit or not: bottom line is you stole some. For example, my music library may consist of 10,000 legit songs, but if I pirated just 10 of them, like a woman who was found guilty of doing so in the U.S. you can be fined for more than your life's freaking net worth!

Is not. You would have to prove the intention to steal them. Google might have been using that insignificant code without any intention of "stealing" it, just because it was made to believe by Sun that it's OK and that they are welcome to do so. Very shoddy from Oracle here... They have absolutely no loss from Google actions, but claim damages of billions...

Major issue is; can APIs be copyrighted? Not the underlying code (naturally copyrighted), but the API itself. Because if yes, it will completely change the way the IT industry is working right now... No one would be able, for example, to write an improved network driver, because the API calls (predefined standards) to the middleware will be copyrighted by the OS maker...
