Trump's lawyers urged Judge Arthur Engoron to stop the case immediately, arguing he had irreparably harmed Trump's right to a fair trial through “astonishing departures from ordinary standards of impartiality." They cited his rulings against their client as well as the prominent role played by the judge's chief law clerk.

In their mistrial motion, Trump’s lawyers accused Engoron of letting Greenfield act as “a de facto co-judge,” and they questioned whether her political leanings were influencing what they perceived as a “demonstrable pro-Attorney General and antiTrump/big real estate bias.”

No they aren't. Also, Trump is trying to muddy the waters because Greenfield isn't the judge. The judge is Engoron.

Trump’s lawyers complained that Engoron’s insistence they they not refer to Greenfield and his expanded gag order barring attacks on his judicial staff “interferes with counsel’s ability to zealously advocate for their clients.”

No, it doesn't. Anything you want to say, can be said in court.

Articles to that effect have shown up in several political news sources. Here's the rub. The court doesn't have to go along. A savvy judge could legitimately refuse to delay the trial telling Mr. Trump that the court sees him doing so as an obvious ploy to delay the trial and the court is not going to go along with it. The judge could legitimately Mr. Trump that he can fire his counsel if he so chooses but whomever he hires to replace them is still going to have to be ready by the trial date.

I would bet more than cold microbrews that such a decision would withstand appeals. Courts do not have to be held hostage by delay tactics. I suspect Judge Chutkan is such a judge.

Lisa Rubin, legal analyst for MSNBC, suggested that the filing of the motion in the court's public docket could come back to bite Trump's legal team in a post to X, formerly Twitter. She pointed out that the motion repeatedly refers to Engoron's relationship to his chief law clerk, something that the ex-president's lawyers were explicitly forbidden from discussing publicly in a gag order issued on November 3.

Rubin also noted that Engoron had told Trump's counsel that he did not want to hear their mistrial motion "in front of hundreds of people," asking them to instead submit a filing that would show cause for a hearing on the matter. She said that Trump lawyer Alina Habba promised to deal with the mistrial motion "in a delicate manner" during the hearing.

"I understood [Engoron] to be instructing Trump's team to submit their proposed order and motion directly to his chambers," Rubin wrote. "That way, he could determine whether to hear the motion publicly and/or whether Trump's supporting papers, which, as filed, seem to violate the very gag order they are protesting, should be redacted or sealed."

Rubin went on to say that "Engoron met with each side privately yesterday" and it was possible that the motion was "filed today with his knowledge and permission."

"But right now, without further clarification, it appears they publicly filed their mistrial motion, brief, and supporting affidavits without such permission—and in a way that likely triggers another violation of the same gag order they claim exemplifies Engoron's bias," she added.

Trump has made a mockery of America's justice system, the best money can buy. This is perhaps the only service he's rendered to democracy by adding another tier to the two tiers already in place for all with eyes to see. If this egregious abuse of the judicial process paves the way for some bigly needed reforms, it will be Trump's unintended legacy. He should have been dealt with like Bolsonaro, the "Trump of Brazil" who has been banned from political activities. Judge Engoron will swat these bogus complaints away like flies and restore some credibility to the system by punishing this incredible scofflaw for his fraud and mischief.

Remember that Trump is facing 91 counts in multiple multiple jurisdictions. He will have to be president behind bars. He could get house arrest, but the problem is he will violate it and end up behind bars where he can conduct his presidential activities with secret service protecting him. Trump people are like Jim Jones followers and would die for him. They don't even want another Republican. It's Trump and only Trump. It's always been about Trump. It's about Trump now and it will always be about Trump.

Grand juries don't. They don't care when Alina says Trump is the best president since Lincoln in front of TV cameras (she really said this on TV). Grand juries base their decisions on legal fact.
