I don't agree with this as they should not be treated as common criminals. they declared war on us! But the decision is made. I'm gonna be right there, everyday until they are convicted and of course receive the most severe punishment. God forbid they anything gets in the way through "technical justice" of mistrails, hung juries, what ever. We gonna get them. When the gov fails to protect the people its time for the people to protect ourselves. Right now, I think the gov has been doing a piss poor job. Due Process is hardly due, but the decision has been made and there is nothing that anyone can do about it.

It appears that the gov't was running out of time to try these criminals. If the gov't had allowed the time to run out we would be in violation of certain laws and might now be able to bring them to justice at all.

If the administration had allowed the time to run out, then we'd have the very same individuals who would complain now about this decision, complaining about not taking action in a timely manner.

The prior administration "dithered" time away doing nothing and when this administration does something, complain.

I guess we'll just have to wait to see what happens.

What gets me as much as anything is the republicans who complain that the torture that they received at bush's blessing could be used in their defense. (But they don't cry because of bush's actions allowing the torture.) The republicans are real good at whining in this situation. The CIA and the republicans shouldn't have allowed the torture to happen at all. Now this action they sanctioned might bite us in the ass. < :-)

Look at it this way, in many cities, the police are an utter disgrace, but usually it is the gangs (at least the uppity ones) and mafia's that keep the neighborhood safe from petty crime or crimes against those who are defenceless.

They are still the suspects. There is no proof that they are actually guilty, yet. And if there were any clear evidence of their guiltiness, they wouldn't have kept them in Guantanamo without sentence.

I think what you mean to write is that they have not been found guilty, yet. Until there is a trial, we cannot know fully whether there is sufficient proof to find them guilty. However, the statement that there is 'no proof' that they are actually guilty is premature.

I don't understand the connection you are trying to draw between evidence of guilt and Guantanamo. Are you attempting to say that everyone in Guantanamo is there solely because there is no evidence against them?

This is the most egregious and offensive thing that I could possibly imagine in handling the mastermind of 9/11 - Khalid Sheikh Muhammad. There is now a very real possibility that the terrorist that killed 3,000 people will get acquited on some legal technicality. This is a stupid and asinine decision by the Obama Administration.

This is not a criminal matter. This is a matter of terrorism and war. It is a insult to the people of New York to bring the terrorist behind the murder of so many of their fellow New Yorkers to their city - just blocks from the former site of the World Trade Center. Was Muhammad read his miranda rights when he was apprehended? This alone could be the basis for an acquital in a criminal trial. President Obama is so naive and short-sighted in his handling of this matter that it is completely incomprehensible.

There is no rational reason to prosecute a combatent during war time in a civilian court. It is totally unworkable and is a threat to national security. How much classified information will have to be divulged to defend the terrorists? Why put a huge target on New York city for other terrorists to take advantage of? Think of the huge propaganda and recruiting bonanza this is going to be for terrorists as they turn this ill-conceived proceeding into a circus and platform for espousing global jihad against the United States.

This is just awful and could very well turn into a huge debacle with terrible future repercusions. Nothing good will come out of this decision. We can only hope that the outrage of Americans will force Obama to reverse this decision.

I almost feel sorry for repubs,ordinary middle class people and those who still cling to their patriotism and belief in the constitution.. This is brilliant move by Obama, almost diabolical. Big ups to him for blowing off tradition and the he-man thing of announcing his decision at a press conference and instead dropping it on the public while hes away in Asia. Too funny!

Now that's the problem. How much information will the US have to show? My guess is that the defense will try to force the US to expose as much of our anti-terrorism network as possible, then cry foul when it's not done. In the meantime, Mohammed will be feeding information and instructions to his lawyer which basically gets him right back into direct contact with his terrorist buddies.

Our courts just aren't sent up for this. Maybe Holder has a way to safeguard some of these things, I don't really know. But unless he does, it might be better to just let these men walk free than give them detailed information on our anti-terrorism program while allowing them to plan future terrorist attacks through their lawyers.

The reason that the terrorist stayed in Gitmo without charges and without being tried is very simple. george bush was real good about attacking Afghanistan without any strategy. he attacked Iraq without any idea what to do once we were in there, except "stay the course" and once the terrorist were in Gitmo, all he knew to do was to torture them, because dick cheney said to.

Then when someone comes along and takes responsibility to convict these terrorists, all the republicans do is cry.

I guess the republicans would have felt better if Obama had gone past any legal guidelines and then been caught with his pants down and nothing to do but release the terrorists. Talk about whining. They would have just gone berserk.

But since he's doing something, all the republicans do is look for another reason to whine. < :-)

I call Bullsh*t on that one. Wouldn't matter if it was Bush or Obama, its a bad idea any way you look at it. No, bad idea doesn't begin to cover the situation. Lousy, horrible, moronic idea begins to approach the rank stupidity being demonstrated in the highest levels of the Obama administration. And yes, I would have said the same thing about Bush had he been stupid enough to try this crap.

Lets think about this for a moment. Setting aside the issues of precedent, and granting terrorist rights they don't actually have under the constitution. Lets talk the facts. Was KSM read his Miranda rights? Was he treated properly while in detention. Was he provided a lawyer on request, was he given a speedy hearing and trial. What about his confession? Every single one of these is qualifications for dismissal, and in the unlikely event that it proceeds to trial, and the judge sets aside every single legal issue about these things, they are then grounds for appeal.

I'll say this again. Doesn't matter if it had been Bush, Obama, or a to be named ultra conservative president elected in 2012. Whoever did this, is an idiot.

If this administration has no problem with putting some of these jihadi's before a military commission (tribunal) and it is obvious that they don't. Why for gosh sakes not put all of them before one??????

You know, I just had an idea.. how confident can one get in knowing that should they blow a bunch of people up for a cause or kill a few thousand people that they can be tried in a regular court of law and have a 50/50 chance of walking off.

American justice is not capable of trying such people.

It'll be tough, I'll agree there. But we've held trials on other tough cases. There was the blind cleric. There were the bombers in the first attempt to bring down the towers. Both held in NYC and both came out with guilty sentences.

USAFdude.... It's my understanding that you need two things. You need to first decide the status of the prisoner and what rights he has, then you have to decide how to put that person on trial. Both requirements have been challenged by various parties which has resulted in a lot of different court cases which has pretty much stopped the process entirely while the legal issues are being worked out.

Personally, I think they should be held as unlawful enemy combatants, given humane treatment, and then sent to military tribunals.

Actually I was agreeing with you bushlover. Yes, it will be hard to find an impartial jury and all the other aspects that deal with as trial of this magnitude and posture. But, it happens and with the results that we would like and we feel are just.

You are wrong - Bush would have been excoriated by the media had he done the same thing. President Obama and AG Holder better pray that none of these guys get off on a technicality - which is very, very possible since this is not a criminal matter - but a military one.

At least New York has a death penalty. Although, if I were the defendant's legal advisor I'd try to get the trial moved out of the city or cite a biased jury. The U.S justice system is so full of holes I wouldn't be suprised if they got let off on a mistrial.

Holder was a senior partner at a law firm that defended Gitmo detainees against the U.S. when he was nominated as AG by Obama. Only the slowest of the slow doesn't understand what's going on here.

This trial, a travesty without precedent, will be held in the grandest of American cities, site of the most deadly foreign attack on our great nation.

The administration that ordered this has lost recently lost independents and moderates.
