Suggesting SC Hur with documents case and SCOTUS with Immunity case have SAME reasoning/see above.

SCOTUS will want to handle immunity quickly. And if they determine they don't need to see it, they won't. They will only see it, if they want to ensure it is clear that immunity will never be used as a defense ever again.

I'd agree with you if it were 3 Hillary SC Justices. Present SCOTUS likely side-steps, like SC Hur above documents case. Problem goes away if Trump wins after all. Last thing SC wants is election involvement, repeat of 2000.

President Biden is visibly wilting Infront of you, I say that with respect, his support of Ukraine, Israel, must be recognised as leadership in office.

Just the man walk away leave office with dignity.

Do the commenters on this site wager on the US Presidential elections? Like even just gentlemen's bets?

7 ( +8 / -1 )

Press Corp has so clearly turned against Joe in link above, questions so aggressive. Clearly media master elites are looking at major 1600 changes to ticket.

Seems SC Bur's Biden fitness assessment, pretty serious nail in the Biden coffin, should expect greater and greater pressure on Biden now to call of re-election.

Not enough to win a conviction.

It would be enough fluff it was Trump.

No, it wouldn't.

SC determined Joe doesn’t have that ability to know what intentional is anymore.

No he didn't and he didn't have any qualified witness to even be able to determine that.

6 ( +8 / -2 )

Not enough to win a conviction.

It would be enough fluff it was Trump.

because SC has to get people to believe it was done intentionally and willingly.

While they are looking at an exhausted confused elderly man that can’t remember.

SC determined Joe doesn’t have that ability to know what intentional is anymore.

-6 ( +3 / -9 )

SCOTUS like SC Hur looks at totality of the issues at hand, including of course remedies. Clearly there is no legal remedy that justifies charging Biden with crimes he obviously committed. It's very pragmatic but true.

Neither wants to press forward, waste time, resources and their goodwill, if there's no clear benefit to doing so.

Especially if their involvement risks influencing an election. They'll almost always opt to stand down or delay in order to clearly establish their non-partisan role.

What are you talking about? SCOTUS has nothing to do with this.

Suggesting SC Hur with documents case and SCOTUS with Immunity case have SAME reasoning/see above.

-7 ( +2 / -9 )

Remember US sworn enemies are emboldened when a US President vulnerabilities are on public display..

-1 ( +4 / -5 )

No one is questioning whether Joe Biden is a sympathetic, well-meaning, elderly man with a poor memory

sometimes I am questioning the well meaning but then I just conclude his family and those around him are taking advantage of his name, title and power as he becomes less and less “aware”.

that’s not Joe’s fault.

In 2020 you said that he was running his campaign out of his basement.

And yet he still won.

We now know how, the GOP won’t make that same mistake again.

Well, Trump looks like the front runner, so it doesn't seem they have learnt their lesson...

They are polls. Hate to break the news, but you don't get to be president by winning a poll.

So how would you win? Show me where Biden is popular where he has a record-breaking crowds coming to see him where you have a lot of people thanking him, and I’m not talking about illegals. Maybe if you cheat your way, you might have a point there.

Real legal question outstanding's whether or not SCOTUS takes up Trump's Immunity Case and whether they 'slow-walk it' past election - predict they do, need 4 justices to agree, SCOTUS looking for an offramp.

Most likely SCOTUS won't take it up, but if they do, they certainly won't 'slow-walk it' the past election. That would be tantamount to election interference.

3 ( +7 / -4 )

200 pages into the report the SC contradicts himself saying there is no evidence that the retread willful.

Biden self-reported, gave the records back and by the SC’s own admission, cooperated with the investigation.

There’s also an entire section contrasting that with Trump who lied, tried to hide the documents, obstructed their return, and obstructed the investigation.

And that’s why Biden isn’t being charged and Trump is.

This is nothing grasping at stews by his cultists to cover for a week when:

His immunity claims were destroyed.

He intentionally scuttled a boarder deal his own party negotiated for no other reason than political gain.

His incompetent rubes in the House failed to impeach a cabinet member for no other reason than optics.

Biden misspoke at a news conference.

Trump is a sociopath, and a stupid and incompetent one at that.

He’s also a felony defendant and will be convicted in multiple jurisdictions this year because he is guilty AF of the crimes he is indicted for.

Post conviction, nobody but the cult will care that Biden called Susie the president of Mexico.

2 ( +6 / -4 )

Classified documents cases don't add up to much for the public. Trump's key point remains, Biden had all these docs from his days in Senate and VP - strictly prohibited. Former Pres. has legal permission with 'constraints'.

-5 ( +0 / -5 )

It is cruel and I have heard stated, unamerican to witness Joe Biden visibly shaken, in fact wound when presented with the growing accusation that he is suffer from acute memory loss, especially when related to his family loss

Harris quoted word for word Biden attorneys....  "gratuitous, inaccurate, and inappropriate.”

-2 ( +1 / -3 )

AG Garland's hands tied, couldn't mess around with edits given independence of SC Hur, would be flagrantly partisan and damage both DOJ's morale & goodwill.

It would also give rocket fuel to Trump's campaigning.

Biden's badly wounded politician now, making VP Harris more front and center - making d's VERY NERVOUS!

-6 ( +2 / -8 )

He’s doing the job.

Not well.

If you can change every single poll, maybe…

-5 ( +2 / -7 )

Naturally VP Harris will take a different view, but she knows the legal game as a former DA (who failed the CA bar exam the first time). Mental fitness highly relevant.

Special Counsel Hur from Biden's own Dept of Justice in his report used evidence of Biden’s “poor memory” to further justify his decision not to criminally charge the president. “We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” the special counsel Hur said in his report.

Translation? SC Hur considered it a poor use of DOJ resources, especially given Biden's age and diminishing mental capacities. Biden's not likely to live a long life given his medical history, brain aneurism surgery twice.

-6 ( +2 / -8 )

Got two of our SEALS killed.

There will always be deaths in the military regardless of who the president is. It's the nature of the business. Killed by accident, in battle, or taking one's own life. Missions succeed and missions fail. There has never been a president who had zero military deaths.

And, many more military dies under Trump's watch...

4 ( +6 / -2 )

HopeSpringsEternal

Mental fitness clearly matters from prosecutorial/Hur standpoint, Biden's mental fitness is already terrible and thus relevant, given his obvious mental decline/aging.

Biden's mental competence is fine, but completely irrelevant to charges not being brought.

your team can’t get out of this one. It’s mentally deficient and 25th Amendment and done or he’s fine and criminal trial.

You din't understand. Hur didn't indict because he thinks Biden is mentally incompetent, and therefore can't sit for a trial. Hur didn't indict because he doesn't think he has a case that he can win.

That's all. There is nothing to do with mental competence about this.

4 ( +8 / -4 )

It's worth noting special counsel is more less deciding whether or not to move forward with charges. It's clear Biden committed crimes regarding possession of classified materials that only a President can possess.

Since Biden's in office and cannot be charged while in office as Pres. and is getting older, SC Hur knew earliest likely court date would be years AFTER Biden leaves office, which would be Jan 2025 if he loses re-election.

Mental fitness clearly matters from prosecutorial/Hur standpoint, Biden's mental fitness is already terrible and thus relevant, given his obvious mental decline/aging.

Yeah, he will, he did last time. That is the reason why they fear a Trump Presidency. We went through this before with him.

Closing the border costs $, too. You have shown you are fine with that never happening, though.

Abbot is doing a good job, now that is a true patriot in every sense of the word.

-6 ( +3 / -9 )

If you read the report (posted above), you'll see photos of a certain filing cabinet containing many secret documents. One of the handwritten labels on a particular folder is "Afghanastan".

-6 ( +3 / -9 )

The 64 dollar question is when will the democrats blame it on the Russia/Putin-interference bogeyman.

Merrick Garland already committed, in a statement last year, to make public all special counsel reports (as with every such report). And Biden’s White House opted not to assert executive privilege over any portion of Hur’s report.

Their own blame game has significant limitations.

-6 ( +3 / -9 )

They typed it up for you.

No, that is what is happening

Yeah, the Israeli-Gaza war is pretty terrible.

Got two of our SEALS killed. How many Americans have died now during this conflict, not including Russia and Ukraine?

No, a laughing stock would be "I asked him and I said its not Russia" or leaving Ukraine with no weapons when you can afford to do otherwise.

So then why do most Americans oppose it, we do have a say, we told Johnson no more of our money and he listened, that is doing your job.

I suppose you think he should have been manning the anti-drone weapon in Jordan?

He is the President is he not? Biden did say, the buck stops with the President, ok, I will take his word for it.

You think this will be remembered.

Yes, the families, the Pentagon, the GOP, and the average American.

It is already forgotten in light of MAGA treason.

If that were true Biden would be up in every single poll stomping a mud-hole into Trump, that is not happening, far from it.

-8 ( +3 / -11 )

The NYT is not super left wing. Come on.

Yes, they are, they have always been historically.

Anyway, no one disputes Biden not operating as sharply as 10 years ago. But this characterization of him as mentally incapacitated is just drama making.

Especially when you see how the WH is defending his condition. Jill seemed enraged that no one stopped the media from pounding on him, she had no room to get angry at anyone, she should protect her husband, and knowing his declining mental state she shouldn't subject him to that kind of torture, it's not about her whether she hates Trump or not.

He’s doing the job.

It won’t be the Trump campaign that matters an Iota whether Joe Biden memory has forsaken him

It will be the American people at the ballot box.

Age isn’t just a number. It’s a profound and growing problem for Biden.

The Whitehouse press pack were unrelenting, harsh maybe, however gave an insight into a 2024 US election campaign that could well become a bridge to far for Joe Biden.

0 ( +5 / -5 )

Now Biden and his aides are blaming Merrick Garland. It's all his fault you see. Behind the scenes they are saying he has no position in a hypothetical second term. They are also reportedly angry at him for not having Trump thrown in jail by now. The knives are out and the blame game is in full swing.

The next logical step is to release transcripts and audio/video of this 5-hour interview (over 2 days) and put this matter to rest.

Here is what Robert Hur and his team said:

https://www.justice.gov/storage/report-from-special-counsel-robert-k-hur-february-2

-4 ( +5 / -9 )

“[Hur] did not believe the evidence met the standard for criminal charges, including a high probability that the Justice Department would not be able to prove Biden’s intent beyond a reasonable doubt.”

Or is Hur also a deep state swamp creature?

Translation, we will legally protect you, but cognitively you are compromised in a nutshell. Seriously, if Hur recommended charges you honestly think that the left or Garland would allow Biden to be indicted seriously?

-5 ( +5 / -10 )

It’s mentally deficient and 25th Amendment and done or he’s fine and criminal trial.

It will be neither. Guaranteed.

And you will have to find something else to look forward to. Again.

your team can’t get out of this one. It’s mentally deficient and 25th Amendment and done or he’s fine and criminal trial.

-6 ( +6 / -12 )

then Hur is wrong and Biden can go to trial for his crimes of retaining and disclosing classified information?

No. Mental deficiency is not the reason for the absence of criminal charges. There simply isn’t evidence that Biden had criminal intent to defraud the government. Like, for instance, lying about what he’s got and ordering underlings to move boxes when faced with noncompliance.

Per the article:

“[Hur] did not believe the evidence met the standard for criminal charges, including a high probability that the Justice Department would not be able to prove Biden’s intent beyond a reasonable doubt.”

Or is Hur also a deep state swamp creature?

3 ( +9 / -6 )

No, it isn’t.

Yes, it is, we all see that and the left can stomp, scream and say “No” all day long, but they cannot stop the images of what we see on TV and we see a man that is cognitively on a rapid decline.

I worked for 6 years in an Alzheimer’s and senile dementia ward. My personal anecdote is stronger than yours.

I don’t think so. At this point I doubt if he can even complete his fist term, definitely not a second Term

-4 ( +6 / -10 )

From this moment on they will keep Biden away from a lectern or microphone and journalists. Harris will finally sink the ship. No wonder they don't want a televised presidential debate.

It should have been obvious when he was using flash cards at press conferences with the softball questions of rigged journalists whilst taking questions.

-7 ( +3 / -10 )

then Hur is wrong and Biden can go to trial for his crimes of retaining and disclosing classified information?

can Trump also be classified as an elderly man with a poor memory and drop the charges?

-5 ( +5 / -10 )

The administration spin is classic wanting-it-both-ways. He played the elderly man who couldn't remember the incriminating parts and got a pass with the non-prosecution. But now they take umbrage as it being described as such by Hur and his team, who outlined it in a 450 page report, fully referenced with photos (read it if you have time). They even had the decency to attach Biden's lawyer's (WH and personal counsels co-signed) letter of objection on the tail end (they got to review it before it was made public).

Always important to remember the context here: Biden's obsessive document habit happened before he was president and thus is not covered by the immunity granted to presidents. The law is not retrospective.

There's never been a time in US history where the leading presidential/vice-presidential candidates and the entire Congress has comprised more mentally and physically incompetent and unstable people.

And let’s throw in Putin, Trudeau, and most of the world.

No one wins and everyone loses.

Hur said his investigation "uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen."

Mr. Biden shared information, including some classified information from those notebooks with his ghostwriter," Honig said, quoting from the report.

Biden is displaying signs of absent mindedness that comes with age.

No, it’s dementia. I have 2 people in my family that are going through it, I know for a fact that is exactly what we are witnessing right before our eyes and it’s progressing rapidly at this point.

But Trump literally thought Nikki Hayley, a woman young enough to be his daughter, was actually Nancy Pelosi, a woman old enough to be his wife. It wasn't a slip of the tongue, it's genuine mental dementia.

No, it’s not and Trump hasn’t had a history past or recent with anything remotely close on a consistent level, Biden does.

-Red States and Green States

-Can’t remember that is son died or when he died.

-Says he spoke to Mitterand, although he’s been dead since 1996

-Confuses Mexico with Egypt.

All in one week and there’s more.

And that's what separates the two - one a man who still has good judgement and Trump, a man who is clearly displaying symptoms of dementia

Trump is willing and begging to take a cognitive test, Biden isn’t, now why would that be? If Biden is as fit as a fiddle mentally he would shut Trump up and challenge him to that offer. If he passes it would make Trump look like a fool. Biden doesn’t have anything to lose. He should do it.

-4 ( +5 / -9 )

The elephant in the room is this: by this stage he has held 88 interviews - relative to Trump over 300 and Obama 400.

Dean Phillips is correct. He called this long ago. Look at his X feed.

He seized up and couldn't remember who Hamas were and described them as "the opposition". Yesterday he confused "the press" (journalists) with the public.

Hur is a well-respected lawyer and obviously correct too.

For essentially the same crime.

Except for the part where Trump hid documents, and lied to investigators and his own attorney.

The special counsel was empowered to bring or decline to bring charges. He chose not to.

For essentially the same crime.

He was not empowered, nor is he qualified to render neurological diagnosis.

But if were the other way around with Trump it would have been acceptable and you would have defended it. I mean, like with the NYC case. None of us are experts and none of us were there, and yet, people still thought he was guilty, so to your point, these people in both cases are not experts, they are just going by what they see or feel.

This was a salacious swipe worthy of James Comey, and it was not in keeping with DOJ policy.

Oh, well….

But in that case it was Hillary who was responsible for her own downfall and no one else.

-6 ( +5 / -11 )

He didn’t. Special Prosecutor said so.

he actually crimes were committed by Biden. Willful retention of classified documents.

just he is too mentally incapacitated and lacking mental faculties to be charged and go to trial. They don’t think they can prove he has the ability to take willful actions he is such mentally roast.

It’s criminal trial or 25th Amendment removal.

a very smart guy said:

"The 25th Amendment is of zero risk to me but will come back to haunt Joe Biden and the Biden administration. As the expression goes, be careful what you wish for," Trump said, reading from prepared remarks.Jan 12, 2021

Sanders was doing very well before being sabotaged by the DNC.

But not well enough to win in a general.

Between being undermined by the DNC and the GOP's using "socialist" as a pejorative for anything it doesn't like, like universal health or having billionaires pay taxes, it wasn't fair.

It was, robbing Paul to give to Peter will last only for so long. Even the Dems know this.

Shows US politics is not based on things like the quality of ideas, or even mental health.

Well, I support all of it as long as it’s done privately.

Ok, but were they in the room or with them if that even happened? Even Anderson Cooper looked at her like she had a few bolts loose.

He’s a sex-offender in the eyes of the law.

No, in NYC

Your opinion is irrelevant.

As is yours.

And thought his victim was his second ex-wife.

Trump loves to dig at his enemies.

But we better give into him because Biden might get us into “World War II”….

Is it slowing down? Don’t look like it, so….

Oh, and can’t remember that he beat Hillary Clinton and not Obama.

Well, technically we all know who’s really in charge behind the curtain.

Trump not only floating conspiracy theories to discredit Haley based on ethnicity,

No one wants her. Look at the polls, the longer she’s clinging on to this campaign, the less chances she has politically to do anything in the future.

he seems to confuse her with Nancy Pelosi.

Ok one for Trump over Biden’s 5 in one week and that’s just this week.

You know one senior who is still sharp as a tack than either one of these at a more advanced age?

Bernie Sanders

As far as we know, anyway, doesn’t matter, the U.S. is not going to vote for a Socialist.

Says the defender of the adjudicated sex-offender who thought his victim was his second wife and thinks he best Obama.

He best Obama and I’m not going to comment on sexual allegations because I wasn’t there, but listening to that woman talk, yeah, I find that very unlikely.

I didn’t know that the special counsel was also a licensed neurologist?

So wait, when they charge Trump or when they give some recommendation or comment about his conduct it shouldn’t be questioned, but in Biden’s case, and Biden’s DOJ, they don’t know what they’re talking about except when it comes to Trump. This is just pure ratings goal and no matter how they spin it, Biden and his staff can’t make us unsee what we saw and see on a daily basis, a very serious rapidly declining mentally cognitive Biden.

Did he get his degree from Trump University?

Failed humor attempted?

Her comments came a day after Biden insisted that his "memory is fine." and grew visibly angry at the White House, as he denied forgetting when his son died. Beau Biden died of brain cancer in 2015 at the age of 46.

That was a low blow.

The reality is American voters are once again presented with the duopoly choice of two seniors long at the highest levels of politics and business, both who exhibit cognitive decline.

Relax. He's fine.

He’s not. If these media pundits believe Biden is fine then they should have no problem with him being charged under the Records Act! You can't have it both ways. Biden said we have red states and green states, put Mexico in the Middle East, and couldn’t remember the cemetery where beau is buried, St Joseph’s.

All in one week.

So we should believe a spokesperson that the report was wrong or deny our lying eyes.

Abdel Fattah el-Sisi, the President of Egypt is actually the President of Mexico. Francois Mitterand is the President of France and Helmut Kohl is the chancellor of Germany.

And the liberals call 'Orange Man' dumb.

And yet none of that is as bad as saying that WW2 is about to start.

They ‘re both too old to run for President and both have made blunders. When almost every public word you say is recorded and analyzed there will be gaffes.

Attacking Biden for being 81 is hypocritical because 45 would be 81 during his term if he became 47.
