What? So they're not actually the guys who fired the weapon, just some important guys who happened to be in the vicinity at the time.

Nowhere was it alleged that these three people were in the vicinity of the weapon.

Its a farce when people start attempting to insert "facts" into the conversation.

It's made pretty clear in the article why these men are being charged. It's no different than going after a terrorist bomb maker even though he wasn't the one planting the bomb.

"These suspects are seen to have played an important role in the death of 298 innocent civilians," Dutch Chief Prosecutor Fred Westerbeke said.

"Although they did not push the button themselves, we suspect them of close cooperation to get the (missile launcher) where it was, with the aim to shoot down an airplane."

Julian Assarge exposed the war crimes by the US in Afghanistan and Iraq and this is way the US is pursuing him. Forget the war criminals, prosecute the messenger. We are the beacon of democracy. America First to hell with the rest that is our democracy.

The US does not recognise the jurisdiction of the ICC . This is another claim of US exceptionalism. Refer war criminals to the ICC but not if they are American war criminals.

While valid when looking solely at peacetime, civilian criminal law, this is an extremely forced prosecution from the perspective of law as an entirety. To move weapons with the "aim to shoot down an airplane" is not a crime in a time of conflict. If that were the case, a lot of CIA operatives will have to be prosecuted for moving Stinger missiles to the Afghans with the "aim to shoot down (Soviet) airplanes".

But hey, anything to get at the Russians, eh?

Dutch authorities said Russia has not cooperated with the inquiry

Old lies die hard. Russians several times asked to be a part of the investigation but were refused. Almaz-Antey, the maker of the Buk missile, turned itself inside out to give the investigators all the information about the missile, but the Dutch wouldn't hear that. Why? Because it will ruin the whole carefully constructed hoax.

 The investigators should concentrate their attention on the exercise of the Ukrainian air defence forces on the day of the tragedy, particularly on the Buk-equipped 156th air defence missile regiment.
