I've heard/read from multiple sources that if the child is in fact Bieber's that Ms. Yeater will be arrested for statutory rape as it is illegal for a 19-year-old adult to have sex with a 16-year-old-minor.

Interesting. I am leaning in the other direction. I think Bieber is not the father and that the plaintiff is nowrunning scared. With today's tech it is quite easy to prove if he is the father or not. He knows this and that is why his lawyers are saying they will counter-sue. I think this young woman is about to find herself in some very hot and expensive water.

I'd also sue her for slander....telling the world that he only lasted for a brief encounter....

i read somewhere that if the gap is 3 years or less (e.g. a 19 year old and a 16 year old) then it's not considered SR, but i could be wrong.

well there will be a confidentiallity agreement so no one will ever know if he is or not the father and the woman will be a single mother with a lot of money if it is Justins or she will be a single mother with no money if he isnt. This is being pushed under the rug. All we can do is wait for the tabloid photos of Justin with his baby in a park or something next year if its true.

@Ben_Jackinoff. I agree with you. I don't think he is the father, either. Apparently, Ms. Yeates accused another man of being this baby's father earlier this year. Poor kid.

The law might be on the books for statutory rape but in terms of sentencing it's mostly a crime that only men are found guilty of to any real extent.

Well, if he was 16 and a half and she just turned 19, she is in the clear. What a completely stupid law they have in California anyway.

He knows this and that is why his lawyers are saying they will counter-sue.

Well that will be tricky. Just because the baby is not his does not mean they did not have sex. Unless he proves they did not have sex he will have no basis to counter-sue. You cannot expect a woman to know a man is not the father if they did have sex.

But, of course, those of us in the know realize the odds of causing a pregnancy by one solitary romp are pretty slim. Even if they did have sex, I would say about a 5 percent chance the baby is his. And if they didn't have sex? Well, there are tricks sports stars have learned the hard way.

In the U.S., I'm pretty sure it all has to do with one of the parties being under 18 years old and the other being over. Even sexless dates can mean big trouble: There's a sensational case in Wisconsin right now where a 19 year old guy might get 3 years in prison for violating a previous court order and seeing his 17 year old girlfriend. The most amazing detail about his case? His grandfather did jail time in 1970 for exactly the same thing. I guess to teens, felonious dating sounds like a joke until they get charged with it.

Well that will be tricky. Just because the baby is not his does not mean they did not have sex. Unless he proves they did not have sex he will have no basis to counter-sue.

Actually, I think the basis for the suit would be the opposite. I think they will argue that he did not have sex and that since she made the allegations, she should prove them. She did bring the suit up in the first place. In addition, if what samwatters suggested about her is true, she has done this exact thing before.

You cannot expect a woman to know a man is not the father if they did have sex.

It depends on how many partners they have had and in this case how many people they have already accused.

Let's wait and see what happens.

@Ben. Yeah, I agree. I caught the news on a segment of the Today Show from the US. Apparently this is really big news as a lot of mens-rights groups are demanding that Ms. Yeats be treated in the same manner as an adult man who had sexual relations with a minor woman, regardless of the proximity of their age. At the same time, there appears to be a backlash against gold-digging women--fair or otherwise---who use their reproductive powers to enrich themselves. Either way, I think you're spot on: the kid is really getting used. Poor kid....

That is incorrect. Consent laws vary by state. In some, the age of consent is as low as 14 and in others the age of both parties are factored in (in Florida, for example, a 23-year-old may have consensual sex with a 16-year-old but anyone 24 or older may not).

In California (where she alleges this happened) the age of consent is 18 but because she was not more than three years older than him, she could only be charged with a misdemeanor.
