In PA, the deadline hasn't been reached. If your ballot is postmarked on election day, it probably won't be delivered on the same day. Much postal mail rarely is - it often takes a day or two. This is why PA allows three days for ballots postmarked on election day to be counted. I hope this has been educational.

Good point. There are still a lot of votes to be counted. It's unfortunate that some legislators felt that early mail-in ballots were not allowed to be opened and counted early. It could've saved people a lot of time. It's also a shame that Trump feels the need to bypass laws and stifle the voices of Americans by not allowing their votes to be counted. Accepting the loss is fine with me. Let the process work itself out and whoever wins gets the Presidency and, hopefully, the support of the people.

However, looking forward it is obvious the electoral system needs some real and dramatic reform. First, the concept of states each having unique (and often archaic) voting regulations has to go. A national election needs national standards. IMHO this is what is causing so much confusion. Some states count mailed ballots before the election, some during, some after, some have the results ready, some take days... it all does nothing but make the system look sketchy.

Rules for who can and cannot vote by mail/fax/etc need to be tightened up too. Some basic ID requirements for a start. It is obvious the postal service was totally unready for this and have really dropped the ball. As I said before, I wouldn't trust the USPS with a letter containing $100, so why would I trust them with my vote?

Two things that should be remembered by those who are already gloating:

One, the counting hasn't finished yet. The result won't be clear for a long time. Any number of things can affect the result: Arizona could go to Trump, a recount in Wisconsin goes ahead, the supreme court take action on how the mail ballots are counted.

Second, you are making any sort of reconciliation impossible. I know many people think that it is already at that stage, but are you helping, or making it worse?

These "long counts" are another kind of voter suppression, the product of rules imposed in those states by Republican-controlled legislatures that in Wisconsin and Pennsylvania allowed for no early processing of the mail-in vote – despite the pandemic – and in Michigan allowed for only one day of early processing. Everyone saw this problem coming. They also saw how Trump would attempt to take advantage of the uncertainty by stealing the election, which he is, although the effort, as historically dangerous and destructive as it is, does not look particularly brilliant. 

Elections officials from both parties in the states in question pleaded with the Republican legislatures for more time to process votes early, as they do in other states with Republican-controlled legislatures such as Ohio, Florida and yes, Arizona, where the race happens to have been truly close. BUT Georgia is on my mind, a real chance of getting those 2 Senate seats. Beautiful.

Regarding PA, there will be a lawsuit, and it will involve a lot of votes being thrown out. The plaintiff (Trump and/or the Republicans) will win, because Pennsylvania’s highest court has almost certainly violated the Constitution of the United States. That’s why, in the weeks ahead, the Supreme Court of the United States (SCOTUS) is going to rule in favor of Trump....

In 2019, the PA legislature passed a law called Act 77 that permitted all voters to cast their ballots by mail but (in Justice Alito’s words) “unambiguously required that all mailed ballots be received by 8 p.m. on election day.” The exact text is 2019 Pa. Leg. Serv. Act 2019-77, which stated: “No absentee ballot under this subsection shall be counted which is received in the office of the county board of elections later than eight o'clock P.M. on the day of the primary or election.” I agree with Justice Alito: That is unambiguous.

Act 77 also provided that if this portion of the law was invalidated, that much of the rest of Act 77, including its liberalization of mail-in voting, would also be void. The exact text is: “Sections 1, 2, 3, 3.2, 4, 5, 5.1, 6, 7, 8, 9 and 12 of this act are nonseverable. If any provision of this act or its application to any person or circumstance is held invalid, the remaining provisions or applications of this act are void.”

To again put this into common English, the Pennsylvania legislature passed a law that said mail-in ballots had to arrive by 8PM on election day to be counted, and then said that if the Court over-ruled that law, the entire law that permitted mail-in ballots was invalid.

In the face of this clear text, the Pennsylvania Supreme Court, by a vote of four to three, made the following decrees, summarized here by SCOTUS:

Mailed ballots don’t need to be received by a election day. Instead, ballots can be accepted if they are postmarked on or before election day and are received within three days thereafter. Note that this is directly contravenes the text above.

A mailed ballot with no postmark, or an illegible postmark, must be regarded as timely if it is received by that same date.

In doing so, PAs’ high court expressly acknowledged that “the statutory provision mandating receipt by election day was unambiguous” and conceded the law was “constitutional,” but still re-wrote the law because it thought it needed to do so in the face of a “natural disaster.” It justified its right to do so under the Free and Equal Elections Cause of the PA State Constitution.

Just like NC taking 9 more days for ballots to arrive, it allows people to figure out how many votes they need to win and introduce them into the system. NC just had election fraud recently that invalidated a whole election so dont tell me it doesnt happen.

Bet one of the court cases is how many votes were processed after election day in PA. with a subset of those with no postmark.

*It also said that ballots without a postmark would "be presumed to have been mailed by Election Day" *unless there was strong evidence to the contrary.
