I don’t think there is any uncertainty at all. The DOJ simply cannot as a matter of policy allow a legal subpoena to be ignored by someone who was nether an attorney for nor an employee of the FORMER administration, which in and of itself makes the entire claim of privilege moot.

Indeed. Bannon defied a lawful subpoena. He has not executive or attorney client privilege. He has been found in contempt by a bi-partisan majority and is not going to face the consequences.

In the meantime there's an unused, empty jail cell under the Capitol where, if the Washington pols were serious about dealing with the present threat to American democracy (that nobody has ever seen before), they would bung Bannon using Congress's power of Inherent Contempt to signal and send shivers down the spines of all those right-wing would-be insurrectionists. Congress isn't a court. Contempt of congress is every American's right. A judge can hold someone in jail for contempt, not congress.

Now, let the DOJ press charges and take him to court for a criminal offense - then he can be fined and put in jail.
