As the government should not meddle in decisions of courts the courts should not ignore agreements between governments (the 1965 Treaty).

And how can a court of SK today apply the present laws of SK on an issue that took place at a time and location when there was no Korea and no Korean laws. It all took place in Japan and Japan's laws of that time would need to be applied by a Japanese court.

It is possible for a lab holding a virus that matches 96% the corona virus simply because similar viruses exist in bats and other animals and may be kept by a lab. The SARS virus is one known virus similar to the corona virus. From a lab holding such a virus one cannot conclude that the corona virus originated from that lab.

490 mio. Yen divided by 30000 employees is only 16333 Yen per employee. Over a span of 18 years makes 907 Yen per year per employee on average. Did any of these 30000 employees within these 30 years ever notice? Maybe not if the difference is so minimal.

@OreiO: If foreign withholding tax cannot be fully deducted in the current year the remaining amount can be carried forward to the next year. Anyhow, foreign withholding tax is tax on foreign derived income that is not yet declared and taxed in Japan. So this is not a case of double taxation.

@garypen: There is no tax on assets abroad declared (if above 50 mio JPY). If you are residing in Japan the income derived from these assets is taxable though.

@OreiO: For a resident there should be no need to pay income tax outside of Japan in the first place. Tax withheld at source can be deducted from income taxes payable in Japan.

There is an exchange of information between OECD countries. Country A will report to country B if accountholder lives in country B. If this information shows income in country A which is undeclared in country B the account holder has a problem. The new proposed regulation is meant to have documentation at hand that facilitates the calculation of taxes for past undeclared income.

The moment Nissan declared to have found in their internal investigation that payments made were for private use of Mr. Ghosn they inadvertently invited the tax office. Such payments are not deductible from income and therefore taxes are due. Whether Nissan's findings are correct is not the tax office's concern. If Nissan states as it did taxes need to be paid.

The use of the company leased jet for private purposes does not need to be illegal but the cost incurred and carried by Nissan can be regarded as Mr. Ghosn's income and taxable as such. From Nissan's side it can be regarded as a gift to Mr. Ghosn and as such not as tax reducing costs. Both sides' tax declarations would need to be amended.
