Barr defends aggressive federal response to protests

U.S. Attorney General William Barr defended the aggressive federal law enforcement response to civil unrest in America as he testified for the first time before the House Judiciary Committee, pushing back against angry, skeptical Democrats who said President Donald Trump’s administration is unconstitutionally suppressing dissent.

The hearing, held Tuesday as the late civil rights icon John Lewis laid in state steps away outside the Capitol, highlighted the wide election-year gulf between the two parties on police brutality and systemic racism in law enforcement. Massive protests have sparked unrest across the nation following the death of George Floyd at the hands of Minneapolis police, and calls for police reform are growing louder.

But Barr said “violent rioters and anarchists have hijacked legitimate protests” and argued the violence taking place in Portland, Oregon, and other cities is disconnected from Floyd’s killing, which he called a “horrible” event that prompted a necessary national reckoning on the relationship between the Black community and law enforcement. But he also said there was no systemic racism in law enforcement.

“Largely absent from these scenes of destruction are even superficial attempts by the rioters to connect their actions to George Floyd’s death or any legitimate call for reform,” Barr said of the Portland protests.

The hearing marks Barr’s first appearance before the committee after 18 months in office, bringing him face-to-face with the panel that voted last year to hold him in contempt and is holding hearings on what Democrats say is politicization of the Justice Department under his watch. But little new ground was uncovered; fuming Democrats often used their five minutes to lay out their frustrations and cut Barr off as he attempted to answer questions.

The hearing comes during a tumultuous stretch in which Barr has taken actions cheered by President Donald Trump but condemned by Democrats and other critics. Among them: the Justice Department’s decision to drop the prosecution of former Trump administration national security adviser Michael Flynn and Barr’s urging for a more lenient sentence for Trump ally Roger Stone, a move that prompted the entire trial team’s departure. Trump later commuted the sentence entirely.

Republicans were ready to back Barr up, with the top Republican on the panel, Ohio Rep. Jim Jordan, using his opening statement to show an eight-minute video that spliced together images of violence by protesters around the country.

Democrats retorted with a video of their own of more peaceful protesters, shown by Rhode Island Rep. David Cicilline.

“We fought for democracy, for the right to speak freely and you are attempting to take that away,” Cicilline told Barr. “What’s worse, you’re doing it for the sole purpose of furthering the president’s political agenda and generating footage for Trump campaign commercials.”

Opening the hearing, committee Chairman Jerry Nadler said the Trump administration had “twisted the Department of Justice into a shadow of its former self,” serving the powerful before average Americans. He said the committee has a responsibility to protect Americans “from that kind of corruption.”

Nadler said Barr had “aided and abetted” Trump’s worst impulses and excoriated him and the Justice Department for turning a blind eye to necessary reforms to police departments, for dismissing Black Lives Matter protests and for flooding streets with federal agents to stop protesters.

Under combative questioning, Barr acerbically defended himself but revealed little new information about his motivations or the Justice Department's recent actions on policing or otherwise.

“Many of the Democrats on this Committee have attempted to discredit me by conjuring up a narrative that I am simply the President’s factotum who disposes of criminal cases according to his instructions,” Barr said in his opening statement. "Judging from the letter inviting me to this hearing, that appears to be your agenda today.”

On policing, Barr's testimony underscored his department's ongoing effort to differentiate between increasing violence in some cities and Floyd's death, which has led to state charges against four officers and is under investigation by federal authorities. Massive but peaceful demonstrations followed Floyd's death in May.

The attorney general acknowledged to lawmakers Floyd’s death struck a chord in the Black community because it reinforced concerns Black people are treated differently by police. But he condemned Americans who he says have responded inappropriately to Floyd's death through what he said was rioting and anarchy.

“As elected officials of the federal government, every member of this committee — regardless of your political views or your feelings about the Trump administration — should condemn violence against federal officers and destruction of federal property,” Barr said. “So should state and local leaders who have a responsibility to keep their communities safe."

Civil unrest escalated in Portland after federal agents were accused of whisking people away in unmarked cars without probable cause; the people were detained and later released. And in Washington, D.C., peaceful protesters were violently cleared from the streets by federal officers using smoke bombs and pepper balls last month before a photo op by Trump in front of St. John's church, where Barr had accompanied him.

He defended the broad use of law enforcement power to deal with the situation, noting that protesters had earlier set fire to the church and "it was total consensus that you couldn’t allow that to happen so close to the White House.” The department’s internal watchdog has opened investigations into use of force and other tactics by agents in Washington and Portland.

He also said the force was used because the protesters would not disperse from the area when law enforcement officials were trying to move back the security perimeter, a decision made the night before. When pressed on details, he pointed to the investigations.

The use of pepper spray was warranted, even if peaceful protesters were also harmed, he said.

Beyond the federal response to the demonstrations, Barr was pressed in detail about his intervention in the Flynn and Stone cases, both of which arose from special counsel Robert Mueller's Russia investigation. Democrats criticized him for partly taking into account Stone's health and age, 67, and said those standards haven't been used in other similar cases.

Barr said he told the acting U.S. attorney that “we are going to leave it up to the judge” and that he ordered the revised recommendation to be filed when the line prosecutors submitted an initial recommendation calling for a sentence of seven to nine years.

“And even though I knew I would get a lot of criticism for doing that, I think at the end of the day my obligation is to be fair to the individual,” Barr said.

As Republicans quizzed Barr about his efforts to untangle the origins of the Russia investigation, Democrats scolded him for downplaying the gravity of Mueller’s findings in a summary letter that he released before the public had even seen the report. Justice officials are now investigating the previous Justice Department's decisions as it started investigating Trump's ties to Russia during the Obama administration and Barr has been sharply critical of his predecessors.

Democrats believe that their right to dissent is being violated if the government uses it resources to stop Marxist rioters from burning down federal buildings and hurling molotov cocktails, frozen water bottles, and bricks at the police. In other words, Barr is a criminal for trying to stop the mob from burning down the courthouse and Federal properties. They want marked cars and the Feds in uniforms that makes them targets and they did it the smart and deceptive way. The Democrats today showed they wanted to hear themselves and didn’t want to hear from the AG at all. They were rude, inconsiderate, wouldn’t let him speak, wouldn’t give him a 5 minute break. AG Barr testimony was very clear what he is doing and why and the videos backed up the fact that these are not "peaceful" protests.

I am sure many people who watched the testimony were seeing this for the first time, and now realize what is actually going on. I expect this to be over within a week or so, as even Antifa themselves are realizing this only helps Trump get reelected.

That was the most hilarious part, Barr said, I thought this was a hearing and I thought you were here to hear ME. they finally got him there and wouldnt even let him speak.

Of course, I knew that the Seattle congresswoman would be the one to be featured on CNN. Her whole rant of "Im starting to lose my temper" was manufactured outrage for YouTube and Twitter consumption. Multiple times Dems talked over AG Barr and said "I havent asked you a question yet" to cut off any answers he tried to give until the time ran out.

Yes, we also found that there is yet another investigation we didnt know about into the unmasking with yet another prosecutor.

Another good part was when they kept saying Trump friends get special treatment, and Barr said asked who has been indicted on the Dem side and they couldnt name anyone.

If it were indeed special treatment, none of those people would have ever been indicted to begin with. They spent an inordinate amount of time talking about the original length of Roger Stone sentence considering it was legally commuted anyway.

'Largely absent' is Barr's wrong narrative laden opinion. George Floyd's death is the reason peaceful protests largely occur. If he gets that straight, first, it'd help bring more peaceful solutions.

Barr is frighteningly wrong to believe there are not even superficial attempts for reform. What a stupid statement. Reform is exactly what's been the subject of unfair practice by the judicial system which is why the protests, and ultimately violence, are occurring. Voices were not heard. Pleads to listen were ignored. And now, when a protest occurs, he says at a point of where violence occurs they weren't there for any superficial attempt at reform? F...ing ridiculous.

If an incendiary comment by idiot president referring to protestors as terrorists doesn't pop out of his ridiculous mouth, people would not be so angry. Republicans don't want peaceful solutions toward racial equality, and if they did, they'd understand reform has been on the table for a long time. Because many of them are 'Proud Boys', our local variant on the Brown Shirts of yesteryears. When you don't let someone speak, eventually they stop bothering to try. Violence often ensues.

Teh mess that is the current-day USA is a direct result of the people feeling everything is futile. A LOT of people who voted for Trump did so in the hopes he'd do something different, which would lead to better lives for them. Four years later, they only need to turn on the TV to see that things are clearly much, much worse.

A LOT of other people voted against Trump. They had watched the unbending, hard-line extreme right wingers (then including the Tea Party) who weren't the opposition during the eight years of Obama, they were obstructionist. There was complete and utter disrespect for the office of president (calling Obama a liar during a speech, pointing their finger up his nose on the tarmac etc). Then Trump was elected, and twelve years later the country has gone from Hope, to Hope The Country Doesn't Collapse.

And then, there was already a HUGE portion of the population who were disenfranchised well before even Obama. They've seen the past twelve years go even further down the toilet.

And in the midst of a pandemic, Trump and his elites have made billions.

And you wonder why the country has burned?

This is the bed the Republicans created by going so far to the right, that Obama appeared far left to them (the man was a centrist - which as a centrist, is why I like him).

I'm not sure that Barr is necessary stupid. He's smart enough to keep Trump happy. And if that's his goal, then it would make him pretty effective at meeting that goal at least - he's managed to avoid the same anger from Trump that Sessions received.

Yes I was wondering why Barr even needs to defend his obvious independence. If Trump were controlling him, we would have multiple FBI and DOJ indictments against the liars and leakers. We dont (yet), even for people the IG said lied and falsified documents on the Dem side.

Swallwell was the absolute worst. He clearly only wanted to hear himself, he wouldn’t let couldn’t get a word in edgewise in. It was just dishonest, disrespectful. Here's another question for the future - how does the reckoning for this look when Biden is president? Will new checks and balances be put in place to prevent future tyrants like Trump from abusing the office? He exploited the holes in the system, and it's unlikely he'll ever face any punishment for the overwhelming majority of what he's done (if he even survives to the election in covid season in the first place - he's definitely in a high-risk category). But will America take steps to ensure this travesty does not happen again? Is this America's rock bottom? Or is there still a long way to fall?

Likely the same for the veterans, as no veteran would stand there to protect someone shooting explosives at federal officers from behind them. Of course these are civil law enforcement agents and it’s the best thing that could happen and to get one leg up on the stags is the element of surprise incoming in a marked car or in uniform we clearly make them a target, so dress up in black or military fatigue you get the best agents you can muster and you snatch up these criminals, you give them their Miranda rights, you prosecute them, and hopefully you can incarcerate them for a very long time and charge them with a federal crime, something that they can’t dismiss so easily as in state charges and this is a very good thing. I hope they ramp it up and do more of these, I wholeheartedly support it and it’s long overdue.

Also if these mayors and governors on the state level want to see their cities damaged and have continued anarchy that’s on them and I hope the voters vote them out or they can keep them and watch their city and their state turn into another Somalia.
