This case was very strange from the beginning. What is NOT mentioned above is that the alleged rapist is also an illegal immigrant. No mention of the status of the victim, but sadly there is a lot of sexual abuse in the illegal community

A ten year old child is a ten year old child.

The poor girl is already going to suffer trauma from this horrible ordeal, possibly for the rest of her life, and they want to add to her hell by forcing her to give birth? Incomprehensible. 2020, the exception is not for rape, it is for the health of the mother. And fortunately, at such an early stage, it can be done medically rather than surgically.

And as I said previously in answer to you, no doctor in Ohio will make that call at this point in the pregnancy, because they face the full weight of the law if anyone questions whether they can prove that the mother's life was in danger.

The AG isn't taking that risk, so he can say anything. And in this case lies.

There is a difference between reporting the information to police, and illegally disclosing confidential medical information. This isn't how HIPPA works.

Absolutely false. The Ohio law has provisions to protect the health of the mother, but they won't kick in until you can say that she would likely die. And at this stage no doctor wants to get prosecuted for making that call. Which is why these laws are evil. It's also why she had to travel to Indiana.

And he's full of it, just like people making this claim. There isn't a carve out in the abortion ban for minors.

In order for her to be able to get an abortion, she would have had to wait until her life was at immediate risk. Is that really what should happen? Should rape victims, minors no less, be forced to carry kids they can't care for up until their life is put in danger? This is shameful.

Unless the doctor has a hotline to the AG, he's not risking it. No, the AG is lying because it make Ohio abortion laws look bad. The law categorically does not have an exception for rape. So you tell me how an abortion could have been legal.

The fact that this is the rarest of cases is the main reason why it should be ignored as rationale for changing abortion laws in all 50 states.

Think everyone is missing the worst thing about this story- a young girl was brutalized and possibly traumatized for life. If the suspect did the crime, one can hope that he enjoys a long and violent stay in the general population of a prison, learning what it feels like to be a victim of such a crime.

It IS possible for two things to be right at the same time.

It is possible that the Attorney General didn't hear about the case. From what is here, the suspect wasn't charged until July 12, weeks after the assault. Once he heard, the wheels went in motion.

It is also possible that he is right in saying that the victim could have been treated in Ohio by a doctor. He stated clearly that she did not need to leave the state. As the AG, he has the final say.

As an aside, not sure why I got SEVEN downvotes for saying that the worst thing about the case is that there is a victim, regardless of everyones' political beliefs. That's just cold.

No mention of the status of the victim, but sadly there is a lot of sexual abuse in the illegal community in the US. Women are routinely assaulted on the journey to the US from the south, and it continues once they arrive.

Also, the police were not contacted by the victim or her parents/guardians. The doctor who saw her in Ohio and also the doctor who helped her in Indiana both failed to report the case to the police.

This was handled very poorly by all involved.

Now to the general issues raised;

In Ohio, a child like this does have access to abortion. A doctor can sanction the procedure with no interference from any government agency- it is entirely the doctor's decision.

Anyone trying to make this case a political football should be ashamed. That goes for both sides. Those who called it a hoax need to own up to their mistake. Those using it as a political weapon without looking at the facts need to shut up.

It drew scrutiny as well from the state attorney general, who said that exceptions to Ohio law would have allowed the girl to obtain an abortion in the state and who said he had not heard of a report being filed in the case.

2020hindsight, don't be offended, but I will take the word of a state Attorney General over a random person on the internet...especially in this case.

Even IF a case actually managed to make it to court, it would be easy to prove that a 10 year old child is in danger if they cannot get an abortion. There is no risk to the doctor.
