Except that doing so would require an Amendment to the US Constitution. This isn't 'legislation,' as the words are clear and held up in US jurisprudence. So unless they wish to violate the Constitution and use some activist judges, their attempt is just bluff and bluster.

But it's in the constitution. You always say owning a gun is a right, because it is in the constitution. And this is in the constitution. Which would make it a right. But above you are saying it's not a right. Even though it's in the constitution, which you say is what makes owning guns a right.

I can guarantee you that if two Americans have a baby born in Japan, that child is not granted Japanese citizenship. This is common sense. But if two Japanese have a baby born in the U.S. that child is a U.S. citizen according to some interpretations of the Constitution.

I think there are over 30 countries in the world which offer unrestricted birthright citizenship (i.e. neither parent needs to be a citizen). Numerous others offer restricted birthright citizenship.

If Trump wants to go after this he should first ensure he has all facts straight.

I have mixed feelings about this issue as it is a fact that this is often abused and it no longer is used as originally intended. Regardless, the President should not shoot off his mouth unless he knows what he is talking about. If this is going to be a major legislation effort by the President he should ensure he sticks to facts.

I suppose it's theoretical possible. Children of diplomats born in the US are not entitled to citizenship since they don't satisfy the second limb of the 14th amendment test (which is being subject to the jurisdiction of the US). In theory congress could pass a law which exempts all newborn babies from the jurisdiction of the United States. It would be a bit weird, to say the least.

Anyone born in the US is automatically granted citizenship, except the children of diplomats. If you want to renounce the citizenship, you have to be proactive.

Children must be named before they are released from the hospital so a social security number can be issued, and the issuance is how the birth is "registers" with the federal government.

It isn't automatic. International law no longer allows people to be naturalised against their will. You have to take some positive steps to be recognised as a citizen. Practically speaking, the 14th amendment is just a method of naturalisation which waves all requirements other than being born in the US and subject to its jurisdiction, at least up until a certain age.

I have no doubt that this still happens to many people in countries with birthright citizenship despite intl law, and I also have no doubt that the 14th amendment intended it to be automatic (contrary to modern intl law). It's interesting to consider whether the 14th amendment should at least be amended to conform with intl rules even if not fully repealed.

The specific situation that intl law is trying to avoid is what Hitler did when he unilaterally granted citizenship to all ethnic Germans in Eastern Europe and then proceeded to conscript them into the army (which was the obligation of military aged citizens). German courts have actually struggled for decades with whether it is fair to deny these people citizenship on the basis that the violation of intl law made it null and void.

Trump can't just change the US Constitution, but it does need some changes and not just related to citizenship as a birthright for everyone.

Citizenship for birth should happen only if parents are in the USA legally, fully documented, with permanent residency. If one of the parents is in the country illegally, then they must be legally married for citizenship to transfer by birth.

Do you genuinely believe that should be the case? Let me put a hypothetical to you; a Native American couple leave the country to live overseas (say, Brazil). They have a child but never fill in the paperwork needed for the child to become an American citizen. At the age of 18 the child fills in the paperwork but is refused US citizenship because he has a serious criminal record. He isn't even allowed to enter the country where generations of his ancestors are buried. Is that fair or should his deep ties to America warrant special treatment? Is he not slightly 'more' American than a recent immigrant?

The 14th amendment was written specifically for African Americans. The only case that's been before the Supreme Court was about someone who was in the country legally and gave birth while here, then returned back to China. The child, once grown, wanted to return and was told no. It went to the Supreme Court and they ruled in favor of him and ruled he was an American citizen by birth.

The key difference is that his parents were here legally. They did not sneak across the border and gain entrance illegally.

This difference in how they entered will make all the difference in the world and they will rule in favor of President Trump if it has to go to the Supreme Court for final decision.
