No, the word 'is' is the present tense of the verb 'to be'. It refers to the current state of events. If they were referring to the lowest point, it would be 'has gone down to [as much as] 3.7 percent'.

Regardless of whether we like Trump or not, we need to be honest about a few things. Trump is not an idiot. Trump has consistently been suspected of breaking numerous laws especially during his early business days. He is good at not leaving direct connections.

As for the Russia collusion case, most of what they seem to have against him is circumstantial evidence. You can’t build a federal case on circumstances. Circumstances can be considered an impeachable offense, but not enough to make a judge want to bring an indictment down on a president.

The nature of his position, as the president, affords him some protection as it can be considered complete career suicide for a judge to indict a President on circumstance.

That is why they are looking for a “smoking gun.”

Try original sources. Like watching the source video instead of CNNs selected snipped. (Famous recent example: The Covington highschool thing). And try to make a distinction between what is meant and ridiculous nitpicking about words. (Random example: No, Obama did not write a formal founding certificate, but his policies did create ISIS, so yes, he is the founder). I could go on for ages, but all these so-called "fact checks" (often with the help of a party political hacks like the couple of activists who run "Snopes") fall into these main categories of misrepresentation and sophistry.

He also claimed to have had “the biggest Electoral College win since Ronald Reagan.” Another lie. Called on it he then claimed "that he meant he achieved a bigger Electoral College victory than any Republican since Reagan". Another lie. And then, as is his habit he blamed someone else for giving him the information.
