The current UK law preventing the naming of underage offenders has been in existence since 1933. It would take an Act of Parliament to change it.

Andrew Tate had posted a video on social media, viewed by nearly 15 million people, blaming the stabbing on an "illegal migrant".

So come on and tell us if he's right or wrong.

Of course he’s wrong. He doesn’t have the facts and dimwits are throwing bricks at each other because of something they read on Twitter.

Gullible, desperate for acceptance, quickly riled up. Extremism displays these poor traits; edl, maga, fundamental religious types. Angry about different things but the same cookie cutter mentality.

I think it was just carelessness on the part of Times Radio. It was very early in the sequence of events and they stopped reporting the information pretty quickly.

What I find depressing on this comments page is that everyone is talking about immigration and no one seems to be thinking about these poor children or their families. They just want to turn it into a forum to express their political beliefs.

I wonder the teenagers defence, mental health, diminished responsibility could provide a mean to question liability for murder.

Diminished Responsibility: what it is and why it is a “special” & “partial” defence to murder

https://rustemguardian.co.uk/blog/2024/02/08/diminished-responsibility-what-it-is-and-why-it-is-a-special-and-partial-defence-to-murder/

Consequently, a person who successfully mounts this defence will be convicted of manslaughter rather than murder. Diminished responsibility is therefore a special and partial defence to murder in England and Wales. It is “special” as it is only available to murder, and “partial” because it does not allow a defendant to fully escape liability, but instead lowers the conviction of murder to manslaughter.

There may have been "leakage" Sid, as automatic restrictions theoretically only begin once court proceedings are active.

The point when a suspect is charged and appearing in court for the first time.

The Times radio took a risk.

Media may challenge an "anonymity order" if identifying the defendant could be deemed to in the public interest or assisting/maintain public confidence in the justice system.

However to openly broadcast the alleged attackers name "could" be a criminal offence.

Press regulator (IPSO) advises editors “avoid naming "children" under the age of 18 before arrest for a criminal offence, also before they appear in a court".

There has been some speculation locally, on the grapevine, some insisting directly from neighbours in the same street where the alleged defendant resides.

Lynch mobs are alive and well even today. How stupid and depressing.

The ever-present danger of misinformation has lead to some serious injuries being caused to many innocent people; AI-generated material (based on algorithms triggered by specific search-words) is a very dangerous development which requires urgent reeling-in by legislators - yet another instance of 'the next-big thing' which takes hold quickly before anyone realises the ramifications and the need for rules and regs to be applied.

The online Russian rumour-machine was also quick off the mark in providing the misinformation in this case, stoking serious trouble from behind the scenes, never one to miss an opportunity.

His name was released initially (I actually heard it on Times Radio) when it wasn't realised that he was 17 years old, and then the usual restrictions were applied very quickly.

@owzer

Andrew Tate is completely wrong. The accused is not an immigrant, illegal or otherwise, and was born in the UK. All of this has been widely reported.

Heard a great description of Nigel Farage as Tommy Robinson in a cravat.

That's good. Yaxley-Lennon is funded by Zionists. No surprise, really.

Nigel Farage many be a number of things, some could be deemed inflammatory.

However at no time did Farage incite thuggery, or encourage violence.

At no time has the alleged 17 year old defend identification ever been released by any UK broadcaster or mainstream media organisation.

All reporting restriction remain fully in place.

The police forces tasked with the investigation, have applied through the CPS/judiciary/court that the identity of defendant under the age of 18, now the subject of criminal proceedings are protected by automatic reporting restrictions under Section 49 of the Children and Young Persons Act 1933.

Because of the severity of the charges, it is more than likely evidence presented to the court in any subsequent trail will be subject to stringent reporting conditions.

Let's be honest, if the offender had been a white guy, his image would have been on front pages across the country (as highlighted with the Bulger case mentioned above).

Do you know when pictures of the Bulger case killers first appeared in the media? Their names were only officially released at the end of the trial.

‘Let’s be honest’ is a very good principle. .

Do try to get some facts in place before giving us the ‘if he had been white…’.

It’s very tiresome.

@albaleo

I remember the Bulger case well and the identities of the murderers were not released until after they were tried and found guilty.

The usual suspects are trying to make this about immigration. As the accused was not an immigrant it's completely irrelevant. I have concerns, too, about immigration into the UK, but this case has absolutely nothing to do with it.

The rioters were not politically motivated. If you look at videos of the riots there are many teenagers who are just out to have a fight, as are their seniors. They are not local, and hecklers of Starmer were not local. They insult the real locals who are trying to grieve about this horrible incident.

The English Defence League are not some kind of mass movement of the people. They are a few hundred thugs who look for any excuse to cause trouble. One of their leaders, Tommy Robinson, had many convictions for violence and dishonesty before he became 'political'. I'm proud to say that when he came to our local football club to recruit members he was laughed at and had to make a quick exit. I can testify that he's not so brave when he's on his own.

Do you know when pictures of the Bulger case killers first appeared in the media? Their names were only officially released at the end of the trial.

There was a released video of the killers in the shopping centre where they abducted the little boy. But that was in order to help identify and find them.

I don't get the desire to see a picture of the accused. Why not wait and let the police investigation and legal procedures take place? I'm sure pictures will emerge eventually.

Multiculturalism has consequences

I don't get what that has to do with this situation. The deliberate killing of young kids is rare. When it happens, it's usually associated with mental issues and not cultural ones.

I recall when I lived in Kobe the name of a schoolboy who beheaded another boy was not identified.

2 ( +7 / -5 )

The name of the 17-year-do is protected by law just as it is in Japan.

Minor or adult, murderers in the UK can enjoy 3 meals, bed and shower for the rest of their lives. In the meantime, lives of innocent people are lost and their families suffer for the rest of theirs.

-8 ( +4 / -12 )

Let's be honest, if the offender had been a white guy, his image would have been on front pages across the country

Indeed, and the subsequent riots would be described by the BBC in that scenario as "mainly peaceful".

-8 ( +4 / -12 )

How about just say that all violent crime gets charged as an adult? I presume judges have discretion for leniency if it is really needed.

3 ( +8 / -5 )

BBC reported the ethnic background of the offender on the live blog right after the event.

Let's be honest, if the offender had been a white guy, his image would have been on front pages across the country (as highlighted with the Bulger case mentioned above). As it is, the UK media has closed ranks and people understandably feel like they're being lied to, leading to considerable anger and civic disorder.

Over a hundred people were arrested in rowdy scenes outside Downing Street - it was a huge protest aimed at Starmer and the reporting seems to downplay it. He was also incessantly heckled by locals when he laid a floral tribute at the streetside memorial and promptly fled the scene in his rover.

I get the idea behind the laws in many western countries and Japan to keep the identify of underage suspects and convicted a secret.

But this also leads to almost as many problems as this policy is trying to fix/avoid!

The biggest is in the most serious cases these juvenile offenders get released and the victims are not informed not are potential future victims.

In this case like previous other cases, the secrecy leads to false rumours and misinformation spreading and the authorities unable to stop or counter these rumours and misinformation because in many cases doing so would lead to identifying or making identifying the juvenile offenders easier.

I lean more towards a more middle ground solution.

In most cases not involving violence keeping the identity secret and giving the juvenile s chance in the future is reasonable.

But in such cases as this, mass murder, sexual assault, terrorism, and other serious crimes that put the public at risk, this law should not apply.

A juvenile rapist over 15 a mass murderer of 15 etc... Knows full well the seriousness of their actions and is a long term danger to society and like with adult offenders the public should know who they are when they are released and where!

-6 ( +5 / -11 )

The name of the accused was released in the mainstream press in the UK. He was born in the UK and is not a muslim. You expect this kind of rabble rousing from someone like Andrew Tate, but Nigel Farage is fuelling the fire with his conspiracy theories about a cover-up. How shameful of them to use the sorrow and shock of this terrible event and use it for their own warped political ends. It tells you exactly the kind of people they are - they do not care in any way about these poor children or their families.

1 ( +8 / -7 )

For a crime this heinous, he should be tried as an adult and then he could be identified by name.

6 ( +9 / -3 )

Nowadays, it is impossible to hold information.

If you hold truth about crimes when obvious, don't expect people to be happy.

If the criminal deserves protection before his sentence, everyone shall know his name since what happened was public !

How abt killed kids? This "law" applies to killer only than?

I do not make the laws. Governments do that. In all of the developed countries like US/Europe/Japan the names of underage criminals are protected and often their criminal records are sealed.

In time I would think his name will be released or leaked like the two very boys in Bootle who killed a very young child.

”Murder of James Bulger”

On 12 February 1993 in Merseyside, two 10-year-old boys, Robert Thompson (born 23 August 1982) and Jon Venables (born 13 August 1982), abducted, tortured, and murdered a two-year-old boy, James Patrick Bulger (16 March 1990[2] – 12 February 1993).[3][4] Thompson and Venables led Bulger away from the New Strand Shopping Centre in Bootle, “

Another very bad child killer was Mary Bell.

People/offenders under 18 are not adults in the English and Australian legal systems.

This has a long history and obviously predates these offences.

So sorry for the "usual suspects " who seek to vilify a whole people based on the actions of one.

Must be frustrating having all that bigotry bottled up and nowhere to express it.

This is what you get when disinformation meets angry, thick incels.

How abt killed kids? This "law" applies to killer only than?

The reason for releasing the names of the victims is quite different. It's in the interests of their families. If names are not released, it's quite likely people in the neighbourhood will be asking around about who was killed. It wouldn't be pleasant if one of the victims' families was asked.

And condemnation and vilification from government and media of those decent souls fed up to the teeth with their loved ones and compatriats continueing to be slaughtered.

I hope you are not including trash like the rightwing mobs who smashed things up and attacked innocents in ‘decent souls’.

Yes. The law about revealing the names of suspects under the age of 18 only applies to suspects under the age of 18.
