@ *Hallowed : *He has kidney failure suddenly! He was arrested illegally! This is all part of a grand conspiracy! His wife didn't know about the money laundering! The Earth is flat and chemtrails are real!

*If this is all the defense has got, Ghosn is definitely ghosin to ja**il*

Eloquently stated! True the defense is grasping at straws.

The Judicial system allows for the treatment of illnesses .

Greg Kelly had / has problems with his neck/ vertebrae and was treated; in fact had surgery..

Ghosn's medical needs will be equally addressed.

@Reckless: So sad. She made a tragic mistake

.

.

No. It's a smart move.

I think - for one thing - she realized France was not going to interfere with the J justice system.

Her hope was that the French Justice Dept would protest.

.

But Renault has a bag full of evidence against Ghosn which it has passed to French prosecutors.

Realizing that France was not the panacea she had hoped, she leaned on the advise of the French lawyers to return to Japan.

.

It would look better for Ghosn if his wife was not out of the country.

.

Besides, the Japanese prosecution is NOT going to arrest her.

.

They have evidence, and they want to question her on that evidence -l ike lawyers do in EVERY case- even in No America.

And if w potential witness is not willing to cooperate, lawyers will issue a subpoena.

.

It happens all the time.

.

That's all.

With Renault's discovery and French prosecution now involved - it is clearly MORE than a boardroom coup.

.

.Ghosn's got to get real.

Moreover Ghosn broke the bail agreement by setting up a Twitter acct - and twitting.

It an in-your-face disrespect of the latitude granted him.

Ghosn saying he is "innocent" does not make him "innocent."

Conversely, saying he is culpable does not make him 'guilty"

.

Since his bail - NOT ONLY J prosecutors, but also Renault has discovered evidence of Ghosn's complicity in the in the diversion of R-N moneys via Paper Companies for Ghosn;s personal use.

.

This 'evidence ' still has to be proven in court - but the allegations are very serious.

@ Joe Yan

You got it ! :-)

.

Also it will make it easier for the defense to argue for Carlos release if his wife is NOT out of the country - though he did breech bail agreement by tweeting..

.

She was advised to return.

It will be an upward battle for Nissan.

Many issues in terms of assigning new and CREDIBLE management team ; as well as the up coming litigation to address.

But I believe nissan can show itself to be a come-back kid ,esp bc the shift to electrifying.

.

She returned to Japan for several reasons

.

Macron ignored her and the French J D in effect washed their hands of Ghosn's case as it is played out in Japan.

.

Ghosn is under investigation in France ( as Renault has passed compromising documents to the French prosecutors) and so, likely it may be 'safe'r for her i n J apan

.

Carole's absence from Japan would make it more difficult for the defence team to secure release for Carlos .

it's a strategic move one her part.- Probably well advised by their French lawyers.

.

The prosecutors will not arrest her.

.

They did not seize her US passport bc they confiscate stuff for evidence.

.

Apparently the Lebanese passport had 'evidence' which the US passport did not.

@Tokyo-Engr

.

Thank you . Excellent article.

.

Though Carole Ghosn recent flight from J casts new doubt on whether Ghosn

(i) is potentially a flight risk (even without passports -as he may seek asylum in the French consulate)

(ii) given the new evidence @ Ghosn's 'Shell' companies ,which he assumed would not come to light, he may now not be able to resist the urge to tamper with evidence.

.

AND the new Twitter account is clearly an insolent 'make my day' challenge to the prosecution's bail terms. (whether he set it up or had Carole set it up)

He was complicit and intentional in this.

@Kenji : Saikawa is trying hard to break up the alliance.

.

Saikaiwa's day at Nissan are numbered.

Saikawa is a puppet.

Nissan is a J company - and its the J business infrastructure that will wrestle for it's autonomy or at the very least a more balanced power sharing.

.

IMO :-)

@ Ascissor:

It's a good question.

Personally -coming from a liberal 'democratic' country, I have contended for, and continue to contend for inherent human rights and judicial safeguards.

.

Yet, being a pragmatist I realize I cannot change the J system.

It plays itself out the way it does - not necessarily granting individuals 'right's' the way I presume a person is entitled to; not only judicially but equally within the various institutions and infrastructures in Japan.

.

{ For example expectant mothers -who are professionally engaged - traditionally, are not guaranteed their jobs/ positions back after they have a child (as they are in my home country) ; or, for example, the J ethnocentricity that denies non Japanese optimum professional mobility ( which would be discriminatory & penalized in my country .)

There is a lot more . .

.

That being said - this case is about an executive who lavishly profited through his employ at a J corporation - but surreptitiously exploited his position by violating ethical and legal parameters for personal gain .

.

I suppose he would be intelligent enough to accept that if he played foul in this territory, he would be penalized by the same system.

2020hindsights : What is disturbing here is that the prosecution seem to have been going on a fishing expedition..

.

In legal terms it is call " doing discovery'.

.

Every legal counsel is researching ('fishing') for evidence to support their case - whether prosecutor or defence attorney.

Jenn Schiebel : Detaining people for excessively long periods of time, with limited access to lawyers or visitors while the prosecutors can spend hours a day interrogating them ... it is definitely "hostage justice."

.

Ummmm . . .so you are referring to the still unresolved controversy around the treatment of untried captives at Guantanamo?

Reckless : A poor analogy. More like the store manager who tripled your sales, cut costs and saved you from going out of business, and who is then ACCUSED of skimming the till by an incompetent and racist assistant manager named Saikawa.

.

Embezzling is never OK - no matter how much one contributed to the company!

.

Lest all you 6-packers forget, Ghosn only "built' Nissan by ruthlessly firing 20,000 workers, closing 3 factories.

There was very little ingenuity on Ghosn's part involved in the early bounce back out of the 'red'.

@ quercetum Maybe we don’t even need to have a trial. Just let the media decide then.

.

He already has had 2 skype interviews,

.

And His lawyers will release a video April 11 to the media where Ghosn will defend his case.

Looks like the media rush - trial via public opinion - is Ghosn's preference.

@ chipstar

.

Listen her name kept coming up as CEO for some of the Dummy companies Ghosn set up - at least over 10 of them -

.

He was siphoning Renault-Nissan funds into these companies for personal and family gain.

.

It would have been grossly remiss if the prosecutors would not want to question her about what she knew.

.

Nevertheless if the prosecution has enough to charge her, they can have her extradited or get Interpol involved. {There is no safe haven for international crime}.

Moreover running to France was somewhat of a poorly judged and precipitous act, bc the French are not welcoming her with open arms.

.

RENAULT is investigating all of this as well; the Finance Ministry in running audits to ensure Ghosn did not evade taxes - and - likely US will follow as some of the dummy companies Carole is CEO are based in the USA.

..

Likely, Carlos and Carole l colluded.

His lawyer, Hironaka, conceded that he did not know where the tweet originated - though it was was not from the lawyers office.

Carole fleeing Japan simply to avoid procedural interrogation ( given that she is CEO of some of the dummy companies) will not sit well for Ghosn either.
