Given the numbers of guns in the US and Americans frequent use of them, It will be a brave petrol pump attendant who refuses to fill an angry drunks car.

It's that last paragraph in the article. I was thinking the same thing from the beginning. I haven't had anyone pump my gas for me, nor have I paid for gas to a person, in years. Unless you put breathalyzers at the pumps so that they can't be used if there are indications of being intoxicated, I don't see how gas stations could be seen as liable.

I see no practical way to enforce such a rule with remote pay at the pump gas purchases. If this is enforced it will be the end of pay at the pump in New Mexico. Actually, enforcing this might create enough public anger at the resulting inconvenience and higher prices to pay for more employees to enforce the new rule to force a change.
