I don't know. When a woman wears a skirt so short that when she shifts and recrosses her legs that her undies are easily in view, the invasion of privacy concept is as questionable as wearing a nearly sheer top, a la Paris Hilton and others.

I find it somewhat difficult to consider a skirt to be "fully clothed", and it only gets more difficult at it gets shorter. But so many women insist on going out that way despite not wishing to suffer any consequences for it.

You can sit back and insist that men should just "behave themselves" but the question is, how are you going to actually make that happen? Draconian law? Just so you can flash some skin with a false sense of security? Because even where upskirting gets men busted all the time, it still happens everyday.

I am surprised that in some US states, they make a big deal of the size of a woman's bikini (for being too small, etc.) but it is OK to take pics up the skirt in BOSTON?? WTF??!!

Massachusetts court, well done, good job. Which age again are we living in? Thru your goggles women don't earn respect, don't have the right the way they dress, are open to aggression by perverts, or anyone else, with cameras aiming up their clothes. Are there issues with [mis]interpreting the laws that protect the integrity and equality of women?

@presto345 - nope, it's a loophole in the law. Had a similar case in which my wife and daughter were personally involved where a marina owner in NY installed cams in the women's change room. Wasn't a crime because, at that time, NY law said the vid had to have audio to be an offense. Soon got that law changed. Moved the boat.

Agree with the perv bit, but the courts are stuck with the law and most legislatures are very short sighted unless it comes to stuffing their own pockets. Or is that too cynical?

This is the great thing about the law in a society governed by a representative democracy. They can now change the law to strengthen the privacy rights of people in public. By the letter of the law as of now it is legal to take such photos. By this time next month or when the state legislature convenes such action will be illegal.

JVJ- Fully clothed and displaying undies weather intentional or accidental is one thing. The garment were of her choosing. An unsuspecting woman violated even with only a photo of here undergarments or less, is perverted and deserving a punch in the mouth. Is their a law saying "retaliation of a perverts action resulting in a KO punch is prohibited"?

for one thing.. why do little school girls where mini dress even in winter... is it legal to beat the crap out of someone who offends or attacks girls, women or an old ladies.. people who have little to no respect even for their own mothers.
