Seems fair to me.
It worries me to think that there are those who believe themselves to be above rules.

War is hell! This just goes to prove it, even if you can call it just doing ones job, killing, blowing up people etc..it is hell.

There are good soldiers who fight for freedom and there are bad soldiers who kill for pleasure. All soldiers are not alike.
Sorry Mr Einstein but my freedom today, and the lives of my family and I rests largely due to the men and women who paid with their blood in WW2 fighting war to avert and destroy the rise of nazism. For that I will forever be greatful.
I hate war, but war at times is a necessary evil and it's most unfortunate.
Please understand that there will always be elements in this world that will try to destroy the freedom and dignity of all freedom loving people. People who don't understand this are like sheep in queue.
It's most unfortunate that we will always have a few bad soldiers in any army.

The question is, how well do the insurgents follow the Geneva Convention?
Have they signed anything, first of all?
Wikipedia says "The Conventions apply to a signatory nation even if the opposing nation is not a signatory, but only if the opposing nation "accepts and applies the provisions" of the Conventions."
Do the insurgents accept and apply the provisions?
Because there is little sense in holding some soldiers to standards which are flouted by their enemies.

Charged with murder for doing your job... what a load of crap. The 'victim' was an insurgent, everyone accepts that, yet due to the rules of engagement these Marines are to face a trial.
